3. Penalty for illegal Strike
Section 26(1) of the Industrial Dispute Act, 1947 provides
penalties for illegal Strikes
If any workmen acts or does any act in furtherance of a
strike which is illegal such act is punishable with,
Imprisonment – may extend up to One month
or
Fine – up to Fifty rupees
or
both
4. Penalty for illegal Lockout
Section 26(2) of the Industrial Dispute Act, 1947 provides
penalties for illegal Lockout
If any employer acts or does any act in furtherance of a
strike which is illegal such act is punishable with,
Imprisonment – may extend up to One month
or
Fine – up to One thousand rupees
or
both
5. Penalty for instigation
Sec.27 provides penalty for instigation
According to Sec.27 if any person instigates, promotes or
does any act in furtherance of a strike or lock-outs which is
illegal, such offence shall be punishable with,
Imprisonment – for term up to six months
or
Fine – up to one thousand rupees
or
both
6. Penalty for providing financial aid
for illegal strikes and lockouts
If any person provides financial aid in furtherance or
knowingly support any illegal strike or lockout shall be an
offence punishable under Sec. 28 of the Act ,
Imprisonment – for term up to six months
or
Fine – up to one thousand rupees
or
With both
