Construction Law in the
Virtual World
MSc/LLM Construction Law &
Practice
Today
• I will explain:
– Who studies on the course
– What we study
– How we study
First… please note:
• Detailed information about the course is available
from:
http://www.salfordconstructionlaw.com
• Next intake is September 2013, but the course is
very popular (so if you are interested apply now to
avoid disappointment)
Who?
• The course is intended to help construction
professionals who need to understand construction
contracts and legal processes in detail.
– Current students are all employed in construction
somehow. Some are lawyers, many are project
managers, QS, engineers, architects. Most are a
good few years into their careers, some are early
career. About 50% are based outside the UK
Who?
• Standard Entry requirements:
– 2:2 Hons degree in law, or a construction related
discipline
– Full professional membership of RICS or CIOB
• Non standard:
– Considered on a case by case basis. Applicants
will have to complete a portfolio which will be
assessed for entry.
Who?
• MSc or LLM?
– This does not matter. The only distinction in
study occurs in Year 2. Students who complete
Year 1 satisfactorily are permitted to transfer
between programmes.
• Non Native English speaker?
– If according to the University rules you need an
IELTS certificate, then you will have to get one.
What?
Assessment?
• No exams
• All coursework
• For the taught modules, this is generally, essay or
legal problem solving work
• Generally 1 piece of coursework for each of the 4
taught 30 credit modules – 6,000 words each.
• Research phase – between 15,000 – 20,000 words in
all.
What not?
• Not arbitration
• Yes, we do statutory construction adjudication,
but only mention arbitration very briefly.
• Not law other than English and Welsh
• N.B. the approach to legal reasoning is identical
in all common law jurisdictions, and has great
similarities in civil law jurisdictions. Hence there
is benefit to be derived even if you are not
practising in England & Wales, however, you
must accept that we only look specifically at that
law.
How?
• No books
• No physical resources at all
• No face to face contact …
• How will this work?
No Books - Virtual Solution
• Superlative e-resource access
– Westlaw
– Lawtel
– Lexis
– i-law [Building Law Reports, etc]
• Investment into e-books and e-journals
• Provision of e-learning packages which guide you to
resources.
No Face to Face Contact – Virtual
Solution
• Regular live internet conferencing, UK mid week
evenings
• 2013 Intake –Wednesday evenings (UK time)
• All sessions are archived for later viewing or
revision
• Peer to peer interaction encouraged which leads to
development of unified cohort of students, despite
physical separateness.
• Also email and phone contact and meetings with
tutors.
Tutors
• Salford based lecturers:
– Me, lawyer with construction environmental
interests
– Brodie McAdam, formerly construction litigation
solicitor with national law firm
– Paul Tracey, experienced QS, with law degree
– Paul Crowe, QS/PM with contract administration
expertise
Tutors
• External Lecturers:
– Paul Crowe, QS who heads up a construction
consultancy
– Katherine Ibbotson, solicitor who advises the UK
Government on Health procurement issues
– Sarah Fox, formerly solicitor with national law
firm
Tutors
• Also, guest lecturers, e.g. Julian Bailey, Cameron
McKenna. Rosie Oliver, UK Environmental Law
Association (former DEFRA lawyer)
• External supervisors, e.g. Julian Bailey, Cameron
McKenna, Emmet Moore, Devonshires, Daniel
Brawn, Ronan Champion
Accreditation
• Accredited by RICS
• Completion of the course will be accepted by RICS
as completion of academic elements of APC
• The course is NOT accredited by CIArb – because
we don’t do arbitration.
