The complainant alleged that his mother Asha Rani's death was planned murder by two individuals. However, the police investigation found that:
1) Asha Rani, a 70-year old asthmatic patient under treatment at AIIMS for 10 years, was sent home from AIIMS on November 8th due to lack of beds.
2) When her condition deteriorated, she was taken to hospital but was declared dead on arrival.
3) The postmortem report found the cause of death was cardiac shock and myocarditis, and the manner of death was natural.
4) No evidence was found to support the complainant's allegations of planned murder. The complaint was determined to have no basis.

Gist of ailegation:- comprainant aileged that police officials of PS Palam Village
did not registere FIR on the death of his mother Asha Rani' Death of his mother
was planned murder by Rtd. Justice s.B Sinha from supreme court of lndia &
praveen Kumar from rndian Defence Account service nexus with the doctors of
AllMS. The patient was follow up case with AIIMS medicine department ' on
oglt1,l17 she was sent back to home due to scarcity of bed in the hospital' The
patient condition was deteriorated and complainant called at 100 no' on

hospital. l.o did not give him copy of PM report and did not register the FIR'

entrusted to me for necessary action. I reached at the spot and patient Asha Rani'
age 70 yrs was sent to DDU Hospital by PCR Van' smt' Asha Rani was declared
brought dead by doctor vide MLC no. 12407117. The statement of comprainant
was recorded. He asserted that his mother had been airing from the disease of
Asthama since 2010. she had been under treatment in AilMS Hospital Delhi since
2OtO.On 0g/11 117 he brought her mother to opD of AilMs Hospitar. Dr. Rajesh
sharma advised him to admit smt. Asha Rani in hospitar but her was not admitted
in hospital due to scarcity of bed and sent back to home after mentioning LAMA'
The postmortem of deceased was got conducted in mortuary of DDU Hospital

was received from DDU Hospital. ln the PM report, doctor opined cause of death
is cardiac shock due to cardiac temponade and myocarditis and manner of death

deceased was handed over to complainant'
concrusion:- Smt. Asha Rani was asthamatic patient for rast 10 years. she had
been under treatment in oPD of AtIMS Hospital' complainnat alleged that his

2. mother had not been admitted in AIIMS hospital and he was forced to go home
aftg1" mentioning LAMA on medical treatment documents. Complainant has not
produced any medical document in this regard where patient was declared LAMA
(Leave against medical advice). The allegation of complainant could not be
substantiated. The manner of death of deceased is natural. No cognizable offence
is made out. The complaint may be filed.
