12. Brainstorm Operational Pain Points - With Your Team!
● Talk to your team about where your production gets backlogged
○ Are we not getting the info. that we need from our clients?
○ Is the attorney to busy with other things to review completed documents?
● Document what your client & team complain about
○ Start with a 2 week period
○ Are there common themes?
● Review your teamʼs time tracked
○ Start with the last 2 months
○ What did they spend the most time on?
○ Are there any red flags?
13. Example Evaluation Blueprint
Current State: Whatʼs your process? Which tools are you using to assist
with this process? Is there firm-wide compliance with this process?
Ideas for Improvement: How does this process impact your firm? Are
there inefficiencies or bottlenecks? Is there room for automation?
Sustainability Analysis: What happens to this process if the
unexpected strikes? What if someone leaves or you terminate a service
provider contract?
14. Example: Billing & Collections
Current State: Using cloud based practice management tools, and
running payments through stripe. Doing trust accounting in QBO.
Collections are hovering around 65%.
Ideas for Improvement: Start using integrated payment processing,
and set up payment plans for delinquent accounts. Use integrations to
avoid double entry.
Sustainability Analysis: Have a backup payment method available if
the first fails. Make sure all staff (or a backup staff member) is trained on
billing and collections procedures.

associated with relevant technology, engage in
continuing study and education and comply with all
continuing legal education requirements to which
the lawyer is subject
23. In the New for Literally all of the Wrong Reasons
24. Rule: 1.6 Confidentiality
ABA Model Rule 1.6
(a) A lawyer shall not reveal information relating to the representation of a
client unless the client gives informed consent, the disclosure is impliedly
authorized in order to carry out the representation…
(c) A lawyer shall make reasonable efforts to prevent the inadvertent or
unauthorized disclosure of, or unauthorized access to, information relating to the
representation of a client.
[Comment 18] …inadvertent or unauthorized disclosure of information relating
to the representation of a client does not constitute a violation if the lawyer has
made reasonable efforts to prevent the access or disclosure.
25. Rule 1.4(a): Communication
ABA Model Rule 1.4 (a) A lawyer shall:

28. Make a tech adoption plan
● What will the transition/migration period look like?
● Have you shown firm staff the value of the software?
● Have you communicated who will be responsible for what?
29. Example template for implementing tech
● Process to refine/move online: Which process will you tackle?
● Problem: Why is this a pain point for your firm?
● Solution: What will a new process/technology to do help? Identify the product
or process here.
● Automation: What will this process/product allow you to automate or refine?
● Budget: How many hours and dollars will you designate for this project?
● Sustainability Plan: How will you get the firm to adopt this change and keep
iterating on this?
30. Ex. How to Move your Billing and Collection Process
Online
● Process to refine/move online: Billing workflow
● Problem: Billing and payment cycles take more than a month, logging payments in
ledgers requires multiple entries
● Solution: Use cloud-based case management to consolidate steps and make payments
easier for clients
● Automation: Log time entries as they happen, generate bills in bulk, send secure
payment link with bill, integrate with accounting software
● Budget: 2 hours of training, communication with all clients on workflow, one billing cycle
to work out kinks.
● Sustainability Plan: Set a billing cut-off date, regularly share collections rate, AAR
32. Supercharge your firmʼs
productivity by creating
workflows for the
substantive legal work,
not just the administrative
work.
Not everyone wants to
come back to the office,
even when they can. As a
result, tech tools will
continue to play an
important role in helping
dispersed teams provide
legal services.
