CAPITAL TAXES TREATY PROTECTION:
• UK domiciled individuals subject to UK IHT on worldwide assets. Non-UK domiciled
individuals only subject to UK IHT on UK sited assets.
• Beware - individuals tax resident in the UK for 17 out of the previous 20 tax years
are deemed to be domiciled in the UK.
• UK/India treaty planning can avoid UK IHT on overseas assets by overriding the
deemed domicile rule.
• Need to consider:
• UK deemed domicile position
• Domicile position in both UK and India
• Situs of assets, governing law and need for overseas Will
• Watch actions which might deny treaty protection, e.g. lifetime transfers, failed gifts
