he Law is reason free from passion” — Aristotle
TLaw is a system of rules and regulations developed by a country or a
government to maintain order in the society, to properly conduct and
conserve business agreements and social relationships, and to deal with
crime and other anti-social activities. It represents the will of the people
and displays the social and political needs of a nation. Hence, for any
government, the study of law is very essential. For every country, it is
essential that they have good lawyers and judges who interpret the law and
provide the appropriate legal assistance to the citizens in need.
Legal education in India originated during the ancient period with
teachings of Dharma and Nyaya. It evolved during the Mughal period,
when the concept of legal representatives or Vakils came into existence. It
further evolved during the Colonial period; however, the legal structure
has been changed since 1987.
Law degrees are granted in India based on the Advocates Act, 1961.
Traditionally, LLB (Bachelor of Laws) or BL (Bachelor of Law) degree
was conferred to the eligible candidates. A candidate needed to have a
bachelor degree of their choice in order to be eligible for a law degree.
However, to establish law as a specialized course, National Law
Universities were established. These universities aimed to offer multi-
disciplinary and integrated approaches to legal education. Hence, for the
first time, a law degree other than an LLB or BL was offered. Many
colleges and universities started introducing integrated degrees like BA
LLB (Honors), and B. Sc. LLB (Honors).
In 2008, the Common Law Admission Test (CLAT) was introduced in
India to unify the system of law entrance examination. With the passing of
time, the country has witnessed revolutionary changes in legal education.
There has been increased investment, better infrastructure, and more
private sector involvement in the field of legal education. Leading private
colleges and universities are offering law degrees. These institutions are
promoting and practicing moot courts, debate sessions, internships, and
other training activities to make the students well aware of the practical
nuances of law. Modern technology is used in educational institutions to
provide an in-depth and lasting educational experience to the students.
The scenario of legal education is becoming more and more specialized
with each passing day. Government bodies are providing full support and
assistance to take legal education to the next level. The new era of legal
education has opened up new avenues for law students and professionals
and has refurbished the structure and image of legal profession in the
country.

he legal education sector is one of the fastest growing educational sectors in India. Students are
Tshowing more interest in pursuing law as a career. In fact, the number of applicants for the Common
Law Admission Test (CLAT), 2016 was the highest ever. This impressive upswing in the interest of
selecting law as a profession is because the legal profession nowadays offers a wide variety of employment
opportunities in addition to litigation oriented practice.
st

Presidency University School of Law
(SOL) is a close-knit community of
faculty, students, staff and alumni
dedicated to providing an excellent
legal education. Their faculty
members, all from premier legal
institutions, have accomplished much
in their respective fields. The students
are active and supportive of one
another, whether one-on-one in
studying for class, or taking on
leadership roles in the many dynamic
student organizations. Their
professional staff is committed to
helping the students excel during their
tenure at the Law School.
The Moot Court Association (MCA):
This is an important student initiative
which organizes many inter-
school/inter collegiate Moot Courts
and holds Moot Sessions, Novice Moot
Competitions, Trial Advocacy Practice
and Research Tests for the students on
a regular basis. SOL also offers one of
the largest competitive National Moot
Competitions where students
participate from all over the country.
Moot Court is a core credited-
component of the curriculum, which is
an integral part of internal assessment
of all Law Program.
Faculty-guided Student Initiatives:
The SOL has many other student
initiatives. The Debating Society called
“DebSoc” is an active and vibrant
Student Club which conducts various
formats of debates on current issues.
Client Counseling, Trial Advocacy,
Group Discussions, Legal Awareness
Programs are few other activities
where student-faculty collaborate in
legal education.

Located in Bengaluru Rural Urban, the Presidency
University Campus has been ranked the most beautiful
campus with unmatched infrastructure by a National
Survey.
The SOL is located on the picturesque 66 acre Presidency
University Campus which is a vast expanse of green
architectural piece of work. Central to the university is its
Library which is a 7,500 square-foot structure, as well as a
state-of-art Moot Court Hall, Conference Rooms,
Classrooms, a Dining Hall, ample technology services, and
a large Auditorium which is the largest indoor facility on
allows students to develop necessary skills and values that
form the basis of Pro Bono Service and the sound practice
of law. Pro Bono Program lets students work with others to
make a meaningful contribution for people seeking access
to justice, the rule of law, and solutions to critical
community concerns. Students also can learn more about
the practice areas and techniques that appeal to them. The
First and Second Year Law Students are strongly
encouraged to give four [4] weeks of service in NGOs
which take the form of credited internships.
The legal profession is expected to play a dynamic role in
the administration of justice. With the Bar Council of India
(BCI) in 1997 making Legal Aid a compulsory practical
paper to be taught in the Law Colleges across India, Legal
Aid to the poor got a new lease of life. In this back drop,
SOL not only has a dedicated faculty designated to take
care of Legal Aid Initiatives but also ensure that students
receive academic credit for this workload. Trained
practicing lawyers from the Legal Services Board help the
SOL in its Legal Aid Program.
The Presidency Law Review Journal: The goal of the
Journal Editorial Team is to provide students with
opportunities to be involved in editing innovative legal
scholarship, participate in invaluable critical thinking and

The students are not just encouraged, but, SOL has factored
in the course component clinical legal activities like moot
courts, debates, client counseling, seminars, article
publications, participation in conferences where student
engagement is mandatory, evaluated and credited.
They collaborate with premiere law schools like NLSIU,
professional bodies like Confederation of Indian Industries,
the Judicial Academy etc. to provide the students with
cutting edge professional training and advantage.
At the SOL, building a professional network that includes
law firms, judges, corporate offices, government agencies
and public-interest organizations is embedded in the very
curriculum. Their legal aid, clinic and pro bono programs
ensure that students will apply the understanding of the law
that they gain in the classroom to professional practice,
working with some of the very same advocates and judges
who are in a position to hire or recommend them for a job.
As every student plans his/her career, there is complete
support from the teaching faculty members who not only
have deep connections to the legal community but as well
to a team of experienced Advocates in the Career Strategies
Office who are with the students.

egal Process Outsourcing has emerged as a trending
Ltopic in the legal sector. It is a concept not much
popular among the non-legal community. When
someone hears about LPO, they compare it with the well-
known concept of BPO. They immediately think about call
centers where youngsters interact on the phone with their
existing or prospective customers. Conceptually, LPO and
BPO are quite similar, but in terms of execution and
qualification, they are entirely different.
Legal services in UK, USA, Singapore, Dubai, and so on,
are quite expensive as a lot of money is charged on an
hourly basis. LPO service providers are also established in
countries like Canada, Philippines, and Israel. In India,
these services are provided in a comparatively cheaper rate.
As result, many corporates send their legal work to India in
order to get them done in a fraction of the cost. In the past
few years, the LPO industry has grown to around 60%
annually. India is currently the largest LPO hub in the
world. Many Indian companies accept work from foreign
clients and allot it to law graduates employed by them.
They complete the allotted work and send the finished file
to the clients abroad. LPOs conduct all the work and
exchange of information online. They are eventually paid
by their clients once the job is accomplished.
Required Qualifications and Skills for LPO
A person is eligible for LPOs if they are law graduates with
a certain skill set. They should possess a law degree from a
recognized university. They should have excellent
communication skills, and should pay attention to detail.
LPO firms do not work on Indian laws or Indian clients.
They work for foreign countries and on matters relating to
foreign law. The lawyers of such firms perform various
responsibilities like drafting certain documents on the basis
of templates, reviewing documents, researching on
companies, legal research, data entry, litigation support,
compliance to various laws, proofreading documents, and
so on. They perform these activities online with the help of
specific soft wares. Patent search, trademark and copyright
registration, and analysis of intelligence services are some
of the other services provided by the LPOs which require
high skills.
Advantages of Working for an LPO
There are many advantages that an LPO firm offers to its
employees. They follow a certain corporate format which
maintains uniformity in the work space. LPOs provide all
the facilities including promotions, increments, hierarchy,
proper office spaces, safe work environment for women and

many other benefits. They also provide comfortable work
timing which generally range from 8–10 hours.
LPOs also provide a comfortable salary to the employees.
The salary levels vary from company to company. Lawyers
working for big LPOs earn around Rs 30,000–45,000,
whereas, smaller LPOs provide a salary ranging from Rs
20,000–25,000. Some companies also provide performance
bonus and similar incentives. Moreover, salaries are also
revised annually depending on the employees’
performance.
Lawyers get the exposure and learning opportunities in
LPOs. Many LPOs work for some of the top-notch law
firms of the UK and US. As a result, they hire foreign
instructors to train the employees. This provides the
employees the exposure to the work culture of foreign
countries and also provides access to the best of soft wares
available for the industry. There are many LPOs which also
offer flexible facilities like work from home if the need
arises.
Limitations of Working for an LPO
In spite of its many advantages, there are certain issues
weakening the LPO industry in India. The work in LPO
firms is tedious at times. Lawyers don’t have the option of
working on Indian laws. They sometimes lose touch of
Indian laws because of constantly working on foreign laws.
Moreover, foreign clients are sometimes skeptic about
sharing confidential information and documents with India-
based LPOs. Such important information may be misused
sometimes.
LPO: Steadily Progressing in India
Legal Process Outsourcing has been steadily growing in
India. The recent global recession has accelerated the
evolution of LPO in India. Many overseas legal firms are
choosing Indian legal firms as outsourcing service providers
to reduce the costs. This has transformed India into a
favorable refuge of legal works. It has also provided freshly
qualified law graduates to prove their worth and also earn
well. The Indian LPO sector expects growth in services like
document review, eDiscovery, legal publishing, and so on
along with intellectual property and contract services.

Technology Changing
The Legal
Discoursee should remember that the jurisdictional issues
Wexisted when it was only paper. The cloud
merely makes them bigger.”
― James Francis
Today, law is considered to be the most sought-after
professions in the world. Law, legal education and
development have become inter-related concepts in modern
developing societies. In the present era, technology
encroaching each and every field, learning and developing
law with technology gives an edge to legal professionals
over other disciplines. Law being an interdisciplinary
profession, in the present e-age, connectivity with other
disciplines like medical, engineering, commerce, finance,
and humanities has given a wider spread to legal sector. In
the present age of technology and science, one should
expect to give a warm welcome, perhaps a permanent
home, to science in our courtroom procedures. The legal
disputes before us increasingly involve the principles and
tools of science and the proper resolution of these disputes
is essential not just for the litigants, but also to the general
public who live in our technologically complex society and
indeed want justice to be served.
The increasing reliance on technology whether it be through
forensic science in a criminal case, food testing in an
adulteration case or data protection in cases of privacy, has
led to the need of imbibing the technical know-how into
one’s legal knowledge, skills and profession. Whether it is
biotechnology, pharmacy and intellectual property rights or
digital privacy, health care, energy and environment policy,
many legal specializations emerge from and rest on
scientific foundations. Although a combination of law and
technology is referred to as an oxymoron, but it is actually a
bitter sweet experience with enhanced results. Studying law
after science improves and nourishes your analytical ability,
planned execution, application of mind and various other
skills that help in laying the foundation in legal profession.
Implanting Technology in Legal Education:
What was available in library in the past is available at the
touch of a screen today. The accessibility to knowledge
resources has increased tremendously leading to the
enhanced exposure and skill-building of the law students.
Knowledge is no more confined to the class-rooms but
gained through actual implementation of the propositions
posed. Right from teaching pedagogy, sailing through the
turmoil of practicality, dynamism in the growth of
professional education has taken a widespread course with
the aid of technology. As is rightly said, “Technique is what
you fall back on when you run out of inspiration….”, the

concept of flipped classrooms has generated an interest and
confidence amongst the students leading to the development
of emotional intelligence. Now-a-days, besides knowledge,
other skills such as client care, leadership, ability to work as
a team, project management, impressive presentations,
marketing self and above all attitude to showcase are much
focussed upon which constantly develops through exposure
on e-space, interactions with professional leaders and
building industry relationships. Platforms like linkedin,
lawctopus, latestlaws, etc. have created a niche space for
the budding lawyers to showcase their skills, hunt for good
opportunities and create a market of their own. India being
a developing nation is far behind the other developed
nations where enrolment, impartation as well as evaluation
happens online. Technology is also used as medium of
communication and one-to-one interaction through video
conferencing and thus, reduces the geographical gaps
between the tutor and the tutee. Apart from regular
degree courses, online certificate courses serve as good
resource for specialized knowledge gain. The generation
is finally moving from knowledge acquisition index to
technical proficiency index irrespective of the area of
study.
Reaping Technology in Legal Profession:
From automation to outsourcing, from associates to
law firms, from chambers to web pages, law has
become a tool in the hands of the people through the
use of technology. Different avenues available to the
legal professionals is gifted to them by
advancements in and adaptation to technology. The
procedures have changed from court rooms to
outside the court through alternate methods of
dispute resolution. The lawyers, paralegals, project
managers, co-operatives, entrepreneurs,
researchers, policy makers, social workers, all are
driven by their ability interface with their clients
and vendors. Pointing towards technology,
Chrissie Lightfoot, author of The Tomorrow’s
Naked Lawyer, listed the year 2018 as the year
when technology can do 80% of the work the
lawyers do. The legal profession is changing its
shape from the pyramid to the rocket shaped
structure where majority of the lawyers will
enjoy equal positions rather then being termed
as juniors. With standardization and
systematization of traditional legal services
with the technical innovations, the legal
discourse has become readily available with
the clients with more competition in the
market in terms of facilitation and clarity of
the expertise involved in the matter. The
abolition of the boundaries has given rise to
globalisation of legal services and creation
of a third jurisdiction like the CLOUD.

echnological advancements have transformed the
Tway we perform our day-to-day activities. These
advancements help us in doing things better and
faster, while spending less money. They have revolutionized
the way we work and are bringing in even more changes
each passing day. Modern computer technologies have
made things easier for us. We have witnessed how
technologies like automation and AI have impacted various
businesses.
The legal sector has been highly affected by the advent of
smartphones, tablets, Wi-Fi and cloud computing. When we
look back a few years, we can realize that there has been a
considerable change in legal practices and the approaches
of the legal sector. Recent research states that technology
has refurbished the management of law firms and corporate
legal departments, relationships with clients, and practice of
law.
The Ground breaking Impact of Social Media
Professionals in the legal sector are exploring high-tech
tools and innovative procedures to enhance their
performance and properly manage their careers. There are
many lawyers and attorneys who are skeptic about
embracing social media because of concerns related to
privacy of client information. But still, there are many
attorneys and paralegals who are increasingly using social
media to expand their networks, develop new business
opportunities, and interact with clients.
st
Legal Professionals of the 21 Century
Legal professionals of this modern era are surrounded by
smartphones, tablets, computers, and cloud-based tools.
They carry all the necessary information/data like files,
documents, scanned images, and legal dictionaries, in their
electronic devices and data drives. This portability helps
lawyers to access data anywhere and anytime. They can
work from remote places and also interact with their clients
from home, while travelling, or from other public places.
Modern technology has also enhanced communication of
lawyers with their clients. Communication and response
times have been shortened with tools like e-mail, texting,
and videoconferencing. With the advent of these modern
tools, many clients also expect immediate responses to their
messages. With the cutting-edge technology in their reach,
the lawyers of this modern era can use them strategically
and judiciously to provide the best-possible client service.
Law firms are nowadays implementing various technologies
to enhance their operations and activities, reduce expenses,
and improve customer service. Many legal firms are
providing services online. They are also incorporating
technologies like cloud computing for knowledge
management, storing documents, powerful searches,
budgeting, planning, time management, docket
management, and invoicing. E-billing is also becoming
popular among clients; they are now demanding for e-bills
from the lawyers/firms. Moreover, e-discovery has also
emerged as an opportunity and a challenge for firms and
legal departments, as there is a drastic increase in the

volume of electronic data that is needed to be managed and
stored.
Towards the Future
Modern innovations in technology are emerging every year,
and firms are implementing them to their advantage. Clients
also demand quality service from their lawyers and expect
them to use technology efficiently. They want value, speed,
and innovation from the lawyers. In the days to come,
future automation will be used to perform tasks that are
time consuming, expensive, and currently performed by
humans. Moreover, further automation will help law firms
to be more innovative in providing service to their clients.
Lawyers will be able to concentrate on providing their
expert legal advice and services to their clients, instead of
being involved in time consuming administrative activities.
The advancements and technological developments have
reshaped the criteria law firms use to hire legal
professionals. Some of the most techno-savvy candidates,
particularly in the field of litigation and e-discovery have a
competitive edge in the job market these days. Lawyers and
other legal professionals should have the proper knowledge
of the latest soft wares, tools and systems to perform their
tasks, interact with the clients, and deal with the cases.
Legal professionals will have to be well acquainted with the
latest developments and constantly evaluate how to
properly utilize the latest devices to perform the work more
efficiently and deliver quality service to the clients. They
will also have to gain experience and be prepared for
working in high-demand areas like litigation and
e-discovery. Professionals will have to learn, explore, and
experiment with technology in order to contend and excel in
this age of cut-throat competition.
Technological competence has now become a matter of
utmost importance. It should now be at the forefront of the
professionals’ minds. Lawyers have to be tech-savvy as it is
becoming increasingly difficult to practice law without
proper knowledge and understanding of technology.
Lawyers have to be innovative and should accept and adopt
the latest developments in this fast changing legal sector.
They should always be alert and aware of the opportunities
that technology may bring with it for the present and the
future. T R

Challenges and Opportunities
Modern technologies are increasingly making
their way in almost every industry and the legal
sector is also not untouched with the magic of
their benefits. Even law firms and lawyers of this modern
era are also interested in incorporating these technological
advancements in legal activities and procedures. In spite of
that, there are many lawyers and law firms who are skeptic
about adopting modern technology in their day-to-day
activities. Cloud computing is constantly evolving and is
widely being used in many businesses. Law firms can take
the next step towards technological advancement and can
adopt cloud computing in their operations. But before doing
so, they should clearly understand the concept, applications,
advantages, and disadvantages of cloud computing to
ensure its successful utilization.
When we use cloud computing, we are running programs
and storing data on the internet, rather than using the
computer’s hard drive. In cloud computing, the computer is
merely used as a gateway to the application, and the
software and files are stored online. A large number of
cloud-based technologies are used in businesses these days
including Google Docs, Dropbox, and Carbonite to
maintain a backup of data.
Cloud computing technologies have been in use since the
1950s, but the important question is can it be properly used
in law offices, for example, cloud-based legal billing and
trust accounting soft wares. To answer that, the benefits and
challenges of cloud computing should be considered.

FOR THE LEGAL PROFESSION:

Benefits of Cloud Computing
From the perspective of the legal profession, there are many
benefits that cloud computing can offer to law firms. Cloud
software can play many important roles as a virtual
attorney. These benefits have been highlighted below.
Mobility
Legal firms nowadays are connected to various computer
systems at the same time. One can access information
anywhere and anytime from any corner of the world with
the help of internet connection. It provides a tremendous
advantage in courts or mediation sessions when the lawyers
have access to all their files and documents while their
opposing attorneys don’t.
Independence
Cloud soft wares provide the advantage of operating system
independence. Users can utilize Mac or Windows OS as per
their convenience. Many applications can also be accessed
from remote locations with the use of laptops, tablets, or
smartphones.
Cost Friendly
Cloud soft wares cost less money for installation and almost
zero or negligible maintenance costs. They require a very
small monthly fee rather than a huge purchase cost.
Moreover, there is no need of hiring dedicated IT staff or
outside consultants to set up the software.
Recovery from Disasters
Major and minor accidents and disasters in the office can
destroy client files, even if they are on the hard drive of the
computers. Maintaining offsite backups are also slow and
costly, and still may not protect against large-scale
disasters. Maintaining backup files in cloud storages
provide protection against disasters and even major
catastrophes.
Challenges of Cloud Computing
Although cloud computing provides numerous benefits,
there are also many potential drawbacks of moving to the
cloud. Firms should properly asses the liabilities and
compare them with the advantages to make sure whether
the cloud is the right step for them. The challenges in using
cloud computing for the legal profession have been
described below.
Ethical Issues
Cloud computing may make things easier and time-saving,
but can also bring some ethical issues. Attorneys should
always be careful that technology doesn’t threaten their
ethical responsibilities. Many law firms have taken opinions
from their state bar associations before adopting new
technology. Till date, all state bar councils have supported
cloud computing usage as long as attorneys utilize it
ethically.
Lack of Control
Law firms should carefully and judiciously use cloud
computing technologies. Firms cannot control their cloud
service provider who may tamper with sensitive
information. These service providers may share sensitive
data with other parties or may make a duplicate copy of
their case notes. Law firms should always properly research
their cloud computing service provider. They should make
sure that the service provider that they are opting for has a
trustworthy professional record.
Breach of Data
Sometimes keeping crucial data on the internet proves
unsafe since chances of the data getting hacked or stolen
will always be there. Law firms should opt for cloud
services which employ strong protection and security
measures, which cannot be easily broken. Firms should
make a note of what protections are in place against a
breach, and what actions need to be taken when a breach
occurs and should take necessary steps accordingly.
Issues Related to Access
An important factor in cloud computing technology is
internet access and availability. If law firms are situated in
areas which don’t have internet access, then it is better for
them to perform activities manually without computer
applications. Moreover, a Denial of Service attack can
sometimes bring down the cloud provider’s servers. This
may leave the law firms with no access until they receive
back up.
Cloud computing is an advanced technology with its mixed
bag of advantages and disadvantages. Law firms should
judiciously use cloud computing technologies making
proper utilization of its various opportunities and
advantages, and overcoming and dealing with the related
challenges. If utilized thoughtfully, cloud computing can
work wonders for law firms and can contribute to their
growth and success. T R

  • 4. Editorial he Law is reason free from passion” — Aristotle TLaw is a system of rules and regulations developed by a country or a government to maintain order in the society, to properly conduct and conserve business agreements and social relationships, and to deal with crime and other anti-social activities. It represents the will of the people and displays the social and political needs of a nation. Hence, for any government, the study of law is very essential. For every country, it is essential that they have good lawyers and judges who interpret the law and provide the appropriate legal assistance to the citizens in need. Legal education in India originated during the ancient period with teachings of Dharma and Nyaya. It evolved during the Mughal period, when the concept of legal representatives or Vakils came into existence. It further evolved during the Colonial period; however, the legal structure has been changed since 1987. Law degrees are granted in India based on the Advocates Act, 1961. Traditionally, LLB (Bachelor of Laws) or BL (Bachelor of Law) degree was conferred to the eligible candidates. A candidate needed to have a bachelor degree of their choice in order to be eligible for a law degree. However, to establish law as a specialized course, National Law Universities were established. These universities aimed to offer multi- disciplinary and integrated approaches to legal education. Hence, for the first time, a law degree other than an LLB or BL was offered. Many colleges and universities started introducing integrated degrees like BA LLB (Honors), and B. Sc. LLB (Honors). In 2008, the Common Law Admission Test (CLAT) was introduced in India to unify the system of law entrance examination. With the passing of time, the country has witnessed revolutionary changes in legal education. There has been increased investment, better infrastructure, and more private sector involvement in the field of legal education. Leading private colleges and universities are offering law degrees. These institutions are promoting and practicing moot courts, debate sessions, internships, and other training activities to make the students well aware of the practical nuances of law. Modern technology is used in educational institutions to provide an in-depth and lasting educational experience to the students. The scenario of legal education is becoming more and more specialized with each passing day. Government bodies are providing full support and assistance to take legal education to the next level. The new era of legal education has opened up new avenues for law students and professionals and has refurbished the structure and image of legal profession in the country. ‘‘ T R Ushering in a New Era of Legal Education in India Ananda Kamal Das “

In fact, the number of applicants for the Common Law Admission Test (CLAT), 2016 was the highest ever. This impressive upswing in the interest of selecting law as a profession is because the legal profession nowadays offers a wide variety of employment opportunities in addition to litigation oriented practice. st The 21 century has witnessed great private and government participation in the growth and improvement of legal education. • 26. egal Process Outsourcing has emerged as a trending Ltopic in the legal sector. It is a concept not much popular among the non-legal community. When someone hears about LPO, they compare it with the well- known concept of BPO. They immediately think about call centers where youngsters interact on the phone with their existing or prospective customers. Conceptually, LPO and BPO are quite similar, but in terms of execution and qualification, they are entirely different. Legal services in UK, USA, Singapore, Dubai, and so on, are quite expensive as a lot of money is charged on an hourly basis. LPO service providers are also established in countries like Canada, Philippines, and Israel. In India, these services are provided in a comparatively cheaper rate. As result, many corporates send their legal work to India in order to get them done in a fraction of the cost. In the past few years, the LPO industry has grown to around 60% annually. India is currently the largest LPO hub in the world. Many Indian companies accept work from foreign clients and allot it to law graduates employed by them. They complete the allotted work and send the finished file to the clients abroad. LPOs conduct all the work and exchange of information online. They are eventually paid by their clients once the job is accomplished. Required Qualifications and Skills for LPO A person is eligible for LPOs if they are law graduates with a certain skill set. They should possess a law degree from a recognized university. They should have excellent communication skills, and should pay attention to detail. LPO firms do not work on Indian laws or Indian clients. They work for foreign countries and on matters relating to foreign law. The lawyers of such firms perform various responsibilities like drafting certain documents on the basis of templates, reviewing documents, researching on companies, legal research, data entry, litigation support, compliance to various laws, proofreading documents, and so on. They perform these activities online with the help of specific soft wares. Patent search, trademark and copyright registration, and analysis of intelligence services are some of the other services provided by the LPOs which require high skills. Advantages of Working for an LPO There are many advantages that an LPO firm offers to its employees. They follow a certain corporate format which maintains uniformity in the work space. LPOs provide all the facilities including promotions, increments, hierarchy, proper office spaces, safe work environment for women and SPOTLIGHT 24 Education. Innovation. • 27. Opportunities Legal Process Opportunities OFOF Legal Process many other benefits. They also provide comfortable work timing which generally range from 8–10 hours. LPOs also provide a comfortable salary to the employees. The salary levels vary from company to company. Lawyers working for big LPOs earn around Rs 30,000–45,000, whereas, smaller LPOs provide a salary ranging from Rs 20,000–25,000. Some companies also provide performance bonus and similar incentives. Moreover, salaries are also revised annually depending on the employees’ performance. Lawyers get the exposure and learning opportunities in LPOs. Many LPOs work for some of the top-notch law firms of the UK and US. As a result, they hire foreign instructors to train the employees. This provides the employees the exposure to the work culture of foreign countries and also provides access to the best of soft wares available for the industry. There are many LPOs which also offer flexible facilities like work from home if the need arises. Limitations of Working for an LPO In spite of its many advantages, there are certain issues weakening the LPO industry in India. The work in LPO firms is tedious at times. Lawyers don’t have the option of working on Indian laws. They sometimes lose touch of Indian laws because of constantly working on foreign laws. Moreover, foreign clients are sometimes skeptic about sharing confidential information and documents with India- based LPOs. Such important information may be misused sometimes. LPO: Steadily Progressing in India Legal Process Outsourcing has been steadily growing in India. The recent global recession has accelerated the evolution of LPO in India. Many overseas legal firms are choosing Indian legal firms as outsourcing service providers to reduce the costs. This has transformed India into a favorable refuge of legal works. It has also provided freshly qualified law graduates to prove their worth and also earn well. The Indian LPO sector expects growth in services like document review, eDiscovery, legal publishing, and so on along with intellectual property and contract services. • 32. Technology Changing The Legal Discoursee should remember that the jurisdictional issues Wexisted when it was only paper. The cloud merely makes them bigger.” ― James Francis Today, law is considered to be the most sought-after professions in the world. Law, legal education and development have become inter-related concepts in modern developing societies. In the present era, technology encroaching each and every field, learning and developing law with technology gives an edge to legal professionals over other disciplines. Law being an interdisciplinary profession, in the present e-age, connectivity with other disciplines like medical, engineering, commerce, finance, and humanities has given a wider spread to legal sector. In the present age of technology and science, one should expect to give a warm welcome, perhaps a permanent home, to science in our courtroom procedures. The legal disputes before us increasingly involve the principles and tools of science and the proper resolution of these disputes is essential not just for the litigants, but also to the general public who live in our technologically complex society and indeed want justice to be served. The increasing reliance on technology whether it be through forensic science in a criminal case, food testing in an adulteration case or data protection in cases of privacy, has led to the need of imbibing the technical know-how into one’s legal knowledge, skills and profession. Whether it is biotechnology, pharmacy and intellectual property rights or digital privacy, health care, energy and environment policy, many legal specializations emerge from and rest on scientific foundations. Although a combination of law and technology is referred to as an oxymoron, but it is actually a bitter sweet experience with enhanced results. Studying law after science improves and nourishes your analytical ability, planned execution, application of mind and various other skills that help in laying the foundation in legal profession. Implanting Technology in Legal Education: What was available in library in the past is available at the touch of a screen today. The accessibility to knowledge resources has increased tremendously leading to the enhanced exposure and skill-building of the law students. Knowledge is no more confined to the class-rooms but gained through actual implementation of the propositions posed. Right from teaching pedagogy, sailing through the turmoil of practicality, dynamism in the growth of professional education has taken a widespread course with the aid of technology. Now-a-days, besides knowledge, other skills such as client care, leadership, ability to work as a team, project management, impressive presentations, marketing self and above all attitude to showcase are much focussed upon which constantly develops through exposure on e-space, interactions with professional leaders and building industry relationships. Platforms like linkedin, lawctopus, latestlaws, etc. have created a niche space for the budding lawyers to showcase their skills, hunt for good opportunities and create a market of their own. India being a developing nation is far behind the other developed nations where enrolment, impartation as well as evaluation happens online. Technology is also used as medium of communication and one-to-one interaction through video conferencing and thus, reduces the geographical gaps between the tutor and the tutee. Apart from regular degree courses, online certificate courses serve as good resource for specialized knowledge gain. The generation is finally moving from knowledge acquisition index to technical proficiency index irrespective of the area of study. Reaping Technology in Legal Profession: From automation to outsourcing, from associates to law firms, from chambers to web pages, law has become a tool in the hands of the people through the use of technology. Different avenues available to the legal professionals is gifted to them by advancements in and adaptation to technology. The procedures have changed from court rooms to outside the court through alternate methods of dispute resolution. The lawyers, paralegals, project managers, co-operatives, entrepreneurs, researchers, policy makers, social workers, all are driven by their ability interface with their clients and vendors. Pointing towards technology, Chrissie Lightfoot, author of The Tomorrow’s Naked Lawyer, listed the year 2018 as the year when technology can do 80% of the work the lawyers do. The legal profession is changing its shape from the pyramid to the rocket shaped structure where majority of the lawyers will enjoy equal positions rather then being termed as juniors. With standardization and systematization of traditional legal services with the technical innovations, the legal discourse has become readily available with the clients with more competition in the market in terms of facilitation and clarity of the expertise involved in the matter. The abolition of the boundaries has given rise to globalisation of legal services and creation of a third jurisdiction like the CLOUD. • 44. Challenges and Opportunities Modern technologies are increasingly making their way in almost every industry and the legal sector is also not untouched with the magic of their benefits. Even law firms and lawyers of this modern era are also interested in incorporating these technological advancements in legal activities and procedures. In spite of that, there are many lawyers and law firms who are skeptic about adopting modern technology in their day-to-day activities. Cloud computing is constantly evolving and is widely being used in many businesses. Law firms can take the next step towards technological advancement and can adopt cloud computing in their operations. But before doing so, they should clearly understand the concept, applications, advantages, and disadvantages of cloud computing to ensure its successful utilization. When we use cloud computing, we are running programs and storing data on the internet, rather than using the computer’s hard drive. In cloud computing, the computer is merely used as a gateway to the application, and the software and files are stored online. A large number of cloud-based technologies are used in businesses these days including Google Docs, Dropbox, and Carbonite to maintain a backup of data. Cloud computing technologies have been in use since the 1950s, but the important question is can it be properly used in law offices, for example, cloud-based legal billing and trust accounting soft wares. To answer that, the benefits and challenges of cloud computing should be considered. CLOUD COMPUTING FOR THE LEGAL PROFESSION: 42 Education. Innovation. Success NOWLEDGEREVIEW T H E NOWLEDGEREVIEWApril | 2018
  • 45. Benefits of Cloud Computing From the perspective of the legal profession, there are many benefits that cloud computing can offer to law firms. Cloud software can play many important roles as a virtual attorney. These benefits have been highlighted below. Mobility Legal firms nowadays are connected to various computer systems at the same time. One can access information anywhere and anytime from any corner of the world with the help of internet connection. It provides a tremendous advantage in courts or mediation sessions when the lawyers have access to all their files and documents while their opposing attorneys don’t. Independence Cloud soft wares provide the advantage of operating system independence. Users can utilize Mac or Windows OS as per their convenience. Many applications can also be accessed from remote locations with the use of laptops, tablets, or smartphones. Cost Friendly Cloud soft wares cost less money for installation and almost zero or negligible maintenance costs. They require a very small monthly fee rather than a huge purchase cost. Moreover, there is no need of hiring dedicated IT staff or outside consultants to set up the software. Recovery from Disasters Major and minor accidents and disasters in the office can destroy client files, even if they are on the hard drive of the computers. Maintaining offsite backups are also slow and costly, and still may not protect against large-scale disasters. Maintaining backup files in cloud storages provide protection against disasters and even major catastrophes. Challenges of Cloud Computing Although cloud computing provides numerous benefits, there are also many potential drawbacks of moving to the cloud. Firms should properly asses the liabilities and compare them with the advantages to make sure whether the cloud is the right step for them. The challenges in using cloud computing for the legal profession have been described below. Ethical Issues Cloud computing may make things easier and time-saving, but can also bring some ethical issues. Attorneys should always be careful that technology doesn’t threaten their ethical responsibilities. Many law firms have taken opinions from their state bar associations before adopting new technology. Till date, all state bar councils have supported cloud computing usage as long as attorneys utilize it ethically. Lack of Control Law firms should carefully and judiciously use cloud computing technologies. Firms cannot control their cloud service provider who may tamper with sensitive information. These service providers may share sensitive data with other parties or may make a duplicate copy of their case notes. Law firms should always properly research their cloud computing service provider. They should make sure that the service provider that they are opting for has a trustworthy professional record. Breach of Data Sometimes keeping crucial data on the internet proves unsafe since chances of the data getting hacked or stolen will always be there. Law firms should opt for cloud services which employ strong protection and security measures, which cannot be easily broken. Firms should make a note of what protections are in place against a breach, and what actions need to be taken when a breach occurs and should take necessary steps accordingly. Issues Related to Access An important factor in cloud computing technology is internet access and availability. If law firms are situated in areas which don’t have internet access, then it is better for them to perform activities manually without computer applications. Moreover, a Denial of Service attack can sometimes bring down the cloud provider’s servers. This may leave the law firms with no access until they receive back up. Cloud computing is an advanced technology with its mixed bag of advantages and disadvantages. Law firms should judiciously use cloud computing technologies making proper utilization of its various opportunities and advantages, and overcoming and dealing with the related challenges. If utilized thoughtfully, cloud computing can work wonders for law firms and can contribute to their growth and success. T R Tech Talk 43Education. Innovation.
