Debt Consolidation

There are many ways to consolidate your debts. In most cases you can
consolidate your debts or outgoings into one lower affordable monthly
payment.We offer the following three products to assist over-indebted
consumers:
1. Debt review [frequently referred to as 'debt counselling']
2. Voluntary distributions
3. Sequestrations


Debt Management Team

The Company is a registered close corporation with registration number
2008/148827/23. We are also registered with the National Credit
Regulator under registration number NCRDC592.
There are two members of the company, namely Julie Duminy and Kim
Armfield.Julie Duminy is the head of Client Liaison. Julie was a Micro-
Finance Agent with the Land Bank for a number of years and also held
workshops to train and eductate people in budgeting and saving.


Debt Counselling (Debt Review)
Debt counselling [debt review] is a form of debt consolidation in that
one payment is made for all creditors, but it is not a loan. It is a
process that has been created by the National Credit Act of 1995
and the process entails the following:
1. A Consumer who is struggling to maintain all his monthly payments
will apply to a Debt Counsellor on a prescribed form.
2. Once the Consumer applies for debt review, the Debt Counsellor
must inform all the Creditors of this by means of a form called a
Form 17.1.

Debt Review (Debt Counselling)
3. Once the Creditor receives the Form 17.1 the Creditor may not
proceed against the Consumer.
4. The Debt Counsellor will assess the Consumers application and
determine whether or not the Consumer is over-indebted. Generally
speaking, a Consumer is over-indebted if the amount that he has
left,after deducting his expenses from his nett income, is insufficient to
cover all the required monthly payments of creditors.
5. If the Debt Counsellor determines that the Consumer is over-
indebted,he notifies all Creditors of this by sending them a form called
a Form17.2.

What is voluntary distribution?
Voluntary distribution has been around long before debt review and it is
traditionally an assistance by an attorneys firm to help draft and make
offers to creditors on behalf of the consumer.
In other words, the attorney becomes the agent or mouthpiece of the
consumer in negotiations with creditors.

How does voluntary distribution work?

The consumer completes an assessment or application form and then we
look at the budget to see if it is reasonable and if not, we will discuss
ways of changing the budget. We then deduct the consumers reasonable
monthly expenses from the consumers nett income to arrive at an amount
that we can work with.

We then take the distribution amount and divide it amongst the creditors,
in other words a payment proposal is drawn up and then sent to the
creditors for their response.

Sequestrations

This is the most drastic debt-relief measure and is suitable for those
consumers whose assets exceed their liabilities. It is a formal process
which involves a court application in which it must be shown that the
consumer has sufficient assets which can be realized and in order to pay
creditors at least 20c/R.
Although it is a drastic measure, it is a remedy which clears the debt of a
consumer without the actual balances due to the creditors being paid.
The consumer may thereafter and within a reasonable time period apply
to be rehabilitated in order to re-enter the economic market.
