2. There are a number of changes in employment law
coming into force as of the 6th April 2014 which will
affect your business so make sure that you and your
policies are up-to-date to avoid mistakes.
3. • Section 7(1) of the Enterprise & Regulatory Reform Act 2013:
It requires potential claimants to lodge specified details with
Acas prior to issuing an employment tribunal claim.
The requirement to contact Acas commences on 6 May
2014, but the prohibition on issuing proceedings without an
early conciliation certificate may apply from 6 April 2014 if a
prospective claimant contacts Acas in the prescribed manner in
the period beginning 6 April 2014 & ending on 5 May 2014, &
presents a tribunal claim on or before 5 May 2014.
The Changes

• Section 66 of the Enterprise & Regulatory Reform Act 2013:
This repeals s.138 of the Equality Act 2010, which sets out the
procedure that enables an individual to obtain information
from the employer about discrimination & provides for the
information to be used as evidence in tribunal
proceedings, otherwise known as the discrimination
questionnaire procedure.
5. • Section 16 of the Enterprise and Regulatory Reform Act 2013:
This gives tribunals the power to impose a financial penalty
against employers that have breached a worker’s employment
rights where the breach has one or more aggravating features.
In most cases, if the tribunal makes an award of
compensation, the amount of the penalty will be 50% of the
award.
6. • The Weekly Rate of Payment for Statutory Maternity, Paternity
& Adoption Pay:
Increases to £138.18. The weekly lower earnings limit for national
insurance contributions increases to £111.
• The Weekly Standard Rate of Statutory Sick Pay:
Increases to £87.55. The lower earnings limit for National
Insurance contributions increases to £111. Also from 6 April
2014, the Statutory Sick Pay Percentage Threshold
(Revocations, Transitional & Saving Provisions) (Great Britain &
Northern Ireland) Order 2014 revokes the schemes that permit
employers in Great Britain & Northern Ireland to claim
reimbursement of payments of Statutory Sick Pay made to
employees.
7. • The Employment Rights (Increase of Limits) Order 2014 (SI 2014/382):
Increases the limits applying to various tribunal awards & other
amounts payable under employment legislation, including the
maximum amount of a week’s pay for the purpose of calculating a
redundancy payment & the basic and additional award of
compensation for unfair dismissal (which increases to £464) & the limit
on the amount of a guarantee payment (which increases to £25).
The maximum compensatory award for unfair dismissal increases to
£76,574.
8. • The Immigration (Employment of Adults Subject to Immigration
Control) (Maximum Penalty) (Amendment) Order 2014:
This increases the maximum civil penalty for employers to
£20,000 for each illegal worker.
