Benton v. Maryland
WHO ??
   Maryland is the Plaintiff.
   Benton is the Defendant.
WHAT ??
   He was tried in a Maryland state court for
    burglary and larceny.
   He was convicted of burglary & sentenced
    10 years.
   The juries had been selected under an
    invalid constitutional provision, which
    remanded the case
   He got charged again with the same case
    which is called “Double Jeopardy”.
WHEN ??
   Argued in December 12, 1968
   Reargued in March 24, 1969
   Decided in June 23, 1969
WHERE??
   The case took place in a Maryland
    Courthouse
WHY ??
   The Court of Maryland had made an
    mistake for charging Benton for the same
    crime twice.
WHAT ??
   On retrial, he was found guilty of both
    offenses, and concurrently sentenced to
    15 years for burglary and 5 years for
    larceny. The appellate court ruled against
    petitioner on the double jeopardy issue
    and affirmed.
   It wasn’t any other cases involved.
OUTCOME & OPINIONS !!
   Nick thinks : I think that double jeopardy is
    stupid !
   Diamond thinks : I think it was wrong for
    trying 2 charge in for the same crime
