THE ROLE OFETHICS CODES AS A CATALYST FOR IMPROVING PRACTICE
SOME STEPS IN MAKING ETHICAL DECISIONS1. Identify the problem or dilemma.2. Identify the potential issues.3. Look at the relevant ethics codes for general guidance on the matter.4. Consider the applicable laws and regulations.5. Seek consultation from more than one source.6. Brainstorm various possible courses of action.7. Enumerate the consequences of various decisions.8. Decide on what appears to be the best possible course of action.
INFORMED CONSENT Involves the right of the clients to beinformed about their therapy and to make autonomous decisions pertaining to it.
CONFIDENTIALITYIs an ethical concept, and in most states it is the legal duty of therapists not to disclose information about a client.
PRIVILEGED COMMUNICATION Is a legal concept that generally bars thedisclosure of confidential communications in a legal proceeding.
SOME OTHER CIRCUMSTANCES IN WHICH INFORMATION MUST LEGALLY BE REPORTED BY COUNSELORS:• When the therapist believes a client under the age of 16 is the victim of incest, rape, child abuse, or some other crime.• When the therapist determines that the client needs hospitalization.• When information is made an issue in a court action• When clients request that their records be released to them or to a third party.
DUAL OR MULTIPLE RELATIONSHIPS Either sexual or nonsexual, occur when counselors assume two (or more) rolessimultaneously or sequentially with a client.

COUNSELORS SHALL ESTABLISH AND MAINTAIN GOOD RELATIONS WITH THEIR COUNSELEES, AND ACCORDINGLY, SHALL:2.6 Give information about the Counselee only to persons who can beof help to the Counselee and is done only with the approval of theCounselee and/or his parents or guardian. When revelations may resultin possible harm to the Counselee or to someone else, or may endangerthe community or the country, he must report the facts to appropriateauthorities and take emergency measures to prevent any untowardevent or harm to Counselee.2.7 Recommend a referral when it is indicated that the Counselee doesnot benefit from the guidance relationship, but assume responsibilityfor the welfare of the Counselee until the guidance responsibility isassumed by the person to whom the Counselee has been referred.

GUIDANCE COUNSELORS SHALL ESTABLISH AND MAINTAIN GOOD RELATIONS WITH THEIR COMMUNITY, AND ACCORDINGLY, SHALL:3.1 Establish a relationship between the community and the guidanceprogram in a manner that is beneficial to both.3.2 Show sensible regard for and ethical recognition of the social codeand moral expectations of the community in which he works andstrives to elevate the understanding of its social and culturaltraditions.3.3 Attend to the needs, problems, aspirations, and human resourcesof the community in order to enable him to give relevant serviceresponses, and to develop a wholesome community spirit.
ARTICL E IV Relationship with Colleagues in the Profession Section 4. GuidanceCounselors’ Relationship
GUIDANCE COUNSELORS SHALL ESTABLISH WITH THEIR COLLEAGUES, AND ACCORDINGLY, SHALL:4.1 Initiate peer relations and maintain high standards ofprofessional competence in the guidance and counselingdiscipline.4.2 Keep relationships on a professional level by refrainingfrom petty personal actions.4.3 Consult colleagues as a matter of professionalcourtesy, when planning to initiate a professional activity likelyto encroach upon his colleagues’ recognized academicdisciplines or researches.
GUIDANCE COUNSELORS SHALL ESTABLISH WITH THEIR COLLEAGUES, AND ACCORDINGLY, SHALL:4.4 Give accurate information and avoid anymisinterpretations or unclear explanations.4.5 Hold responsible for proper permission from andadequate recognition of authors and publishers ofcounseling and testing instruments which he uses andsees to it that psychological tests are administered onlyby professionally-trained and competent guidancepersonnel under his direct supervision.
ARTICL EV Research and Publications Section 5. GuidanceCounselors Attitude on
GUIDANCE COUNSELORS SHALL UNDERGO RESEARCH AND PUBLICATION AND, ACCORDINGLY, SHALL5.1 Undertake research to contribute to the advancement of theGuidance and Counseling profession.5.2 In conducting research, adhere to the highest standards of researchMethodology.5.3 In reporting results of researches, reveal the identity of the subjectsof research only with the permission of the subjects concerned and onlyfor professional purposes.5.4 Acknowledge the source of his ideas and material in his research aswell as in his publications, and recognize divergent opinions fromresponsible persons.
ARTICL E VI Miscellaneous ProvisionsSection 6. Administrative Penalties
Sec. 6. Administrative Penalties – Any registered andlicensed Guidance Counselor who violates any provision ofthis Code shall be administratively liable under Sec. 24, Art.III of R.A. No. 9258 and Sec. 24, Rule III of BoardResolution No. 02 Series of 2007, the “RR of R.A. No.9258”.Sec. 7. Separability Clause – If any part of this Code isdeclared unconstitutional or invalid, the remainingprovision/s or part/s thereof not affected thereby, ifseparable, shall continue to be valid, enforceable, andoperational.
