Yes, the ‘Legal stuff’ is boring. The Terms of Use Agreement is fairly straightforward however it is typical of such legal writing that it is verbose which ensures many people cannot be bothered to read it. “…Studies show privacy policies are hard to read, read infrequently, and do not support rational decision making.”  (McDonald & Cranor as cited in OUT-LAW News, 2008)
MySpace can do many things... They can change their Terms of Use Agreement at any time.  The changes take effect as soon as they are posted on the website.  All users of MySpace accept these changes by default (automatically) MySpace.com Terms of Use Agreement online at: http://www.myspace.com/index.cfm?fuseaction=misc.terms
Who can use MySpace? When registering as a new User, you must tell the truth. You must be 13yrs of age or older.  You would not be breaking any applicable Lawsby using MySpace. Section 1. MySpace can close your account. They can terminate (close) your membership at any time and for any reason or no reason at all. They do not have to give you notice or explain why. MySpace can start charging fees. They can start charging for any service they like, whenever they like. If you currently pay for any MySpace service, and your account is closed for any reason stated in their Terms, you are not entitled to a refund. Section 3. Fees. They don’t like certain content. MySpace can remove any of your content (what you post, send or display). If they deem your content is commercial and unauthorised, they may also terminate your membership or take legal action against you. e.g. advertisements, affiliate links and data collection or solicitation. Is your content really private? You can mark your content as private at any time and MySpace will ensure it will not be distributed outside MySpace. But your content may remain on display even if you have marked it as private. It is your responsibility to remove or ask others to remove your content on MySpace. If you don’t own it, don’t use it. You must own the content you intend to use on MySpace. You must not use any content on MySpace if you don’t have the legal rights or permission to use it. But, if you do own the content; you are free to copy, modify, publish, distribute, sell it etc. Section 6.5 Proprietary Rights in Content on MySpace. Illegal CONTENTis not tolerated. MySpace have given examples of CONTENTthey consider illegal or prohibited in their Terms (see relevant Section below). Their examples include content that affects User behaviour, security, rights, licenses etc. Your account may be closed and legal action taken against you for these violations. Illegal ACTIVITY is not tolerated. MySpace have given examples of ACTIVITIESthey consider illegal or prohibited in their Terms (see relevant Section below). Their examples include activities such as hacking, spam, impersonation etc. Your account may be closed and legal action taken against you for such violations. Some messages will cost you $$$ Also mentioned in Illegal Activities… section 8.18 states that unauthorised advertising or solicitationi.e. Bulk email or messaging communications,may cause MySpace harm. You agree to pay MySpace $50for each actual or intended recipient who receives unsolicited communication from you. Section 8.18 Content / Activity Prohibited. Not another Policy? If you choose to use services on MySpace such as applications, websites, desktop, wireless, mobile etc, be aware that your data may be used and shared by third parties. Each service may have their own policy so you should not expect MySpace to protect your data and privacy all the time. Section 10. Third Party Linked Services.   • 3. Yes, the ‘Legal stuff’ is boring. The Terms of Use Agreement is fairly straightforward however it is typical of such legal writing that it is verbose which ensures many people cannot be bothered to read it. “…Studies show privacy policies are hard to read, read infrequently, and do not support rational decision making.” (McDonald & Cranor as cited in OUT-LAW News, 2008)

  • 7. MySpace can start charging fees. They can start charging for any service they like, whenever they like.   • 8. They don’t like certain content. MySpace can remove any of your content (what you post, send or display). If they deem your content is commercial and unauthorised, they may also terminate your membership or take legal action against you. e.g. advertisements, affiliate links and data collection or solicitation.   • 9. Is your content really private? You can mark your content as private at any time and MySpace will ensure it will not be distributed outside MySpace. But your content may remain on display even if you have marked it as private. It is your responsibility to remove or ask others to remove your content on MySpace.   • 10. If you don’t own it, don’t use it. You must own the content you intend to use on MySpace. You must not use any content on MySpace if you don’t have the legal rights or permission to use it.   • 11. Illegal CONTENTis not tolerated. MySpace have given examples of CONTENTthey consider illegal or prohibited in their Terms (see relevant Section below). Their examples include content that affects User behaviour, security, rights, licenses etc. Your account may be closed and legal action taken against you for these violations.   • 12. Illegal ACTIVITY is not tolerated. MySpace have given examples of ACTIVITIESthey consider illegal or prohibited in their Terms (see relevant Section below). Some messages will cost you $$$ Also mentioned in Illegal Activities… section 8.18 states that unauthorised advertising or solicitationi.e. Bulk email or messaging communications,may cause MySpace harm.   • 14. Not another Policy? If you choose to use services on MySpace such as applications, websites, desktop, wireless, mobile etc, be aware that your data may be used and shared by third parties.
