We hope to in the next two minutes communicate the view of youth to you on a Corruption Free India (CFI) and to suggest how MP’s can remove the trust deficit that is eroding the faith of youth in Parliament. We also want to communicate that the youth are passionate about CFI and are ready to volunteer to help MP’s by working 24x7 in shifts. CFI has a Single Point Agenda as outlined above. What do you think of the SPA? – “Let MP talk” . CFI believes that if the Lokpal bill is good then with continuous improvement it can become better. We need to pass a bill in this session not because Team Anna wants it but because 20000 + children die every month because of corruption . Do you agree that the cost of delay is enormous and therefore urgency is justified ? “Let MP talk” . There are those that say that RTI had 153 amendments in the standing committee as reason for not rushing but even with all this the bill missed out wasted work that bad RTI’s cause and protection to RTI activists. Activists keep dying because there is no focus on rapid improvement . Thus more debate is not necessarily good and rapid improvement based on real experience is essential. Do you agree? “Let MP talk” The world has changed and with hard work sixteen hours a day seven days a week and with a good structured two way communication process parliament can achieve the SPA that the youth of India want. With an announcement on national TV parliament in one fell swoop parliament could remove the trust deficit and convince Anna to stop fasting. Our idea of a petition to MP’s got 2500 signatures in 36 hours. Do you think that an announcement such as the one that we propose will work ? “Let MP talk” . Youth have passion and want to help. If you have time now or later we would like to share some of the work we have done and get your ideas on how we can help plus work out concrete next steps if any. As we work on the bill it is important to focus on the outcomes we want to achieve. A few outcomes that we want are listed above. Delhi spent over two years to pass an act to prevent defacement of Delhi by posters. Two years after the act Delhi remains defaced. We need to make sure that the Lokpal Bill will produce real outcomes. Do you agree ? “Let MP talk “ Lokpal cannot deliver outcomes if corruption is rampant. The system has to be changed such that corruption becomes an isolated instance instead of a rampant practice. To do this every public entity must be required by the Lokpal to put up their corruption elimination plan in public domain. If any citizen feels that the plan is defective then they should write to the Lokpal with concrete suggestions on why the plan is flawed and how to correct the flaws. The Lokpal should have a prevention wing that helps put adequate prevention plans in place. If the plan fails or a good plan is not submitted in a time bound manner the Lokpal should be able to take punitive action against the senior bureaucrat and/or minister. Do you agree that a prevention wing is essential for the Lokpal ? “Let MP talk “ Implementing a VDS (Voluntary Disclosure Scheme) where the identity is protected (maybe international agency is involved) and the person that discloses is protected from jail time or penalties up to the amount disclosed and returned: should be strongly considered because it will reduce the burden on the Lokpal and also let the Lokpal know the methods and channels used. If the corrupt fear that because whistleblowers now have protection and the independent Lokpal cannot be influenced and will use best practices for recovery then a lot of them will be tempted to come clean. For those who do not come clean, it will encourage the courts to give them a harsher sentence as they knowingly chose not to use VDS. All old cases should be pursued by a dedicated expert unit. The list above are some of the attributes that we want the Lokpal and the Special Courts to have. In order to eliminate corruption the Lokpal must be capable of acting independently . Absence of day-to-day political interference, fiscal/budgetary autonomy, strong research and prevention capabilities, power to freeze assets, power to protect informants, ability to monitor income and assets are some factors that will contribute to effective functioning of the Lokpal. Do you Agree? “Let MP speak” At the same time, the Lokpal should not become a hindrance to society and must remain accountable through legal standards, judicial review, public complaints and oversight, precise and comprehensive expenditure accountability. By retaining a proactive and prevention focused stance which is embedded in a comprehensive anticorruption strategy, careful planning and performance measurement and realistic expectations, lesser time and money will get spent on levying of penalties and pursuing cases. Do you agree? “Let M.P speak”. In addition, effective monitoring and metric based assessment of public institutions will enable the Lokpal to create new initiatives and implement new policies from time to time. This will ensure innovation and dynamism. Most importantly, however, will be the quality of training and the manner of selection of the staff of this institution. The staff will have to be in sufficient numbers with highly specialized skills, well-compensated, subject to integrity reviews and quick removal, with strong ethic of professionalism and integrity and a high morale. Having special courts with sentencing guidelines, plea bargains, discovery processes, affidavits ,remote hearing through technology and adequate safeguards for suspects are vital. We can learn and adapt from countries with successful ACA ( Anti Corruption Agencies) . The examples from Singapore may or may not be good for India but is worth researching what other countries do. The story of Hongkong which had rampant corruption in 1973 but was able to substantially improve in two years can be seen on http://www.icac.org.hk/new_icac/eng/abou/history/main_1.html . Do you agree ? “Let MP talk “ Based on a study of Hongkong ICAC you may find this Lokpal strawman interesting http://www.scribd.com/doc/61099593/LokPal-Strawman . As per this strawman the annual expense on Lokpal to fight corruption is 4200 crores which is 0.33% of expenditure budget of India. The government Lokpal spend is 100 crores. Given the benefits of reducing corruption 4200 crores is not unreasonable and with this transactional and big ticket corruption can be significantly reduced. However, just spending 100 crores will have little impact on corruption and will probably be a waste of expenditure. After so many months of deliberation the bill produced by the government is terrible. No other political party or MP has produced a bill better than the Jan Lokpal Bill which is why there is a huge trust deficit. Do you agree ? “Let MP talk “ To remove this trust deficit either the standing committee and/or political parties and/or private members need to modify the Jan Lokpal Bill with a detailed commentary on the changes made so that a consensus can be reached. Do you agree ? “ Let MP talk “ By modular approach we mean that the bill can be broken into logical modules and each module can be finalized so that by the end of the monsoon session which can be extended if necessary, the SPA of CFI is met. To get input the structure for people to provide input in a modular way must be laid out and the working papers with different viewpoints presented so that the input can be distilled and consensus reached.
