Unsightly gaps have appeared in the conservation area as a result of demolition far in
advance of redevelopment. Therefore on granting planning permission for demolition of a
building in the conservation area, a condition under section 22 (3) Town And Country
Planning Act shall be imposed that demolition shall not take place until :
(i)    planning permission, building plan and commencement of works for those works
       have been granted; and
(ii)   a contract for carrying out of works of redevelopment has been made.

5.3       LISTED BUILDINGS

Listed buildings located within the conservation areas are buildings that have intrinsic
architectural and heritage interest and are classified into two different categories, such as
Category I and Category II.

For a Category I building, only restoration work is allowed to reinstate back its original
character and maintaining its original fabric using similar construction method and
materials. New construction method will be allowed for the purpose of re-strengthen its
original building structure without disturbing or modifying its original structure or
removing any of its original fabric.

While for Category II building, internal alteration and extension at rear and side is
allowed for adaptive-reuse and new extension should complement and enhance the
quality of existing building in terms of setting, mass, height, design, scale, material use
and architectural element.

The existing with its original character and building profile should be retained and
restored to its original condition. Replacing the existing materials should have similar
profile, design, colour and texture or equivalent.

Beside these heritage buildings in the gazette conservation areas, there are other
recognized heritage buildings located outside this area that have been identified in the
development document of Structure Plan and Local Plan, such as areas or streets of;

Precinct area are shown in *Figure 1, 2 & 3. The list of heritage buildings located outside
the gazette conservation areas are listed in *Annexure C.

Extracted from Guidelines For Conservation Areas & Heritage Buildings Municipal Council of Penang Island Page 12-14 Unsightly gaps have appeared in the conservation area as a result of demolition far in advance of redevelopment. Therefore on granting planning permission for demolition of a building in the conservation area, a condition under section 22 (3) Town And Country Planning Act shall be imposed that demolition shall not take place until : (i) planning permission, building plan and commencement of works for those works have been granted; and (ii) a contract for carrying out of works of redevelopment has been made. 5.3 LISTED BUILDINGS Listed buildings located within the conservation areas are buildings that have intrinsic architectural and heritage interest and are classified into two different categories, such as Category I and Category II. For a Category I building, only restoration work is allowed to reinstate back its original character and maintaining its original fabric using similar construction method and materials. New construction method will be allowed for the purpose of re-strengthen its original building structure without disturbing or modifying its original structure or removing any of its original fabric. While for Category II building, internal alteration and extension at rear and side is allowed for adaptive-reuse and new extension should complement and enhance the quality of existing building in terms of setting, mass, height, design, scale, material use and architectural element. The existing with its original character and building profile should be retained and restored to its original condition. Replacing the existing materials should have similar profile, design, colour and texture or equivalent.
