Well on Instagram it can!
If Instagram sells any part of their assets
to another organisation, they transfer all
information collected through the service
to the new owner (Instagram, 2013).

Privacy Policy to highlight this new

32. The updated terms of service claimed the right to license all
public Instagram photos to companies, effectively transforming
the website into the world's largest photo stock agency
(McCullagh, 2012).

33. Instagram users
were NOT happy!
In late December 2012, Instagram backtracked with CEO Kevin
Systrom announcing that the privacy terms would revert to the
version in place since the service launched in 2010 and “remove”
the language that caused a user revolt (Savides, 2012).
