PROGRAMME TO RAISE AWARENESS ABOUT FEMALE GENITAL MUTILATION/CUTTING

1. Preventive Undertaking

Hereby certifies that the health examinations carried out to date on the girl(s) whose details are
stated below have not shown any alterations in the integrity of her/their genital organs.

The girl’s/girls’ family / guardians are therefore informed about the following
circumstances:
1. The social, healthcare and psychological risks of genital mutilation and international
recognition of this practice as a violation of girls’ Human Rights.
2. The legal framework of female genital mutilation in Spain, where this intervention is
considered grievous bodily harm in accordance with Article 149.2 of the Criminal Code,
even if it is committed outside national territory (for example, in Gambia, Mali, Senegal, etc.),
in the terms envisaged in Organic Law on the Judiciary, which was amended by Organic Law
1/2014, of 13 March.
3. The practice of genital mutilation is punishable with a 6 to 12 year prison sentence for parents,
guardians or carers and with disqualification from exercising parental rights, guardianship,
custody or foster care for 4 to 10 years (i.e. the parents would lose their parental rights and
custody of their daughter. These would be passed on to the corresponding social services and
the girl may be placed in foster care or in a children’s home).
4. The undertaking to bring the girl back to see the paediatrician/doctor at her Health Centre
after returning from the journey in order to undergo a health examination within the context
of the Child Health Programme.
5. The importance of taking all the preventive measures recommended by Health Service
professionals in relation to the journey.
I therefore:
- DECLARE that I have been informed by the healthcare professional responsible for the
girl’s/girls’ health about the aforementioned aspects relating to female genital mutilation.
- CONSIDER that I have understood the purpose, scope and legal consequences of these
explanations.
- UNDERTAKE to safeguard the health of the minor(s) under my charge and to protect her/them
from genital mutilation and bring her to a check-up after returning from the journey.
As evidence of which I read and sign the original of this informed commitment in duplicate,
of which I receive a copy.
