PLAINTIFFS’ PROPOSED VERDICT SHEET*
Date: [INSERT]
IT IS NECESSARY THAT ONLY FIVE JURORS AGREE UPON ANY SINGLE
QUESTION TO DETERMINE THE ANSWER TO BE REPORTED. IT IS NOT
NECESSARY THAT THE SAME FIVE JURORS AGREE ON EACH QUESTION.
* Judges commonly favor particular styles of verdict sheets, as do defendants. Both sides have particular reasons for presenting
differing versions of a verdict sheet. The issue is important and should be attended to carefully. The above proposed verdict
sheet is an example from a specific case. Counsel must tailor each verdict sheet to fit the individual case. It is also
recommended that a disc with the proposed verdict sheet be on hand at the courtroom so that any final changes can be made
with a laptop and portable printer, or in the judge’s chambers if so requested. This will also allow the attorney’s headings and
signature block to be removed should the judge adopt the proposed verdict sheet.

Please go to the next page and answer question 6.
*
The verdict sheet must specifically allow the jury to award damages for all plaintiffs on all claims. In the above case, the
verdict sheet does not contain a line or section for the parent’s damages, as they had waived such a claim for case specific
reasons.Spousal derivative causes of action, and parental claims for loss of household services and unreimbursed medical
and other expenses and loss, as well as damages for any other claim proven up at trial, must be listed on the verdict sheet so
that the jury may award damages for them.
* *
The list of special damages on the verdict sheet will vary by case and depend on the proof at trial. For example, in this
case, the primary plaintiff was an infant. Therefore, he had suffered no lost wages up to the date of verdict and this is
reflected by the absence of such a damage line item in the verdict sheet. Consult the PJI to ensure that all possible damages
are listed on the verdict sheet.
QUESTION 6:
State separately the amount awarded for the following items of damages, if any,
from the date of your verdict to be incurred in the future for the infant plaintiff:
(a) Loss of earnings
of infant plaintiff: $__________________ per year for
______ years at _____% inflation.
(b) Supervised group home
care and supervision: $__________________ per year for
______ years at _____% inflation.
(c) Psychological counseling $__________________ per year for
______ years at _____% inflation.
(d) Speech and occupational therapy $__________________ per year for
______ years at _____% inflation.
(e) Pain and suffering, includes
loss of enjoyment of life, including
the permanent effect of the injury,
from the time of the verdict to
the time that the infant plaintiff
could be expected to live: $__________________ per year for
______ years at _____% inflation.
Total $__________________
If you decide not to make an award as to any of the above items, you will insert
the word “none” as to that item.
At least 5 of the 6 jurors must agree on the answer to this question.
