This document is a license agreement between a licensee and a company for use of software. It grants the licensee a non-exclusive, personal license to use one copy of the software to develop a single end-user application. The licensee cannot modify the software or its documentation and can only distribute the end-user application, not the software itself. The company provides the software "as is" and is not liable for damages from its use. The agreement is valid indefinitely unless its terms are violated.

1. License Agreement - MERGEFIELD software «software» This legal document is an agreement between MERGEFIELD licensee «licensee», the Licensee and MERGEFIELD company «company». By installing MERGEFIELD software «software» on a computer, you are agreeing to be bound by the terms of this agreement. If you do not agree to the terms of this agreement, promptly return the unopened package, together with all the other material which comprises the product, respectively delete all MERGEFIELD software «software» related files. Subject of agreementThe subject of this agreement is the software MERGEFIELD software «software», the operating manuals, online help files and all other accompanying material. It will be referred to henceforth as MERGEFIELD software «software». Grant of license MERGEFIELD company «company» grants the Licensee a non-exclusive, non-transferable, personal and worldwide license to use one copy of MERGEFIELD software «software» in the development of an end-user application, as described in section 3 (below). This license is for a single developer and not for an entire company. If additional programmers wish to use MERGEFIELD software «software», additional copies must be licensed. End-user applicationAn end-user application is a specific application program that is licensed to a person or firm for business or personal use. The files which are not listed under section 5 must not be included with the end-user application. Furthermore, the end-user must not be in a position to be able to neither modify the program, nor to create MERGEFIELD software «software» based programs. Likewise, the end-user must not be given the MERGEFIELD software «software» serial number. RoyaltiesServer-based programs which have been created with MERGEFIELD software «software» may only be installed on a single server, but may be accessed by an infinite number of clients. Additional licenses are required when installing MERGEFIELD software «software» on more than one server. Redistributable files MERGEFIELD software «software» contains an additional commmand line registration tool for installing MERGEFIELD software «software» on a server. This file is not redistributable. CopyrightThe Software is the property of MERGEFIELD company «company». MERGEFIELD company «company» reserves all rights to the publishing, duplication, processing and utilization of MERGEFIELD software «software». A single copy may be made exclusively for security and archiving purposes. Without the express written permission of MERGEFIELD company «company» it is forbidden to:• Alter, translate, decompile, or to disassemble MERGEFIELD software «software».• Copy MERGEFIELD software «software»'s accompanying written documentation.• Lend, hire out or lease MERGEFIELD software «software».A permanent transference of MERGEFIELD software «software» is only permitted when the Licensee retains no copies and the recipient declares her/his acceptance of the conditions of this agreement. Exclusion of warranties MERGEFIELD company «company» offers and the Licensee accepts the product 'as is'. MERGEFIELD company «company» does not warrant MERGEFIELD software «software» will meet the Licensee's requirements, nor will operate uninterrupted, nor error free. LiabilityWith the exception of damage caused by willful or gross negligence, neither MERGEFIELD company «company» nor its distributors are responsible for any damage whatsoever which is put down to the use of MERGEFIELD software «software». This is valid without exception, including loss of profits, lost working time, lost company information or other financial losses. In any event the liability of MERGEFIELD company «company» is limited to the purchase price. Trial version limitationIf you are installing a trial version of MERGEFIELD software «software», it is forbidden to:• Install the trial version on a production server.• Distribute or sell an application with the trial version.• Delete the additional trial text that is added to the created documents. Duration of agreementThis agreement is valid for an indefinite period of time. The Licensee's rights as a user automatically expire if the conditions of this agreement are in any way violated. In this event all data storage material and all copies of MERGEFIELD software «software» are to be destroyed.
