The material is made available open online which creates an excellent starting point for big scale reuse.

Juridische, auteursrechtelijke beoordeling van de open online beschikbaarstelling van deze films: Allereerst hebben we bepaald of de films in het publieke domein zijn. Dat betekent dat een werk, zoals een film, vrij is van auteursrechten. Daarbij hebben we het volgende overwogen: Films uit 1940-1944; Op de films staat de filmdienst der NSB als maker vermeld (geen individuele personen als maker); Filmdienst der NSB was een onderafdeling van de afdeling propaganda van de NSB en was daarmee een onderdeel van de NSB. De NSB was een stichting; De NSB wordt daardoor als maker van de films beschouwd en was auteursrechthebbende van de films; Dit was de NSB tot september 1944, toen werd de NSB ontbonden, waarbij de auteursrechten aan de staat vervielen (BOLO); Los van de overgang van het auteursrecht van de NSB naar de staat, vervalt het auteursrecht op een werk (in dit geval een film), waarvan de maker een organisatie is (in dit geval een stichting) 70 jaar na 1e openbaarmaking; Omdat de maker van de films een organisatie was en er 70 jaar is verstreken na 1e publicatie van de films, zijn de auteursrechten vervallen en de films in het publieke domein. Als films in het publieke domein zijn, zet BenG ze niet meteen online. Eerst doen we nog een: B. Ethische check (portretrecht, ethische bezwaren & privacy) Bij deze films hebben we de volgende beoordeling gedaan: Er is sprake van mensen die herkenbaar in beeld zijn. Deze mensen en hun nabestaanden hebben portretrecht en kunnen zich eventueel verzetten tegen openbaarmaking van het portret o.g.v. hun recht op privacy. Dit portretrecht weegt BenG af tegen het recht op vrijheid van meningsuiting (informatievrijheid) van BenG zelf; Een vergelijkbare toets is gedaan o.g.v. de AVG,. de Algemene Verordening Gegevensbescherming die gaat over privacy; Beeld en Geluid en NOB hebben gezamenlijk overwogen dat het vrijgeven van deze beelden een algemeen belang dient en onderzoekers ondersteunt, waardoor dit belang voorgaat en tot open online publicatie is besloten.

Op last van de bezetter mogen beide firma’s niet meer de eigen journaals vervaardigen en moeten zij samenwerken met het Duitse filmverhuurkantoor Tobis. Vanaf 1941 verzorgen Polygoon en Profilti het Tobis Nieuws wekelijks om de beurt.
