In addition, surveillance of the public by companies or by other individuals should be subject to conditions, and again, the opinion addresses the principles that govern these forms of ‘commercial’ or individual surveillance, and the manner in which the data so gathered may be used as part of a data mining or profiling system by private entities or the state. The digital revolution and subsequent advances in mobile, wireless and networked devices have significantly contributed to the development of security and surveillance technologies. New technologies offer the possibility of recording the everyday activities of billions of individuals across the globe. Our mobile phones can identify and pinpoint our location at any given moment, loyalty cards allow commercial entities to analyse our spending and track our personal preferences, keystroke software monitors our performance and productivity in the workplace and our electronic communications can be screened for key words or phrases by intelligence services. Moreover, personal data concerning our health, employment, travel and electronic communications are stored in databases, and data mining techniques allow for large amounts of personal data from these disparate sources to be organised and analysed, thereby facilitating the discovery of previously unknown relationships within these data. Security technologies are no longer discrete; the trend is toward convergence, creating more powerful networked systems. Thus, our everyday lives are scrutinised by many actors as never before, all made possible by developments in technology together with political choices or lack thereof.

The source of the ne bis in idem principle in European Union law is found in both the Protocol no. 7 to the Convention for the Protection of Human Rights and Fundamental Freedoms (Convention) and in the legal systems of many Member States. It is enshrined in the jurisprudence of the EU courts as a general principle of EU law. Furthermore, it has also been introduced into some international agreements concluded by the Member States, i.e. the Convention on the protection of the European Communities’ financial interests and the Convention on the fight against corruption, which remain an integral part of EU legislation, as well as in the Convention implementing the Schengen Agreement, which has been progressively integrated into EU legislation. Following the entry into force of the Treaty of Lisbon, which incorporates the Charter of Fundamental Rights of the European Union (Charter) into EU primary law, the provision on the application of the ne bis in idem principle is now applied in the European Union in areas broader than just the scope of the three abovementioned Conventions. The significance of this principle may also be strengthened following the accession of the EU to the Convention, as has been set forth in the new Article 6(2) TEU. The ne bis in idem principle has found its own, lasting place among the rights and guarantees of undertakings in proceedings conducted by the Commission and the national competition authorities (NCAs) of the Member States aimed at prosecuting and/or sanctioning parties for agreements non-compliant with EU competition law. However, it is still not applied in proceedings against agreements having a scope which transcends EU borders, conducted by the Commission or the NCAs of Member States on the one hand, and by the competition authorities of non-member States on the other. This approach is grounded both in the provisions of the Convention and in the provisions of the Charter.

Rapid technological change and globalization have created new challenges when it comes to the protection and processing of personal data. In 2018, Brazil presented a new law that has the proposal to inform how personal data should be collected and treated, to guarantee the security and integrity of the data holder. The General Law Data Protection - LGPD, was sanctioned on September 18th, 2020. Now, the citizen is the owner of his personal data, which means that he has rights over this information and can demand transparency from companies regarding its collection, storage, and use. This is a major change and, therefore, extremely important that everyone understands their role within LGPD. The purpose of this paper is to emphasize the principles of the General Law on Personal Data Protection, informing real cases of leakage of personal data and thus obtaining an understanding of the importance of gains that meet the interests of Internet users on the subject and its benefits to the entire Brazilian society.

Privacy ideas have had a long tradition within the UK and can be tracked prior to the common law and their recent appearance within the General Data Protection Regulation (GDPR)(Garcia-Alfaro et al., 2014). At the moment, Article 8 of the European Convention on Human Rights (ECHR) points out the right to privacy, which is also integrated into UK law owing to the Human Rights Act (HRA) of 1998 and also incorporated in the General Data Protection Regulation (Cornock, 2018). Despite the European Court of Human Rights, which is located in Strasbourg and not part of the European Union, it upholds privacy rights and data protection laws through its enforcement of the European Convention on Human Rights and Convention 108 and has also considered the question of the safeguards of personal data from the viewpoint of rights of access to such data (Zaeem and Barber, 2020).
