5. Cos’è un «cartello»
Art. 101 TFUE

ovvero altre condizioni di transazione;

6. L’iniziativa del DoJ
Apple
Hachette
HarperCollins
Macmillan
Penguin
Simon & Schuster
7. L’iniziativa del DoJ
«Publishers saw the
rise in e-books, and
particularly
Amazon’s price
discounting, as a
substantial
challenge to their
traditional business
model»
8. L’iniziativa del DoJ
«The Publisher
Defendants (…)
conspired to raise
retail e-book prices
and to otherwise
limit competition in
the sale of e-books»
9. L’iniziativa del DoJ
«To effettuate their
conspiracy, the
Publisher
Defendants teamed
up with Defendant
Apple, which shared
the same goal of
restraining retail
price competition in
the sale of e-books»
10. L’iniziativa del DoJ
«Apple and the Publisher
Defendants reached an
agreement whereby
retail price competition
would cease (which all
the conspirators
desidered), retail e-book
prices would increase
significantly (which the
Publisher Defendants
desidered), and Apple
would be guaranteed a
30 percent ‘commission’
on each e-book it sold
(which Apple desired)»
11. L’iniziativa del DoJ
«Apple and the
Publisher
Defendants (…)
agreed jointly to
replace the
wholesale model for
selling e-books with
an ‘agency model’ »
12. L’iniziativa del DoJ
«After executing the
Apple Agency
Agreements, the
Publisher
Defendants all then
quickly acted to
complete the
scheme by imposing
agency agreements
on all their other
retailers »
18. La posizione di Apple
The DOJ’s accusation of collusion against Apple is
simply not true. The launch of the iBookstore in 2010
fostered innovation and competition, breaking
Amazon’s monopolistic grip on the publishing
industry. Since then customers have benefited from
eBooks that are more interactive and engaging. Just
as we’ve allowed developers to set prices on the App
Store, publishers set prices on the iBookstore
