List of property documents to be submitted
THIS IS AN INDICATIVE LIST AND THE USERS ARE ADVISED
TO CONSULT LAWYERS BEFORE FINALISING PROPERTY
DOCUMENTS TO BE SUBMITTED. FORMATS OF
DOCUMENTS ARE SUBJECT TO CHANGES BASED ON
REQUIREMENTS; PLEASE ALSO INSERT DETAILS IN THE
DRAFTS AS PER FACTUAL POSITION. IN CASE THE
PROPERTY IS IN THE POSSESSION / BELONGS TO A
PERSON OTHER THAN THE BORROWER, PLEASE READ
“BORROWER” AS SUCH THIRD PARTY IN THIS LIST
LIST OF DOCUMENTS
A Construction on Freehold Plots
1. Sale/Partition/Gift/Release /Settlement Deed executed in
customer’s favour.
2. Encumbrance Certificate for a period of 15 years to date.
3. Khatha Certificate issued by the corporation or city
municipality / Bangalore Development Authority (BDA) as
applicable.
4. Prior Title Deed/s for the past 15 years.
5. Copies of up to date Tax paid receipts.
6. Copy of Approved plan and Licence for construction issued
by the Bangalore Development Authority or the Bangalore
Municipal Corporation as applicable.
7. Conversion Certificate if applicable.
8. NOC from BDA if the site is under Gram Panchayat, HAL
Sanitary Board Area, ITI Notified Area, if applicable (This
NOC is taken in the BDA format and states that BDA has
not initiated any land acquisition proceedings in that area).
9. Receipt towards the payment of betterment charges (only in
case of a agricultural plots-revenue land used for residential
purposes).
B. Construction on plots allotted by Housing
Co-operative Society
The society is registered under the Karnataka Society
Registration Act and the land which the society acquires
must be as per the rules under part 7 of the act or else the
acquisition is invalid.
1. Sale Deed duly executed between the Society and the flat
owner and registered.
2. Encumbrance Certificate from the date of allotment of site to
date.
3. Khatha Certificate
4. Possession Certificate
5. Allotment letter
6. Letter from the society in favour of IHFC (Draft 1 attached)
for properties under lease.
7. Prior Title Deed/s of acquisition of land by the society.
8. Own Contribution Receipts for cost of site.
9. Copy of Approved plan and Licence for construction issued
by the Bangalore Development Authority or the Bangalore
Municipal Corporation as applicable.
10. Copies of up to date Tax paid receipts.
11. Advocate’s Title Report as the title of the Society to the plot
of land - if applicable.
C. Construction on Bangalore Development
Authority (BDA) / Karnataka Housing Board
(KHB) / Municipal Corporation Sites
1. Conditional Sale Deed executed by BDA if the lease period
is NOT yet over,
OR
Absolute Sale Deed duly registered.
2. Permission from BDA for mortgage of the property in favour
of IHFC (if the same is not incorporated in the Conditional
Sale Deed).
3. Allotment Letter issued by BDA.
4. Possession Certificate.
5. Khatha Certificate issued by BDA.
6. Certified copy of Lease-cum-sale agreement.
7. Receipts issued by BDA for cost of site.
8. Encumbrance Certificate from the Sub-Registrar for 15
years till date.
9. Copy of Land Tax paid receipt issued by BDA/BMP (latest
year).
10. Copy of Approved plan and Licence for construction issued
by the Bangalore Development Authority or the Bangalore
Municipal Corporation as applicable.
D. Construction on B.D.A. auction sites
1. Auction Sale Deed executed by the BDA and the customer
(if already registered).
2. Auction Sale Confirmation Letter issued by the BDA.
3. Receipts issued by the BDA for cost of site.
4. Certified copy of Auction Sale Agreement with the BDA.
5. Possession certificate issued by the BDA.
6. Khatha Certificate issued by the BDA.
7. Encumbrance Certificate from the Sub-Registrar for 15
years till date.
8. Permission from the BDA for Mortgage of the property in
favour of IHFC.
9. Copy of Approved plan and Licence for construction issued
by the Bangalore Development Authority.
E. Construction on B.D.A. reconveyed sites
1. Possession Certificate issued by the BDA.
2. Khatha Certificate issued by the BDA/Bangalore City
Corporation.
3. Copy of Prior Title Deeds in customer’s possession.
4. Encumbrance Certificate from the Sub-Registrar for 15
years till date.
5. Permission from the BDA for mortgage in favour of ICICI
Bank, if applicable.
6. Certified / Photocopy of the Sale Deed with the BDA.
7. Transfer Agreement, if any.
8. Original Land Tax Paid Receipt (latest).
9. Copy of Approved plan and Licence for construction issued
by the Bangalore Development Authority.
F. House/Flats allotted by B.D.A./K.H.B.
 Before release of loan amount
1. Original Allotment Letter.
2. Receipts for the cost of House / Flat.
3. Schedule of Payments.
4. No Objection Certificate from BDA/Karnataka Housing
Board for mortgage of the property in favour of ICICI
Bank
5. Latest Demand Letter from BDA/KHB
6. Possession Certificate
7. Khatha Certificate
 After the release of loan :
1. Sale Deed duly registered in customer’s favour.
2. 15 years Encumbrance Certificate reflecting above
transaction.
3. Money receipt from the Sub Registrar.
4. Endorsement from the Sub Registrar.

5. Latest Tax paid receipt
For alteration / addition in the building / flat -
(a) Cost estimate from the engineer.
(b) Letter of permission to carry out work from BDA /
KHB or society, if already formed.
G. Purchase of ready built flats constructed by
builders
BUILDER’S DOCUMENTS
1. Copy of Approved plan and Licence for construction
issued by the Bangalore Development
Authority/Bangalore Municipal Corporation/Bangalore
Mahanagar Palika as applicable.
2. Registered Sale Deed (title deed/conveyance deed) in
favour of land owner (for outright sale to builder).
3. Parent title deeds for the past 15 years.
4. Draft Sale Deed and construction agreement
5. Development Agreement in favour of the builder in
case development rights are given to builder

Registered POA to develop, sell and mortgage the
property.
6. Encumbrance Certificate -
a) 15 years for privately held property
b) 30 years for Government held property
7. ULC clearance
8. Property tax receipt
9. Khatha Certificate
10. Conversion certificate
11. Legal opinion - title certificate of the builder (from his
own advocate) for scrutiny purposes only. IHFC
reserves the right to a obtain a title certificate from its
own advocate.
BORROWER’S DOCUMENTS
 Before Release of Loan Amount
1. Stamped Agreement for Sale
2. Own Contribution Receipts
3. Letter from the Builder (Draft 2 attatched)
4. Agreement to Sell / Construction Agreement - usually
between the purchaser and the builder except in some
cases where the land owner may join in based on the
terms of his agreement with the builder.
5. Draft copy of the Sale Deed
 After Release of Loan Amount
1. Sale Deed executed in customer’s favour.
2. Khatha Certificate transferred to customer’s name.
3. 15 years Encumbrance Certificate reflecting above
transaction.
4. Money receipt from the Sub Registrar.
5. Endorsement from the Sub Registrar.
6. Tax Assessment copy of the apartment depicting the
relevant municipal number.
7. Deed of Declaration (in cases where the undivided
share of land is registered first and the apartment is
constructed later by the builder).
8. Possession Certificate issued by the builder
H. Purchase of ready built house from a society
SOCIETY DOCUMENTS
1. Registered Sale Deed of land
2. Society Registration Certificate
3. Copy of Approved plan and Licence for construction
issued by the Bangalore Development
Authority/Bangalore Municipal Corporation as
applicable
4. Prior title deeds -
∗ Purchase by society from Individual/Govt
∗ Land acquisition by BDA and transferred to
society
∗ Govt. grant to society
5. 15 years Encumbrance Certificate
6. Possession Certificate
7. Copy of Bye laws of society
8. Property tax paid receipts
9. Khatha Certificate issued by BDA/Corporation
10. NA Conversion certificate
11. Legal opinion - title certificate of the society (from their
own advocate) for scrunity purpose only.
ICICI Bank reserves the right to obtain a title
certificate from its own advocate.
BORROWER’S DOCUMENTS
1. Original Allotment letter
2. Own Contribution Receipts
3. Letter from the Society (Draft 3 attached)
4. Share Certificate issued by the Society duly noting lien
of ICICI Bank.
5. Sale deed executed in customer’s favour
6. Khatha Certificate
7. Endorsement from Sub Registrar
8. Money receipt from Sub Registrar for registration
charges
9. All prior title deeds and documents
10. Encumbrance Certificate reflecting the above
transaction
I. Resale Cases
SELLER’S DOCUMENTS
1. Sale Deed,
2. Prior Title Deeds for the past 15 years
3. Khatha Certificate
4. Uptodate Encumbrance Certificate for 15 years
5. Latest tax paid Receipt
6. Society Registration Certificate if applicable
7. Copy of Approved plan and license
8. Legal opinion - title certificate of the seller from his
own advocate
BORROWER’S DOCUMENTS
1. NOC from Society/Builder (Draft 2/3 as applicable)
2. Agreement to Sell
3. Original Sub Registrar’s receipt
4. Endorsement from Sub Registrar
5. Extract from tax assessment register
6. Own Contribution receipts
7. Sale Deed executed in customer’s favour
8. Khatha Certificate transferred to customer’s name
9. Upto date Encumbrance Certificate depicting the
transaction of sale in favour of the customer.
And any other legal document required by ICICI Bank
or its approved lawyers in order to certify a clear and
marketable title.

to the said property and every part thereof, and that all taxes and
dues in respect thereof have been paid upto the date.
We confirm that we have “No Objection” to your giving a loan to
the said ____________ and his/her mortgaging the said flat to
you / the security trustee nominated by ICICI Bank Limited by
way of security for repayment of the said loan. Notwithstanding
anything to the contrary contained in our agreement

We also undertake to inform and give proper notice to the Co-
operative Housing Society as and when formed about the flat

  • 1. KARNATAKA List of property documents to be submitted THIS IS AN INDICATIVE LIST AND THE USERS ARE ADVISED TO CONSULT LAWYERS BEFORE FINALISING PROPERTY DOCUMENTS TO BE SUBMITTED. FORMATS OF DOCUMENTS ARE SUBJECT TO CHANGES BASED ON REQUIREMENTS; PLEASE ALSO INSERT DETAILS IN THE DRAFTS AS PER FACTUAL POSITION. IN CASE THE PROPERTY IS IN THE POSSESSION / BELONGS TO A PERSON OTHER THAN THE BORROWER, PLEASE READ “BORROWER” AS SUCH THIRD PARTY IN THIS LIST LIST OF DOCUMENTS A Construction on Freehold Plots 1. Sale/Partition/Gift/Release /Settlement Deed executed in customer’s favour. 2. Encumbrance Certificate for a period of 15 years to date. 3. Khatha Certificate issued by the corporation or city municipality / Bangalore Development Authority (BDA) as applicable. 4. Prior Title Deed/s for the past 15 years. 5. Copies of up to date Tax paid receipts. 6. Copy of Approved plan and Licence for construction issued by the Bangalore Development Authority or the Bangalore Municipal Corporation as applicable. 7. Conversion Certificate if applicable. 8. NOC from BDA if the site is under Gram Panchayat, HAL Sanitary Board Area, ITI Notified Area, if applicable (This NOC is taken in the BDA format and states that BDA has not initiated any land acquisition proceedings in that area). 9. Receipt towards the payment of betterment charges (only in case of a agricultural plots-revenue land used for residential purposes). B. Construction on plots allotted by Housing Co-operative Society The society is registered under the Karnataka Society Registration Act and the land which the society acquires must be as per the rules under part 7 of the act or else the acquisition is invalid. 1. Sale Deed duly executed between the Society and the flat owner and registered. 2. Encumbrance Certificate from the date of allotment of site to date. 3. Khatha Certificate 4. Possession Certificate 5. Allotment letter 6. Letter from the society in favour of IHFC (Draft 1 attached) for properties under lease. 7. Prior Title Deed/s of acquisition of land by the society. 8. Own Contribution Receipts for cost of site. 9. Copy of Approved plan and Licence for construction issued by the Bangalore Development Authority or the Bangalore Municipal Corporation as applicable. 10. Copies of up to date Tax paid receipts. 11. Advocate’s Title Report as the title of the Society to the plot of land - if applicable. C. Construction on Bangalore Development Authority (BDA) / Karnataka Housing Board (KHB) / Municipal Corporation Sites 1. Conditional Sale Deed executed by BDA if the lease period is NOT yet over, OR Absolute Sale Deed duly registered. 2. Permission from BDA for mortgage of the property in favour of IHFC (if the same is not incorporated in the Conditional Sale Deed). 3. Allotment Letter issued by BDA. 4. Possession Certificate. 5. Khatha Certificate issued by BDA. 6. Certified copy of Lease-cum-sale agreement. 7. Receipts issued by BDA for cost of site. 8. Encumbrance Certificate from the Sub-Registrar for 15 years till date. 9. Copy of Land Tax paid receipt issued by BDA/BMP (latest year). 10. Copy of Approved plan and Licence for construction issued by the Bangalore Development Authority or the Bangalore Municipal Corporation as applicable. D. Construction on B.D.A. auction sites 1. Auction Sale Deed executed by the BDA and the customer (if already registered). 2. Auction Sale Confirmation Letter issued by the BDA. 3. Receipts issued by the BDA for cost of site. 4. Certified copy of Auction Sale Agreement with the BDA. 5. Possession certificate issued by the BDA. 6. Khatha Certificate issued by the BDA. 7. Encumbrance Certificate from the Sub-Registrar for 15 years till date. 8. Permission from the BDA for Mortgage of the property in favour of IHFC. 9. Copy of Approved plan and Licence for construction issued by the Bangalore Development Authority. E. Construction on B.D.A. reconveyed sites 1. Possession Certificate issued by the BDA. 2. Khatha Certificate issued by the BDA/Bangalore City Corporation. 3. Copy of Prior Title Deeds in customer’s possession. 4. Encumbrance Certificate from the Sub-Registrar for 15 years till date. 5. Permission from the BDA for mortgage in favour of ICICI Bank, if applicable. 6. Certified / Photocopy of the Sale Deed with the BDA. 7. Transfer Agreement, if any. 8. Original Land Tax Paid Receipt (latest). 9. Copy of Approved plan and Licence for construction issued by the Bangalore Development Authority. F. House/Flats allotted by B.D.A./K.H.B.  Before release of loan amount 1. Original Allotment Letter. 2. Receipts for the cost of House / Flat. 3. Schedule of Payments. 4. No Objection Certificate from BDA/Karnataka Housing Board for mortgage of the property in favour of ICICI Bank 5. Latest Demand Letter from BDA/KHB 6. Possession Certificate 7. Khatha Certificate  After the release of loan : 1. Sale Deed duly registered in customer’s favour. 2. 15 years Encumbrance Certificate reflecting above transaction. 3.   • 2. 5. Latest Tax paid receipt For alteration / addition in the building / flat - (a) Cost estimate from the engineer. (b) Letter of permission to carry out work from BDA / KHB or society, if already formed. G. Purchase of ready built flats constructed by builders BUILDER’S DOCUMENTS 1. Copy of Approved plan and Licence for construction issued by the Bangalore Development Authority/Bangalore Municipal Corporation/Bangalore Mahanagar Palika as applicable. 2. Registered Sale Deed (title deed/conveyance deed) in favour of land owner (for outright sale to builder). 3. Parent title deeds for the past 15 years. 4. Draft Sale Deed and construction agreement 5. Development Agreement in favour of the builder in case development rights are given to builder + Registered POA to develop, sell and mortgage the property. 6. Encumbrance Certificate - a) 15 years for privately held property b) 30 years for Government held property 7. ULC clearance 8. Property tax receipt 9. Khatha Certificate 10. Conversion certificate 11. Legal opinion - title certificate of the builder (from his own advocate) for scrutiny purposes only. IHFC reserves the right to a obtain a title certificate from its own advocate. BORROWER’S DOCUMENTS  Before Release of Loan Amount 1. Stamped Agreement for Sale 2. Own Contribution Receipts 3. Letter from the Builder (Draft 2 attatched) 4. Agreement to Sell / Construction Agreement - usually between the purchaser and the builder except in some cases where the land owner may join in based on the terms of his agreement with the builder. 5. Draft copy of the Sale Deed  After Release of Loan Amount 1. Sale Deed executed in customer’s favour. 2. Khatha Certificate transferred to customer’s name. 3. 15 years Encumbrance Certificate reflecting above transaction. 4. Money receipt from the Sub Registrar. 5. Endorsement from the Sub Registrar. 6. Tax Assessment copy of the apartment depicting the relevant municipal number. 7. Deed of Declaration (in cases where the undivided share of land is registered first and the apartment is constructed later by the builder). 8. Possession Certificate issued by the builder H. Purchase of ready built house from a society SOCIETY DOCUMENTS 1. Registered Sale Deed of land 2. Society Registration Certificate 3. Copy of Approved plan and Licence for construction issued by the Bangalore Development Authority/Bangalore Municipal Corporation as applicable 4. Prior title deeds - ∗ Purchase by society from Individual/Govt ∗ Land acquisition by BDA and transferred to society ∗ Govt. grant to society 5. 15 years Encumbrance Certificate 6. Possession Certificate 7. Copy of Bye laws of society 8. Property tax paid receipts 9. Khatha Certificate issued by BDA/Corporation 10. NA Conversion certificate 11. Legal opinion - title certificate of the society (from their own advocate) for scrunity purpose only. ICICI Bank reserves the right to obtain a title certificate from its own advocate. BORROWER’S DOCUMENTS 1. Original Allotment letter 2. Own Contribution Receipts 3. Letter from the Society (Draft 3 attached) 4. Share Certificate issued by the Society duly noting lien of ICICI Bank. 5. Sale deed executed in customer’s favour 6. Khatha Certificate 7. Endorsement from Sub Registrar 8. Money receipt from Sub Registrar for registration charges 9. All prior title deeds and documents 10. Encumbrance Certificate reflecting the above transaction I. Resale Cases SELLER’S DOCUMENTS 1. Sale Deed, 2. Prior Title Deeds for the past 15 years 3. Khatha Certificate 4. Uptodate Encumbrance Certificate for 15 years 5. Latest tax paid Receipt 6. Society Registration Certificate if applicable 7. Copy of Approved plan and license 8. Legal opinion - title certificate of the seller from his own advocate BORROWER’S DOCUMENTS 1. NOC from Society/Builder (Draft 2/3 as applicable) 2. Agreement to Sell 3. Original Sub Registrar’s receipt 4. Endorsement from Sub Registrar 5. Extract from tax assessment register 6. Own Contribution receipts 7. Sale Deed executed in customer’s favour 8. Khatha Certificate transferred to customer’s name 9. Upto date Encumbrance Certificate depicting the transaction of sale in favour of the customer. We hereby assure you that the said flat as well as the said building and the land appurtenant thereto are not subject to any encumbrance, charge or liability of any kind whatsoever and that the entire property is free and marketable. We further confirm that we have a clear, legal and marketable title to the said property and every part thereof, and that all taxes and dues in respect thereof have been paid upto the date. We confirm that we have “No Objection” to your giving a loan to the said ____________ and his/her mortgaging the said flat to you / the security trustee nominated by ICICI Bank Limited by way of security for repayment of the said loan.
