Please supply the information on the following points:
1. Nature of matter: Matter is arising out of refusal of F.I.R by Police, Dismissal
of Writs by Supreme Court of India and Continuation of Sexual Abuse by the State
since 20 years.
This is a kidnapping, abduction, Non- Bail able Warrant, Gang Rape, Illicit Sex
trade and human trafficking matter by the state since 20 years.
No F.I.R, no ATR, no rescue and no rehabilitation against the case of Abduction,
Gang Rape, Child Sexual Abuse, illicit sex trade and human trafficking either by
Delhi Police or by Bihar Police. Case is a replica of Muzaffarpur shelter home case.
Two N.B.W dated 25.08.2010 & 8.9.2011 u/s 82 & 83 Cr.Pc. against petitioner and
unlawful detention of whistle blower, violation of provisions of Juvenile Justice Act
2015 & POCSO Act 2012, violation of direction of this Hon’ble Court laid down in
Lalita Kumari vs. Government of Uttar Pradesh & Ors. (W.P. (Crl.) No. 68/2008),
judicial malfunctioning, adverse order dated 9.12.2022 has been deferred, unlawful

intervention dated 13.04.2021 by National Commission for Protection of Child
Rights (NCPCR) and 17.04.2021 by ChildLine India Foundation NGO. Order dated
6.1.23 has been complied to file I.A. No. 8023/2023 for Condonation of delay in
refiling/curing the defects therefore Writ number has not been allotted.
That cause of action arose on 26.04.2021 at Shastri Park North East Delhi,
11.05.2022 at Sonaili Bazar, Katihar, Bihar and 19.06.2022 at Church Mission
Road, Fatehpuri Old Delhi. Neither Bihar Police nor Delhi Police has registered an
F.I.R nor supplied any ATR against more than twenty five 112 calls made by the
petitioner between 03.05.2020 to till date. PIL W.P.(Crl.) No. 242/2021 has been
dismissed on 25.10.2021 by this Hon’ble Court due to non-appearance of Amicus
Curie and Legal Aid Advocates in this matter.
That Instead of rescue and rehabilitation within the family or within the state owned
institutions under the intimation of petitioner; victims have been pushed into the
mud of prostitution and into the clutches of human traffickers again with greater
magnitude. NCPCR, ChildLine India Foundation, Bihar Police and Delhi Police
have misused their power and served the victims to the bureaucrats, officers,
politicians and general public for debauchery. Victims have been trafficked across
the country and globe for illicit sex trade and prostitution. One of the victim is
Petitioner’s 18 year ago kidnapped pregnant wife Rina Kumari alias Guddi and his
never seen 17 year old minor daughter.
2. Date of impugned order/High Court: 25.10.2021 in W.P.(Crl.) No. 242/2021
and 02.05.2022 in W.P.(Crl.) No. 137/2021 at Supreme Court of India.
3. Date of filing of matter before this Court: E-filed on 07.06.2022 and
physically filed on 14.06.2022 to revive/ restore e-filed Writ dated 7.6.22.
4. Grounds of urgency: to avoid sexual abuse, to rescue and rehabilitate the
victims’ immediately. There is sheer violation of practice, procedure and Rule of
Law in this matter by the Registry of this Hon’ble Court. Matter has been placed
before mentioning branch on 16.1.23 but being withheld for updating the case
status till 28.1.23. That matter has been rejected for listing on 31.1.23 even after
physically mentioning dated 30.1.23 before mentioning branch.
5. Latest date upto which the matter can be heard in view of the urgency
indicated: 01.02.2023
6. Nature of interim order sought in the matter
That allow this extremely urgent matter to mention before the Hon’ble Chief Justice
of India for issuance of a writ of mandamus or other appropriate writ order or
direction directing respondent No.01 Secretary, Ministry of Home Affairs to rescue
the Gang Rape and illicit sex trade victims from the clutches of human traffickers

and from the mud of hidden prostitution to rehabilitate them within the family or
within the State owned institutions under the intimation to the petitioner
immediately; depending upon the nature and dynamics of the case till the
investigation team constituted by this Hon’ble Court or the investigation process
resumes and completes.
