casehitclosetohomeasmysonhadfriends
thatwereaffected. OnJanuary1,2013inthe
UniversityofCincinnaticampusareathree
blocksoffcampus,twocollegestudentsdied
ofsmokeinhalationduetoasmolderingfire.
Asalandlord,gettingacallaboutatenant
dyinginafireatoneofmyrentalhomesisone
ofmygreatestfears. Readingthearticleand
hearingtheaccountfrommyson,Iwas
botheredbyseveralthings.
Therentalwasasolidbrickhouse–notthe
aging,woodframed,structurethatImight
firstthinkofwhenIhearaboutseriousfires.
Thefiredidn’tappeartohavebeenaserious
blaze. NewsreportsandtheFireDepartment
reportsaidthecallcameinat6:48AM,trucks
wereonthesceneinlessthan3.5minutes,they
hadthefireundercontrolin10minutesandhad
confinedittooneroom. Afiremancommented
thatwhenhearrivedhewasnotsuretheyhad
therightaddressbecausehedidnotimmediately
seesignsoffire. Thefiremencarriedthetwo
victimsfromthehouse9minutesand50seconds
afterthefirstcallcamein. Whatkilledthe
residentswassmoke. Thefirenevergotnear
them. Theywereonthefloor,apparentlytrying
toescapewhentheywereovercomewithsmoke.
Whiletherewereothercomplicatingfactorsto
thatsituation,itdiddrawasignificantamountof
attentiontosmokebasedfatalitiesthatareso
commoninhousefires. Contrarytopopular
belief,mostdeathsfromhousefiresdo
notoccurfromburns,butinsteadfrom
smoke. Thesmokebasedfatalitiesarea
problemthatcouldmostlikelybe
avoidedwiththeuseofaphotoelectric
typeofsmokedetector. Thesedetectors,
accordingtoseveraluniversitystudies,
aresignificantlymoreeffectiveinpicking
upsmolderingfires. Withtoday’s
pervasiveuseoffireretardantmaterials,
mostfiresactuallysmolderfora
significantamountoftimebefore
growingintoaflaming-fire. The
photoelectricsmokedetectorsare
quickeractivatingwiththesesmoldering
firesandsubstantiallythesameinfast
burningfires. Byutilizingasinglesensor
photoelectricsmokedetector,residents

ontothelightsensor;triggeringthealarm.
Combo-Units: Pleasenotetheuseoftheterm
“singlesensor”isnotwithoutpurpose. There
arecombo-unitsthatincludebothionization
andphotoelectricsensors. However,these
combounitsconsistentlyreactslowerthan
singlesensorunitsinvarioustests,andarenot
recommended. Tobebrief,theyaremore
costlyandlesseffective.
Althoughmanyofthechangesinthelawcallfor
photoelectricinstallation,foreachtypeof
smokealarm,theadvantageitprovidesmaybe
criticaltolifesafetyinsomefiresituations. Fatal
firesinarentalhome,dayornight,includea
largenumberofsmolderingfiresandalarge
numberofflamingfires.Youcan’tpredictthe
typeoffireyoumayhaveinyourrentalhomeor
whenitwilloccur.Anysmokealarm
technology,tobeacceptable,mustperform
acceptablyforbothtypesoffriesinorderto
provideearlywarningoffireatalltimesofthe
dayornightandwhetheryouareasleepor
awake.
Forbestprotection,NREIArecommendsboth
(ionizationandphotoelectric)technologiesto
beusedinrentalhomes. Wealsoencourage
havingaworkingandtestedcarbonmonoxide
detectorandfireextinguisherinyourrentals.

battery. Longerlastingbatteriesareexpected
toenterthemarketlaterthisyear–updates
willbeannouncedastheybecomeavailable.
Manydetectorshaveapinnearthebattery
case,whichcanhelpdenyordelayatenant
accesstothebattery.
Sowhatarethespecificdifferenceinsmoke
detectortypes?
IonizationDetectors: typicallytheseare
disabledatleast20%ofthetimedueto
nuisance(false)alarms. Ionization-type
smokealarmshaveasmallamountof
radioactivematerialbetweentwoelectrically
chargedplates,whichionizedtheairand
causescurrenttoflowbetweentheplates.
Whensmokeentersthechamber,itdisrupts
theflowofions,thusreducingtheflowof
currentandactivatingthealarm.Ionization
detectorswilloftenhaveanatomicsymbolon
themfortheir(exceptionallysmall)
radioactiveingredient,whilephoto-electrics
willtypicallyhave“P”inasquarestampedon
thecase. 90%ofalldetectorscurrentlybeing
usedareionization.
Photoelectricsmokealarms: generallymore
responsivetofiresthatbeginwithalong
periodofsmoldering. Photoelectric-type
alarmsaimalightsourceintoasensing
maybenotifiedbetween2and40minutes
earlier,basedonuniversitystudies.
Duetothistechnologicaladvantage,inaneffort
tohelpreducesmokerelatedfatalities,many
municipalitiesacrosstheU.S.arechanginglaws
orpassingordinancestorequirephotoelectric
smokedetectorsinrentalproperties. Mostof
theseordinancesrequirealandlordtoinstallone
photoelectricsmokedetectorsinabedroom,or
outsideofabedroombetweencontiguous
bedrooms. Personally,Iamplacingthemineach
bedroom,thehallways,andatthetopofthe
stairwellsdependingonthelayoutofthehome.
Manyofthesenewlawsputstricttime
requirementsintoplace.
Becauseofthelogisticsandfinancialimpact,as
wellaslikelihoodofincident,theselawsare
askingsingle-familyrentalsandsmallerbuildings
tofinishtheprocessmorequickly,asstudentand
universityrelatedfatalitieshavebeenmore
significantlyimpacted. NationalREIAhas
workedwithourpartner,TheHomeDepotand
theirmanufacturerstoaddressthesubstantial
needforadependablesolutionsforour
members,independentrentalowners. Inmost
areastherewillbeanannualcertificationthat
thedetectorsareworking. Theprocessforthis
willmostlikelybethepostingofaself-signedand
datedcertificateIanareabyafireextinguisher
orboilercertificateattheproperty.
PleaseconsiderthatALLsmokealarmsexpire
after10years. Ifthesmokealarmdoesnothave
adatestampedonit,itmostlikelypredatesthe
10yearexpirationandwillbeconsidered
“expire”byfireinspectorsinanyregion.
Someotherwaystomakethedetectorlonger
lastingarelithiumbatteries.Theselong-life
batteriescanhelpminimizethemaintenance
requiredforbatterychangeoutsandreducethe
timeittakestoperformannualcertification.

ON May 19th, 2016 HR 5301:  The Seller Finance
Enhancement Act was introduced to the 114th US
Congress by Congressman Roger Williams a
Republican from Texas along with his co-sponsors

3. Mick Mulvaney (R-SC-5)
4. Henry Cueller (D-TX-28)
Initially announced by the Seller Finance Coalition at
a Note School Event way back in 2013 by the one and
only sponsor at the time Congress Roger Williams, it
has gone through many draftings and discussions to
create the final bill that was introduced and to add
the initial co-sponsors listed.
When the SAFE Act and Dodd-Frank went into effect
it virtually overnight stopped most real estate
investors from offering seller financing and
installment sales to home owners who could ill afford
the blow.  Seller Financing by is the primary source
for financing for home buyers in the under $50,000
price range and those buying non-conventional
housing, like mobile homes.  Discouraging
homeownership.
The Bill would simply exempt seller financers who
originate not more than 24 mortgages in a 12-month
period from mortgage lending rules under the SAFE
Act and Dodd-Frank Act.  Specifically the Loan

Demand has remained high through the first three quarters of 2016. With rental prices and
employment opportunities in a consistent climb, year-over-year increases in home buying are
probable for the rest of the year but not guaranteed.
In general, today's demand is driven by three factors: Millennials are reaching prime home-
buying age, growing families are looking for larger homes and empty nesters are downsizing.
However, intriguingly low interest rates often prompt refinancing instead of listing, contributing
to lower inventory. Recent studies have also shown that short-term rentals are keeping a
collection of homes off the market.

Let’s face it, our local cities are facing
hard times. Their expenses are
continually going up and their
funding is not necessarily going up.
They could raise “taxes”, but they
may not be elected to the city council
next time up. So they are getting
creative.
These same officials are facing aging
housing stock where the homes and
apartments need to be repaired and
updated, maintained and even
replaced as time goes on. And while
home owner work hard to maintain
what they own, there are some who
do not have the time, money or
ability to maintain their homes. Some
just don’t care and also do nothing.
In an effort to make sure the housing
in their city is safe, they have long

This past year in 2015 in a precedent-
setting win for personal freedom and
tenants, the U.S. District Court for
the Southern District of Ohio in the
Baker v. the City of Portsmouth, the
court rules that “the Portsmouth
[Ohio Rental Dwelling Code] violates
the Fourth Amendment insofar as it
authorizes warrantless
administrative inspections. It is
undisputed that the RDC affords no
warrant procedure or other
mechanism for pre-compliance
review. As in the above cases, the
owners and/or tenants of rental
properties in Portsmouth are thus
faced with the choice of consenting
to the warrantless inspection or
had rules and regulations on the
books that require inspections to
make sure the building is up to code
and meet city codes rules and
regulations. But now with the aging
stock and the need for more funds,
more and more cities are creating
new rules and regulations that
require the at least the landlord
property owners to get a license of
some sort, generating income. And in
an effort to keep properties
maintained, they are creating new
inspection rules to go along with
those licensing requirements.
All well and good, except for
something called the Fourth
Amendment to the Constitution that
prohibits warrantless inspections of
homes without the occupant’s
consent.

slum lord, which the cities concede is a
miniscule portion of all landlords, well,
we are pretty sure that they don’t
care about their properties, their
tenants or even the rules and why
would even more rules make them do
anything different.
So what can we as landlords, investors
and property owners in Missouri do?
We highly encourage you to be part
of some or several organizations who
monitor what is going on and respond
as best they can. First join MAREI and
be sure to subscribe to our email
newsletters and / or follow MAREI on
social media. Next, join the Landlord
organization(s) in the cities where you
hold rentals. We list many of them on
the MAREI calendar to help you find
one near you.. As each and every city
is going to have a different set of rules
and regulations, your local landlord
group is going to be your best first line
of defense.
In Kansas most landlord groups are
already a part of their state
Organization The Associated
Landlords of Kansas. In Missouri,
there is no state Organization.
It takes coordinated effort to show
the general public, that 99.9% of all
Landlords are good people, with great
properties, who take care of their
tenants. The public only sees that
0.1% of the bad landlords as bad press
sells generates more viewers that the
cute feel good stories.

onthisbillforalmostayear,fightingoff
multitudesofattacks.Heaskedforand
receivedmuchcooperationandsupport
fromtheRealtorLobbyistandmanyothers,
withoutwhomthislegislationmightnothave
passed.
EffectiveJuly1,2016,thisnewlawisagiant
stepforwardinpreservingtherightsofboth
propertyandprivacyforthecitizensof
Kansas.
Manycitiesarestilldoinginteriorinspections
onrentalswhentheyarevacantbetween
tenantsorwhentheyareabletoobtainand
administrativewarrant,sowewillneedto
watchandseehowcitiesacrossKansasdeal
withthisaspect.
MostrecentlythecityofIndependence
Missourivotedtoamendcitycodetoadd
interiorinspectionseverytwoyearsonrental
property. Togetaroundthe4thamendment
issue,thecityhasdecidedtheywillnotdothe
inspection,butratherprovidethelistof
qualifiedinspectorsandrequirethelandlord
toorderandpayfortheirowninspections.
ThelandlordsinIndependencecollected
signaturesinattempttogettheordinance
puttothevotebutwereun-successful.
So,whereisthisallgoing? Well,hereat
MAREI,ourbeliefisthatthemoreyou
regulatetherentals,thecostswillgoupfor

facingcriminalcharges,aresulttheSupreme
Courthasexpresslydisavowedunderthe
FourthAmendment.
Whatdoesthatmeanforeveryoneelsenotin
PortsmouthOhio,wellthenextstepwastoseeif
thecityinquestionwouldappealtheruling,
whichtheydidnot. Nextupwouldbeforother’s
totakesuitagainsttheirowncitiestogetsimilar
rulings.
InanothercaseinColoradowherearental
inspectionprogramwasstartedtocutdownon
slumlordsandmakesureeveryresidenthasa
habitableplacetolive,atenantendedupincourt
forrefusingtoallowinspectorsintohishome. In
thatcasethecitymanagerorderedastayon
interiorrentalinspectionsonsinglefamily
homesuntiltheycouldberemovedfromtheir
inspectionprogram. Althoughtheyarestill
maintainingtheinspectionrulesformultifamily.
Meanwhile,citiesinKansasandMissourikeep
creatingnewinteriorinspectionlawsfortheir
cities.
IntheStateofKansas,TheAssociatedLandlords
ofKansasandtheirPresidentEdJaskiniawas
successfulingettingHB@665thatwas
eventuallycombinedwithSB366andseveral
otherbillspassedandsignedintoKansasLawon
May17,2016. ThisnewKansasLawsays four
importantthings:
1)Noresidentialrentallicensingprogram
operatedbycityorcountygovernmentsmaydo
anINTERIORinspectionwithouttheconsentof
thelawfuloccupant.Theymustask,andthe
Tenant mustagree,ortheinspectionisnot
allowedtohappen.Thereisanexceptiontothis
lawformixedusebuildings,suchasabuilding
withbothcommercialandresidentialTenants.
2)ThislawdoesNOTmakeanychangestothe
LandlordsrighttoenterasdefinedintheKansas
Landlord-TenantLaw(58-2557).

One casehitclosetohomeasmysonhadfriends thatwereaffected. OnJanuary1,2013inthe UniversityofCincinnaticampusareathree blocksoffcampus,twocollegestudentsdied ofsmokeinhalationduetoasmolderingfire. Asalandlord,gettingacallaboutatenant dyinginafireatoneofmyrentalhomesisone ofmygreatestfears. Readingthearticleand hearingtheaccountfrommyson,Iwas botheredbyseveralthings. Therentalwasasolidbrickhouse–notthe aging,woodframed,structurethatImight firstthinkofwhenIhearaboutseriousfires. Thefiredidn’tappeartohavebeenaserious blaze. NewsreportsandtheFireDepartment reportsaidthecallcameinat6:48AM,trucks wereonthesceneinlessthan3.5minutes,they hadthefireundercontrolin10minutesandhad confinedittooneroom. Afiremancommented thatwhenhearrivedhewasnotsuretheyhad therightaddressbecausehedidnotimmediately seesignsoffire. Thefiremencarriedthetwo victimsfromthehouse9minutesand50seconds afterthefirstcallcamein. Whatkilledthe residentswassmoke. Thefirenevergotnear them. Theywereonthefloor,apparentlytrying toescapewhentheywereovercomewithsmoke. Whiletherewereothercomplicatingfactorsto thatsituation,itdiddrawasignificantamountof attentiontosmokebasedfatalitiesthatareso commoninhousefires. Contrarytopopular belief,mostdeathsfromhousefiresdo notoccurfromburns,butinsteadfrom smoke. Thesmokebasedfatalitiesarea problemthatcouldmostlikelybe avoidedwiththeuseofaphotoelectric typeofsmokedetector. Thesedetectors, accordingtoseveraluniversitystudies, aresignificantlymoreeffectiveinpicking upsmolderingfires. Withtoday’s pervasiveuseoffireretardantmaterials, mostfiresactuallysmolderfora significantamountoftimebefore growingintoaflaming-fire. The photoelectricsmokedetectorsare quickeractivatingwiththesesmoldering firesandsubstantiallythesameinfast burningfires. Forbestprotection,NREIArecommendsboth (ionizationandphotoelectric)technologiesto beusedinrentalhomes. Wealsoencourage havingaworkingandtestedcarbonmonoxide detectorandfireextinguisherinyourrentals. outsideofsmokealarmsforthisstyleof battery. Longerlastingbatteriesareexpected toenterthemarketlaterthisyear–updates willbeannouncedastheybecomeavailable. Manydetectorshaveapinnearthebattery case,whichcanhelpdenyordelayatenant accesstothebattery. Sowhatarethespecificdifferenceinsmoke detectortypes? IonizationDetectors: typicallytheseare disabledatleast20%ofthetimedueto nuisance(false)alarms. Becauseofthelogisticsandfinancialimpact,as wellaslikelihoodofincident,theselawsare askingsingle-familyrentalsandsmallerbuildings tofinishtheprocessmorequickly,asstudentand universityrelatedfatalitieshavebeenmore significantlyimpacted. NationalREIAhas workedwithourpartner,TheHomeDepotand theirmanufacturerstoaddressthesubstantial needforadependablesolutionsforour members,independentrentalowners. Inmost areastherewillbeanannualcertificationthat thedetectorsareworking. Theprocessforthis willmostlikelybethepostingofaself-signedand datedcertificateIanareabyafireextinguisher orboilercertificateattheproperty. PleaseconsiderthatALLsmokealarmsexpire after10years. Ifthesmokealarmdoesnothave adatestampedonit,itmostlikelypredatesthe 10yearexpirationandwillbeconsidered “expire”byfireinspectorsinanyregion. Someotherwaystomakethedetectorlonger lastingarelithiumbatteries.Theselong-life batteriescanhelpminimizethemaintenance requiredforbatterychangeoutsandreducethe timeittakestoperformannualcertification. H.R. 5301 S E L L E R F I N A N C E ON May 19th, 2016 HR 5301:  The Seller Finance Enhancement Act was introduced to the 114th US Congress by Congressman Roger Williams a Republican from Texas along with his co-sponsors 1. Randy Neugebauer (R-TX-10) 2. Bobby Rush (D-IL-1) 3. Mick Mulvaney (R-SC-5) 4. Henry Cueller (D-TX-28) Initially announced by the Seller Finance Coalition at a Note School Event way back in 2013 by the one and only sponsor at the time Congress Roger Williams, it has gone through many draftings and discussions to create the final bill that was introduced and to add the initial co-sponsors listed. When the SAFE Act and Dodd-Frank went into effect it virtually overnight stopped most real estate investors from offering seller financing and installment sales to home owners who could ill afford the blow.  Seller Financing by is the primary source for financing for home buyers in the under $50,000 price range and those buying non-conventional housing, like mobile homes.  Discouraging homeownership. The Bill would simply exempt seller financers who originate not more than 24 mortgages in a 12-month period from mortgage lending rules under the SAFE Act and Dodd-Frank Act.  Specifically the Loan  ACTION R E I N V E S T M E N T N E W S | 5

Twenty four seller financed loans per year, including first mortgages, second mortgages and installment land contracts is enough for almost any small real estate investor to get back to improving our cities housing stock, providing clean, save housing for consumers to own, and making some long term interest on these transactions to help secure and stabilize our own financial futures. With rental prices and employment opportunities in a consistent climb, year-over-year increases in home buying are probable for the rest of the year but not guaranteed. In general, today's demand is driven by three factors: Millennials are reaching prime home- buying age, growing families are looking for larger homes and empty nesters are downsizing. However, intriguingly low interest rates often prompt refinancing instead of listing, contributing to lower inventory.   • 10. INVESTORS TAKE ACTION ON  INTERIOR INSPECTIONS INVESTORS TAKE ACTION ON  INTERIOR INSPECTIONS By Stff Let’s face it, our local cities are facing hard times. Their expenses are continually going up and their funding is not necessarily going up. They could raise “taxes”, but they may not be elected to the city council next time up. So they are getting creative. These same officials are facing aging housing stock where the homes and apartments need to be repaired and updated, maintained and even replaced as time goes on. And while home owner work hard to maintain what they own, there are some who do not have the time, money or ability to maintain their homes. Some just don’t care and also do nothing. In an effort to make sure the housing in their city is safe, they have long 1 0 | M A R E I . O R G This past year in 2015 in a precedent- setting win for personal freedom and tenants, the U.S. District Court for the Southern District of Ohio in the Baker v. the City of Portsmouth, the court rules that “the Portsmouth [Ohio Rental Dwelling Code] violates the Fourth Amendment insofar as it authorizes warrantless administrative inspections. It is undisputed that the RDC affords no warrant procedure or other mechanism for pre-compliance review. As in the above cases, the owners and/or tenants of rental properties in Portsmouth are thus faced with the choice of consenting to the warrantless inspection or had rules and regulations on the books that require inspections to make sure the building is up to code and meet city codes rules and regulations. But now with the aging stock and the need for more funds, more and more cities are creating new rules and regulations that require the at least the landlord property owners to get a license of some sort, generating income. And in an effort to keep properties maintained, they are creating new inspection rules to go along with those licensing requirements. All well and good, except for something called the Fourth Amendment to the Constitution that prohibits warrantless inspections of homes without the occupant’s consent.
  • 11. landlords. They will then choose to go out of business or pass the expense on to the tenant resident. However, the slum lord, which the cities concede is a miniscule portion of all landlords, well, we are pretty sure that they don’t care about their properties, their tenants or even the rules and why would even more rules make them do anything different. So what can we as landlords, investors and property owners in Missouri do? We highly encourage you to be part of some or several organizations who monitor what is going on and respond as best they can. First join MAREI and be sure to subscribe to our email newsletters and / or follow MAREI on social media. Next, join the Landlord organization(s) in the cities where you hold rentals. We list many of them on the MAREI calendar to help you find one near you.. As each and every city is going to have a different set of rules and regulations, your local landlord group is going to be your best first line of defense. In Kansas most landlord groups are already a part of their state Organization The Associated Landlords of Kansas. In Missouri, there is no state Organization. It takes coordinated effort to show the general public, that 99.9% of all Landlords are good people, with great properties, who take care of their tenants. The public only sees that 0.1% of the bad landlords as bad press sells generates more viewers that the cute feel good stories. 3)Localgovernmentmaycontinuetodo inspectionswhenbuildingpermitsare required. 4)ThelawreservestherightofaTenantto requestaninteriorinspectionfromthelocal government,asalreadydefinedintheKansas Landlord-TenantLaw(58-2572). TALKLobbyistEdJaskiniaworkedveryhard onthisbillforalmostayear,fightingoff multitudesofattacks.Heaskedforand receivedmuchcooperationandsupport fromtheRealtorLobbyistandmanyothers, withoutwhomthislegislationmightnothave passed. EffectiveJuly1,2016,thisnewlawisagiant stepforwardinpreservingtherightsofboth propertyandprivacyforthecitizensof Kansas. Manycitiesarestilldoinginteriorinspections onrentalswhentheyarevacantbetween tenantsorwhentheyareabletoobtainand administrativewarrant,sowewillneedto watchandseehowcitiesacrossKansasdeal withthisaspect. MostrecentlythecityofIndependence Missourivotedtoamendcitycodetoadd interiorinspectionseverytwoyearsonrental property. Togetaroundthe4thamendment issue,thecityhasdecidedtheywillnotdothe inspection,butratherprovidethelistof qualifiedinspectorsandrequirethelandlord toorderandpayfortheirowninspections. ThelandlordsinIndependencecollected signaturesinattempttogettheordinance puttothevotebutwereun-successful. So,whereisthisallgoing? Nextupwouldbeforother’s totakesuitagainsttheirowncitiestogetsimilar rulings. InanothercaseinColoradowherearental inspectionprogramwasstartedtocutdownon slumlordsandmakesureeveryresidenthasa habitableplacetolive,atenantendedupincourt forrefusingtoallowinspectorsintohishome. In thatcasethecitymanagerorderedastayon interiorrentalinspectionsonsinglefamily homesuntiltheycouldberemovedfromtheir inspectionprogram. Althoughtheyarestill maintainingtheinspectionrulesformultifamily. Meanwhile,citiesinKansasandMissourikeep creatingnewinteriorinspectionlawsfortheir cities. IntheStateofKansas,TheAssociatedLandlords ofKansasandtheirPresidentEdJaskiniawas successfulingettingHB@665thatwas eventuallycombinedwithSB366andseveral otherbillspassedandsignedintoKansasLawon May17,2016. ThisnewKansasLawsays four importantthings: 1)Noresidentialrentallicensingprogram operatedbycityorcountygovernmentsmaydo anINTERIORinspectionwithouttheconsentof thelawfuloccupant.Theymustask,andthe Tenant mustagree,ortheinspectionisnot allowedtohappen.Thereisanexceptiontothis lawformixedusebuildings,suchasabuilding withbothcommercialandresidentialTenants. 2)ThislawdoesNOTmakeanychangestothe LandlordsrighttoenterasdefinedintheKansas Landlord-TenantLaw(58-2557).
