2. My case : case no 6
– Mr. Nathan, an elderly male patient hospitalized for prostatic surgery, woke up in the
middle of the night, dressed himself, and attempted to leave the nursing unit. An RN
approached him to ask him where he was going and tried to detain him. He shoved
the woman into a wall and she struck her head, sustaining a concussion. The unit clerk
called for help. The patient ran toward the exit and was stopped by two male
orderlies and a security guard. As they took him by the arms, he screamed, “I'm being
held prisoner! I have the right to leave!” A physician wrote restraining orders to be
checked in an hour, and the patient was given an intramuscular sedative. Mr. Nathan
sustained some bruises and abrasions in the struggle. The nurse was taken to the ER
and was out of work for two weeks. The patient is now suing the hospital for false
imprisonment and aggravated assault. As the director of the hospital, what do you
do?
3. INTRODUCTION
– An elderly male patient , Mr. Nathan was hospitalized for prostatic surgery
. He woke up late at night got himself dressed and attempted to leave the
hospital . A nurse questioned him and tried to not let him escape from the
hospital. Patient threw her to the wall in which she got head injury and was on
medical leave for 2 weeks .
– He was stopped by 2 male orderlies and security guard . when he said that “I m
being held prisoner ! I have the right to leave !”
– A physician gave him I m sedative. After creating such an antisocial behavior Mr.
Nathan (patient) is now suing the hospital for false imprisonment and assault.
4. My role as the director of the hospital
– As the director of the hospital I will gather all
the evidences of that night and talk to all the
people present at that time for a detailed
information about the nights encounter .and
previous behavior of patient with hospital staff
and other patients.
5. Evidences and testimonies:
– I would bring into notice the admission agreement
signed by the patient himself or by his legal
guardians/relatives at the time of hospitalization
which clearly states that patient cant go anywhere
without the consent of his treating doctor.
– All the eye witnesses of the case and camera
footage of that night.
6. Major problems and secondary issues:
– Patient is hospitalized for prostatic surgery and as we know
prostatic diseases make patient aggressive and violent so
whatever he did was under the influence of his faulty hormones
and disease he was suffering from .
– Hospital should have sued the patient instead for attacking a
female nurse and injuring her head but we did not do so keeping
in mind his physical state.
– But this doesnot mean that hospital is guilty as the consent form
signed up for the patient makes it a one sided case for the
hospital to win the case.
7. Organizational strengths and weakness
– my hospital is capable of suing the patient instead for disturbing
the peaceful environment of hospital and injuring female nurse.
As she was just doing her job when he hit her into the wall
– The only weakness in this case can just be the physical and
mental state of patient which we already know is due to
influence of his faulty hormones which made him that aggressive
.
– So the topic of imprisonment is baseless and false.
8. My main motive as a director of hospital
– I have full responsibility to protect my hospital
from any legal actions and protect my staff at
any cost.
9. Conclusion:
Hospital will win the case for sure under any
circumstances which indicates that if Mr. Nathan goes for
the hearing session of this case in court he will have to
pay compensation instead which will be a great penalty
for him . So its better for him to understand the situation
and seek psychiatric help and pay attention to his medical
issues rather than creating trouble for himself .
