2. What do you mean by legislation?
Legislation (or "statutory law") is law which has been promulgated (or
"enacted") by a legislature or other governing body or the process of
making it.
What do you mean by delegation?
Delegation is the assignment of any responsibility or authority to
another person (normally from a manager to a subordinate) to carry
out specific activities.
Delegated legislation is law made by individuals and institutions
acting under a grant of legislative authority from Parliament.
3. ●Delegated powers are usually granted in an
enabling Act
●This Act will establish a framework of general
principles and grant powers to fill in the details
•Administrative agencies are frequently delegated law
making powers by parliaments and as a consequence
may formulate subordinate laws in the form of
regulations, rules, ordinances, orders or by laws.
•These instruments become law once signed by the
delegated law maker.
•The Parliament and court control the making of
delegated legislation to ensure it is intra vires of the
power.
5. By laws are made by local councils and other public
bodies.
For example: a local council might wish to ban drinking in
its town center. Another example would be the fines
incurred by the people who let their dogs foul in public
parks.
Public corporations, such as the bus and train services,
are able to impose fines for non-payment of fares.
6. Statutory instruments are regulations made by
government departments to implement the
provisions made in acts of parliament.
For example, the department of constitutional
affairs can make changes to the provisions of
legal aid under the legal aid act 1998.
7. Orders in council are laws passed by the privy
council,
Which is a group of senior politicians who are
allowed to make law without the need for the
whole of parliament to be sitting.
Issued by the privy council, generally only used
in case of emergency.
8. Delegated legislation
Reasons for/Advantages
• to save parliamentary time
• to deal with complex and technical issues (e.g. health
and safety regulations)
• quicker and easier to amend and update than primary
legislation
• able to respond quickly to emergencies
• allows for local variation to meet local need
