• Directors can come to our attention in a number of ways
• Initial assessment undertaken by the Ministry’s Registries Integrity and Enforcement Team
• Further information sought from liquidators or receivers
• If information supports a case, a senior solicitor reviews the case
• If there’s a case to answer, the director is served with a notice under the Act, with a summary
of the alleged mismanagement
• The director has 20 days to make representations to the Registrar
• All relevant material referred to the ‘external’ Deputy Registrar for a decision
• When the final decision is made, a minute of decision is issued
• The director is advised that either:
• he/she will not be disqualified; or
• a notice of prohibition is served.
