1. Privatization, and Rehabilitation, of Private Prisons

In light of the economic struggles that many states are facing today, every area of the criminal
justice system is coming under scrutiny, especially as it relates to the expenditures of taxpayer
monies. One of the most hotly contested areas is that of the privatization of prisons. Respond to
the following questions, and support your position using credible research:
What are some of the advantages and disadvantages of prison privatization?
Explain in your own words.
The advantages are fewer than the disadvantages. Correction corps would love fr people
to believe there is a need for privatization prisons under the belief there is a need with
over crowding. The facts are that since 9/11 immigration laws were changed and many
fell into this new law, and were incarcerated by private prisons. (Magee,2015)
Ideal of the advantages were:
To un-crowd already crowded facilities
Was to be more cost affective and cheaper that government run facilities
More jobs.
The reality of the disadvantages
:
They actually cost more
Loss of jobs in state facilities
Lock up were not criminal charges but also for immigration charges, mentally ill,
substance abuse.
The state facilities were protected by Union where private ones made their own rules and
Unions were not allowed.
What impact does the privatization of prisons have on providing rehabilitative
services that would help prisoners rejoin society productively and curb recidivism?
Explain.
2. Private prisons would not have rehab services, because the more that comes in the more
they could make. The ideal was to make harsher and longer sentences because it would
produce more income for the private sector. (Magee, 2015) This is why there is a
movement by the National Prison Divestment campaign, a group of religious groups,
immigration rights, and criminal justice groups, campaign to try and get donators to stop
donating money to private prisons. (Friedmann, 2012)
What impact does contracting with a private firm have on governmental liability for
the violation of inmates' constitutional rights? Explain.
How prisoners are treated makes a difference. Private prisons are not held accountable as
much as state owned. Two cases are
Biven v. six unknown federal narcotics agents # 301, 403 U.S. 388 (1971)
Pollard v. GEO Group Inc. # 07-16112, 2010 US
Inmates must be treated properly, they still have constitutional rights. They deserve
proper medical treatment and while public run prisons this can be checked on, private
ones can hide certain things. Many cases prisoners are locked up and forgotten, especially
if families do not maintain contact. (Farber, 2010)
Some would argue that for-profit private prisons have no place in a democratic
society. Do you agree? Use external research to justify your response.
I do not believe for profit prisons have a place in the democratic society. They use bribes
to gain favor from law makers, government officials, and other prominent officials. I do
not believe any money should be made on another person’s pain, or illness. Inmates could
be in for very small incidents, mental illnesses, or addictions. There is no program to help
any inmates to have a reason to further themselves as it should be. The idea is to punish
but also to correct behaviors to try and reenter inmates back into society, to be productive
citizens.
