FAR 18.202 Defense or Recovery From Certain Events.
It automatically triggered elevation of procurement thresholds for certain
acquisitions:
• Micro-Purchase Threshold (MPT)
• Simplified Acquisition Threshold (SAT)
• Definition of commercial items
• Using Simplified Acquisition Procedures (SAP) for commercial items/services
threshold

FAR 18.202(b)
Simplified Acquisition Threshold
The threshold increases when the head of the agency determines
the supplies or services are to be used to
facilitate defense against or recovery from cyber, nuclear, biological, chemical,
or radiological attack; to facilitate provision of international disaster assistance;
or to support response to an emergency or major disaster.
(See 2.101.)

How to Interpret, How to Comply?
• Determine if authority has been delegated
• FAR Convention 1.108(b) and FAR 1.102-4(b) apply, Delegation of Authority.
• DoD Class Deviation has delegated this authority to HCA
(Head of Contracting Activity) level
• Document the procurement is to support… Covid 19 efforts, etc.

FAR 18.203
Emergency Declaration or Major Disaster Declaration
• Allows for local area set-asides
• Allows geographical proximity as an evaluation factor
• May waive preference for U.S. Flag Vessels

Humanitarian or Peacekeeping Operation

Available Acquisition Flexibilities
18.101 General.
The FAR includes many acquisition flexibilities that are available to the
contracting officer when certain conditions are met. These acquisition
flexibilities do not require an emergency declaration or designation of
contingency operation.

• FAR 4.1102(a) lists seven (7) exceptions for a contractor to be registered in

• Six of these are standard, but 4.1102(a)(3) requires a declared contingency or
emergency in order to use.
