No.15 CL.NO.1748 may lead to dismissal of petition-reg.
Hon’ble Sir,
1. That under signed is OM PRAKASH S/O Late Shri Deep
Narayan Poddar, Age about 48 years, R/O Asha Deep Niwas,
Shukkar Hatt, Sonaili Village, P.S. Kadwa, District Katihar,
Bihar-855114 and R/O RZF-893, Netaji Subhash Marg, Raj
Nagar Part-2, Palam Colony, New Delhi-110077 and Petitioner-
in-Person in the International Sex Racket matter in Writ Petition
(Criminal) No. 242/2021, Interlocutory Application No.
66686/2022 in Writ Petition (Criminal) No. 137/2021 and Writ
Petition (Criminal) Diary No. 18546/2022 before Supreme
Court of India.

2. That registry has not issued the NOTICE to the Petitioner-In-
Person for the date of hearing on 28.11.2022 in the above said
matter as per office report dated 26.11.2022, “Since it is a
defective matter, interaction with Petitioner-In-Person by
concerned Registrar is still awaited. Therefore, the Petitioner-
In-Person can not appear before the Hon’ble Court without
interaction.”
3. That Registry has Suppressed the additional e-filed 88 Gang
Rape related reports (filed from the field of Bihar and Delhi) in
Office Report dated 26.11.2022 in Non Bail able Warrant and
Gang Rape matter W.P. (Criminal) Diary No. 18546/2022 listed
for hearing on 28.11.2022 before Chamber Judge HON'BLE
MR. JUSTICE PAMIDIGHANTAM SRI NARASIMHA, Court
No.15 CL.NO.1748.
4. That Registry has only recorded the records to defend its
heinous work in the Office Report dated 26.11.2022 hiding all
the factual crucial records filed by the petitioner even after his
reminder though e-filed letter dated 22.11.2022 addressed to
Branch Officer and Assistant Registrar Section X.
5. That in response to the queries of Shri Deepak Punwani
Assistant Registrar Section X, letter dated 22.11.2022 states at

para no.05, “ That all legal documents either filed physically or
filed electronically are very crucial in this case.”
6. That letter dated 22.11.2022 notes at para no.03, “That
Petitioner has e-filed 10 legal documents on 7.6.2022 and 84
Additional legal documents till 22.11.2022 in Provisional
Application no. 12939-2022 and Writ Petition (Criminal) Diary
No. 18546/2022 before Supreme Court of India which has not
been taken into record of office report dated 24.09.2022 and
has not been entered into Writ Petition (Criminal) Diary No.
18546/2022 at the website in the public domain. Hence, crucial
records have been suppressed deliberately with ulterior
motive.”
7. That letter dated 22.11.2022 clearly says at para no.06,
“That all Annexures, letters, miscellaneous documents, I.A. for
written arguments are supportive of Gang Rape report filed
from ground zero level either from Bihar or from Delhi.”
8. That letter dated 22.11.2022 categorically states at para no.07,
“That e-filed important legal documents like Interlocutory
Applications for additional grounds dated 20.09.2022 and
recall /cancellation of Non Bailable Warrant dated 09.10.2022
has not been entered into Physical filing case record of Writ

Petition Criminal Diary No. 18546/2022 at the website of
Supreme Court of India to present the wrong fact before the
Chamber Judge on 25.11.2022 for office order/direction.”
9. That letter dated 22.11.2022 further prays at para 09,
“petitioner requests you to take on record all e-filed and
physical filed legal documents on record in office report in
W.P. (Criminal) Diary No. 18546/2022 for the date of hearing
on 25.11.2022 before Chamber Judge for direction of Office
Order.”
10. That despite of written requests, Registry has suppressed all
the crucial records filed by the petitioner in Office Report dated
26.11.2022 to dismiss the petition by default for non-
compliance of order dated 26.09.2022 by this Hon’ble Court
which says, ““Last opportunity of four weeks time to cure the
defects is granted. On non-compliance to cure the defects
within a period of four weeks, the matter(s) will be deemed to
be dismissed on default without reference to the Court”.
11. That Registry has recorded the defects, “Petitioner -In
-Person has cured all the defects except that he has not filed an
application for condonation of delay in filing the instant Writ

Petition Petition (Crl.)” in the Office Report dated 26.11.2022
which has been raised on 14.10.2022 after curing all the defects
on 10.10.2022 and complying order dated 26.09.2022 of this
Hon’ble Court. Moreover, the said defect is beyond the purview
of order dated 26.09.2022.
12. Hence, under the above facts and circumstances, petitioner
prays from to you to take on record all the crucial records either
filed electronically or filed physically by the petitioner in Non
Bail able Warrant and Gang Rape matter W.P. (Criminal) Diary
No. 18546/2022 for hearing on 28.11.2022.
