LEGAL BASIS
   Republic Act No. 7796 (TESDA Act of
    1994)

   TESDA Board Resolution No. 98-03
    dated January 23, 1998
What is UTPRAS?
   UTPRAS is a two-stage process of quality
    assurance namely:

1. Mandatory registration of TVET programs
  / courses

2. Voluntary accreditation of institutions
  (currently this is with the Asia Pacific
  Accreditation and Certification
  Commission)
PROGRAM REGISTRATION
   Registration of all Technical-Vocational
    Education and Training programs
    offered by both public and private TVIs
    under TESDA

    (Mandated under Section 8 of R.A. 7796 and
    TESDA Board Resolution 98-03 as reiterated by
    TESDA Circular No. 45 series of 2007)

NTR PROGRAMS REGISTRATION
   Requirements for the NTR programs registration:

    1. Must lead toward employment
       opportunities;
    2. Must satisfy any of the following
       conditions:
       i. The manpower requirement of critical emerging
          industry or specific area requirements
      ii. The industry with high employment potentials
     iii. The employment commitment from enterprises
     iv. The regulatory and licensing requirements for the
          practice of an occupation/profession

                                          recommends issuance of CoPR or Letter of
                                          Denial;
                                          5. RO prepares CoPR or Letter of Denial
                                          6. Regional Director signs CoPR or Letter
                                          of Denial
                                          7. RO releases CoPR or Letter of Denial to
                                          PO/DO, then PO/DO releases CoPR or
                                          Letter of Denial to the TVI
                                          8. Release of CoPR shall be done within
                                          one (1) week after receipt of
                                          recommendation from PO/DO

COMPLIANCE AUDIT
 Compliance Audit is a tool for the independent
  examination of whether a TVET institution is
  continuously complying with TESDA’s
  requirements for registered TVET program in
  all regional, provincial and district offices.
 Newly registered land-based programs are
  subjected to compliance audit a year after the
  issuance of CoPR. Thereafter, the programs
  are subjected to compliance audit once every
  (2) two years.
COMPLIANCE AUDIT
 The RO submits to TSDO the list of programs
  to be audited every first quarter of the year
 The sea-based program are subjected to
  compliance audit every first quarter of the year
 Unscheduled compliance audit may be
  conducted due to:
  1. customer complaints and
  2. recurring quality problems
SANCTIONS AND PENALTIES
a.Grounds for imposing sanctions and
  penalties:
 Unauthorized offering of an unregistered
  TVET programs;
 Advertisement of an unregistered programs
 Discovery of fraud or deceit in connection
  with the application for program registration
SANCTIONS AND PENALTIES
b. Sanction/Penalties to be imposed:

 Criminal liability
 A fine of not less than P 2,000.00 no more than P
  10,000.00 or
 Imprisonment for a maximum of 2 years or both at the
  discretion of the court (if the corporation commits the act,
  the school head together with the person/s responsible for
  the offense shall equally be liable.
 Sanctions against the school shall be without prejudice to
  the right of the aggrieved students, teachers and
  employees to after the erring officials and TVIs.
GROUNDS FOR PROGRAM CLOSURE
AND REVOCATION OF CoPR
   Failure of the TVI to comply with the non-
    compliance/deficiencies within a prescribed period
    as found in the compliance audit.
   Failure of the TVI to re-register/migrate program
    within a prescribed period
   Employment rates of the graduates of an NTR
    program is lower than the national average for 3
    consecutive batches.
   Mismanagement or gross inefficiency of the school
    personnel in the operation of the school and its
    program offering;
   Fraud, falsification, misrepresentation, or any
    similar acts of the TVI.

TESDA UTPRAS Program Registration Process

  • 3. What is UTPRAS?  UTPRAS is a two-stage process of quality assurance namely: 1. Mandatory registration of TVET programs / courses 2. Voluntary accreditation of institutions (currently this is with the Asia Pacific Accreditation and Certification Commission)
  • 4. PROGRAM REGISTRATION  Registration of all Technical-Vocational Education and Training programs offered by both public and private TVIs under TESDA (Mandated under Section 8 of R.A. 7796 and TESDA Board Resolution 98-03 as reiterated by TESDA Circular No. 45 series of 2007)

  • 15. NTR PROGRAMS REGISTRATION  Requirements for the NTR programs registration: 1. Must lead toward employment opportunities; 2. Must satisfy any of the following conditions: i. The manpower requirement of critical emerging industry or specific area requirements ii. The industry with high employment potentials iii. The employment commitment from enterprises iv. The regulatory and licensing requirements for the practice of an occupation/profession
  • 16. PROGRAM REGISTRATION FLOWCHART a. Review Application Document 1. TVI representative inquires about program registration procedures Reviews PO/DO UTPRAS 2. PO/DO focal person conducts briefing to Application Focal Documents the applicant TVI 3. TVI submits required documents to the PO/DO 4. PO/DO UTPRAS focal person receives documents UTPRAS Inspection Conducts Site 5. PO/DO focal person assesses / Team Inspection evaluates submitted documents; 6. Assesses curriculum against competency-based training (CBT) definition 7. Focal person recommends to the PO/DO Prepares result UTPRAS Inspection the conduct of ocular inspection if the of Site Team Inspection documents are in order 8. Review of application document shall be conducted not more than 15 working days.

PO/DO UTPRAS focal person sends official notice to TVI duly signed by the PO/DO Director for compliance of deficiencies if any, schedules and conducts re-inspection if required; UTPRAS Inspection Prepares 2. PO/DO UTPRAS focal person Team results of Site prepares final inspection Inspection report/recommendation and submits to PO/DO Director 3. PO/DO Director submits recommendation to the RD for issuance of Letter of Denial or CoPR 4. Compliance with registration requirement deficiencies shall be done by the TVI not more than 30 days.
  • 19. PROGRAM REGISTRATION FLOWCHART d. Issue Certificate of Program Registration / Letter of Denial 1. RO UTPRAS Focal conducts final review of documents, returns documents if there Issues CoPR / are deficiencies; Regional Director Letter of Denial 2. PO/DO UTPRAS focal returns documents to institution and outlines the corrective actions needed; 3. Institution comply with the deficiencies within one (1) week; 4. PO/DO prepares memorandum to RO based on the corrective actions taken then recommends issuance of CoPR or Letter of Denial; 5. RO prepares CoPR or Letter of Denial 6. Regional Director signs CoPR or Letter of Denial 7. RO releases CoPR or Letter of Denial to PO/DO, then PO/DO releases CoPR or Letter of Denial to the TVI 8. Release of CoPR shall be done within one (1) week after receipt of recommendation from PO/DO

COMPLIANCE AUDIT  Compliance Audit is a tool for the independent examination of whether a TVET institution is continuously complying with TESDA’s requirements for registered TVET program in all regional, provincial and district offices.  Newly registered land-based programs are subjected to compliance audit a year after the issuance of CoPR. Thereafter, the programs are subjected to compliance audit once every (2) two years.

COMPLIANCE AUDIT  The RO submits to TSDO the list of programs to be audited every first quarter of the year  The sea-based program are subjected to compliance audit every first quarter of the year  Unscheduled compliance audit may be conducted due to: 1. customer complaints and 2. recurring quality problems
  • 23. SANCTIONS AND PENALTIES a.Grounds for imposing sanctions and penalties:  Unauthorized offering of an unregistered TVET programs;  Advertisement of an unregistered programs  Discovery of fraud or deceit in connection with the application for program registration
  • 24. SANCTIONS AND PENALTIES b. Sanction/Penalties to be imposed:  Criminal liability  A fine of not less than P 2,000.00 no more than P 10,000.00 or  Imprisonment for a maximum of 2 years or both at the discretion of the court (if the corporation commits the act, the school head together with the person/s responsible for the offense shall equally be liable.  Sanctions against the school shall be without prejudice to the right of the aggrieved students, teachers and employees to after the erring officials and TVIs.

GROUNDS FOR PROGRAM CLOSURE AND REVOCATION OF CoPR  Failure of the TVI to comply with the non- compliance/deficiencies within a prescribed period as found in the compliance audit.  Failure of the TVI to re-register/migrate program within a prescribed period  Employment rates of the graduates of an NTR program is lower than the national average for 3 consecutive batches.  Mismanagement or gross inefficiency of the school personnel in the operation of the school and its program offering;  Fraud, falsification, misrepresentation, or any similar acts of the TVI.

Editor's Notes

  1. (Greetings) I am ____________________________ of _____________________. I am tasked to give you a brief orientation on the Unified TVET Program Registration and Accreditation System or what we call the UTPRAS.
  2. Before we proceed to the main presentation of UTPRAS, Let us identify first the legal basis of the UTPRAS, why it is being implemented Republic Act No. 7796 (TESDA Act of 1994) empowers TESDA to establish and maintain a system of accrediting, coordinating, integrating, monitoring and evaluating formal and non-formal TVET Programs. Further, it was supported by a TESDA Board Resolution No. 98-03 dated January 23, 1998, which promulgated the establishment of the Unified TVET Program Registration and Accreditation System. The adoption of the UTPRAS is to ensure the quality of TVET Programs offered to the public.
  3. UTPRAS is a two stage process of quality assurance namely: The mandatory registration of TVET programs/courses with TESDA and the monitoring for continuous compliance with the prescribed minimum requirements; and 2. The voluntary accreditation of institutions which deals with the institutionalization of quality management systems at the institutional level.
  4. Section 8 of R.A. 7796 and TESDA Board Resolution 98-03 as reiterated by TESDA Circular No. 45 series 2007 mandates all technical-vocational programs being offered to the public to be registered under TESDA. Program Registration prescribes full compliance with the minimum requirements prescribed in the Training Regulations and anchored on the competency-based system.
  5. General Principles The registration process shall be institutionalized in all Regional/Provincial/District Offices; All TVET programs shall be registered either With Training Regulations (WTR) or No Training Regulations (NTR); Programs shall be registered by qualification or by cluster of competencies; For some sectors where related qualifications have existing Training Regulations (e.g. Tourism Industry and Information and Communication Technology), program registration still has to be made by qualification. However, the TVIs shall be given the option to bundle such qualifications into multi-qualification programs to produce multi-skilled graduates; The nominal duration indicated in the Training Regulations (TR) shall be the minimum number of hours for a TVET program;
  6. Registration of Mobile Training Classrooms – Park and Train Programs (MBC-PTP) shall only be allowed for WTR programs or defined cluster of competencies; Detailed implementing rules/guidelines is found in TESDA Circular No. 27, series of 2009 f. Principles of full disclosure in the submission of documentary requirements: - the units of competency and targeted learning outcomes; - the manner by which the competencies are to be achieved; - the institutional assessment process; and - the range of jobs for the acquired competencies may apply
  7. Registration of e-Learning programs shall be allowed and shall follow the existing guidelines for program registration and the provider must have an office located in the Philippines, details of the guidelines in covered under TESDA Circular No. 37 series of 2009. An Institution with registered TVET programs shall be eligible for institutional accreditation. An institution with registered program under a promulgated TR may be accredited as an Assessment Center or Assessment Venue provided the requirements and processes of accreditation are complied with. Special Order Numbers shall be issued by the POs/DOs to graduates of all registered TVET programs whether WTR or NTR and whether full qualification or in cluster of competencies (in privately owned institutions) The title of a program for WTR registration shall follow the title of the appropriate Training Regulations
  8. The UTPRAS is primarily intended to promote public interest and welfare by ensuring the quality of all TVET programs. The registration system is anchored on the competency-based system wherein TVET programs adopt the qualification titles being prepared for and the competency or set of competencies that are to be acquired; The registration system prescribes compliance with minimum standards provided for in the TRs promulgated by the TESDA Board.
  9. The following are the requirements in registering TVET programs under UTPRAS: The letter of application specifying the intent to offer TVET program(s) Board Resolution to offer TVET program(s). This should be signed by the Board Secretary and attested by the Chairperson (SUCs, LCUs and private institutions). If the institution is created under Special Law (for public institutions) they must specify and attach a copy of the law, either by virtue of the Republic Act or an Executive Order, etc. It must be duly registered with the Security and Exchange Commission (SEC) and must specifically cover the training delivery site (for private institution only). The Articles of Incorporation must specifically state the offering of TVET programs in the primary purpose(s). Proof or Certificate of Building Ownership or contract of lease which covers at least 2 years Proof of current/updated Fire Safety Certificate In case the institution may wish to branch out, the Articles of Incorporation and By-laws must state reasons for opening a branch. The Board Resolution signed by the majority of the incorporators must be notarized, received and noted by the SEC.
  10. The curriculum and the program delivery should be competency-based The equipment, tools, and consumables needed to deliver the program must be listed and submitted using the prescribed forms. The Instructional materials (reference materials, slides, videotapes, interned access and library resources) needed to deliver the program must be specified using the prescribed form. The location and list of Physical Facilities and Off-Campus Physical Facilities specifying the floor area.
  11. The listing of school officials and personnel should be attached including their individual resume, while the teaching personnel with their qualifications, areas of expertise and courses/seminars attended including the NC certificate required should be attached.
  12. The applicant TVI shall also submit the schedule and breakdown of tuition fees and other fees duly signed by the school head indicating the school year of effectivity. The documented grading system shall also be submitted, details of which should be known by all students/trainees at the start of the program. The entry requirements for the program should comply with the relevant training regulations whenever applicable. The rules on attendance should be submitted and shall form part of the documentary requirements in the registration of the program.
  13. Support Services The school should also provide health services to the students/trainees, if these services are contracted out or outsourced, these should be covered by a contract or a MOA or other similar documents of understanding must also be submitted. There should be career guidance services made available to the students/trainees in the school. Community outreach program (optional but documented evidences should be available) Research (optional) that supports the operation of the school is carried out (e.g. surveys, consultations, FGD, etc.)
  14. In case the school wishes to register additional program(s) the following shall be submitted Numbers 1 to 8.
