Introduction While it is a new practice for same sex couples to be granted the same form of legal recognition as heterosexual couples, same sex unions have been recorded for a long time worldwide. Gays have experienced discrimination by society and in the workplace. The U.S. government has adopted a policy to help gay people to avoid discrimination in the military called  The “Don’t Ask, Don’t Tell Policy”. President Obama also overturned the DOMA policy (Defense of Marriage Act) in order for same sex marriages to be recognized. Gay rights have come along way in America but there are still barriers that gays have to overcome.

  1. Welcome to our presentation. We hope to inform you of the facts of Gay Rights in society. Thank you for viewing our presentation and we hope you enjoy it.
  2. In our presentation we hope to portray some of the ways in which gay people have been discriminated against in society. We also will inform you of some of the policies that the United States government has adopted in order to make it easier for gay people to have the same rights as heterosexual people. Although America has come a long way in their efforts toward helping homosexual individuals, there is still some form of discrimination against homosexuals. Hopefully, more policies and procedures will be adopted in the future to make it easier for homosexuals in America.
  3. Bill Clinton made signed the DOMA act which stated that marriage is recognized as that between a man and a woman. On February 23, 2011, President Obama declared section 3 of DOMA to be unconstitutional. Obama plans to replace this act altogether with the Respect for Marriage Act which would not define marriage at the Federal level. The Department of Justice has been instructed to be concerned with upholding the Defense of Marriage Act. (CBSNEWS, 2011).
  4. In 2010 it was up to each individual state to allow for gay marriage to take place in their state or not. Arizona is the only state that has ever defeated a constitutional amendment defining marriage between a man and a woman (2006) but oassed the measure in 2008.
  5. The EEOC is responsible for enforcing federal employment discrimination laws. With current legislations on gay marriage, the rights of gays in the workplace is receiving more attention than ever. There are currently no federal laws that prohibit discrimination based on sexual orientation; however there a federal agencies, states and municipalities that prohibit discrimination based on sexual orientation. Although there are mechanisms in place to prohibit discrimination, discrimination continues to exist among or workforce. Corporate Human Resources Department – Many Fortune 500 companies are adapting to the acceptance of gay and lesbian employees in the workplace. The recognition of this group of people is important especially since the major issues are a partner’s rights to certain benefits. The benefits in question are the same benefits provided for heterosexual couples. Some of the benefits include health, relocation, public recognition of dependent status and at some point and time, social security benefits widowed spouses. State and Federal Laws – There are currently 20 states that prohibit discrimination based on sexual origin; California, Colorado, District of Columbia, Hawaii, Illinois, Iowa, Maine, Maryland, Massachusetts, Nevada, New Hampshire, New Jersey, New Mexico, New York, Oregon, Rhode Island, Vermont, Washington, and Wisconsin. There are still a large number of states that do not prohibit discrimination against this group. Where states do not prohibit discrimination, many city and county ordinances do. Political Strategies - Political strategies as it pertains to same sex marriage includes a comprehensive approach on gender related issues. The focus should be on equal treatment of same sex partners. Much of the controversy associated with the political views of this country as it pertains to same sex marriage comes down to the bottom line. Should same sex marriage be allowed or not?

Government Agencies – The government is the nation’s largest employer and they set the example for other employers to emulate as it pertains to the discrimination of employees based on their sexual orientation. Executive order 13087 prohibits discrimination based on sexual orientation. Although government agencies do not provide benefits to the partner’s of their employees, with the recent repeal of “Don’t Ask, Don’t Tell” it will be a matter of time before the implementation of benefit packages occurs. Religious Groups – The belief of same sex marriage among most religious groups is almost non-existent. Many religious groups believe that marriage should only exist between a men and women. Same sex marriage is viewed among this group as an abomination in accordance wit the teachings of the bible. Grass Root Organizations – On June 27, 1969 in New York’s Greenwich Village, the police raided a gay bar sparking what is known as the Stonewall Riots. The Stonewall Riots would prove to be the beginning of the gay and lesbian revolution towards the movement of civil rights in the United States. The riots inspired Lesbians, Gays, Bisexuals and Transgender also known as (LGBT) throughout the country to form a united front in support of gay rights. Within two years of the riots gay rights groups had been formed in every major city in the country.
  7. Gay marriage issues exist in other countries. Since 2011, ten countries have begun formalizing same sex marriages. Although in some countries same sex marriage is recognized, it is also illegal and punishable by death in many other countries. Denmark was one of the first countries to recognize same sex marriage in 1989. The Dutch were the first people to eliminate distinction between gays and straight. (CBS News, 2007). Canada now legalizes same sex marriages. In most parts of Africa, with the exception of South Africa, homosexuality is illegal. Both France and Germany have civil union laws and Britain is in the process of adopting them. Homosexuality is definitely viewed differently in each individual country.
  8. Homosexuality is stereotyped by most of society. Most of society feminize gay males and portray gay women as having masculine qualities. Society tends to overlook a gay person’s potential and they base them on what kind of lifestyle they live. Gay actors and actresses were even denied roles because of their open sexuality.
  9. “ Brokeback Mountain” is one of the more well known films based on the gay relationship between two males. This movie created outrage in the anti-gay community.
  10. Gay marriage does exist in other countries. Some countries that gay marriage exists in are Denmark, France, Germany, and Canada. Some countries recognize gay marriages but in some countries such as Saudi Arabia and Pakistan, it is illegal to be gay.
  11. Prior to 1993 when President Clinton put “Don’t Ask, Don’t Tell” into policy that it was legal to ask a recruit/candidate if they were currently or had ever been homosexual. Passing of that policy prohibited recruiters or higher ranking officials to discuss or question a service members sexuality. Many service members did not want to be forced to work alongside another service member of the same sex who was known to be homosexual. Based on fact or fiction, somehow it would effect their own performance. Anyone found to have lied about any such behavior or who was currently engaging in such behavior was dishonorably discharged from the military. President Obama has set that the Act will be repealed and anyone in any branch of the service can serve and not have to hide their sexual identity.

  13. An Arizona law requires married heterosexuals to get preference as adoptive parents. Utah and Mississippi ban gay couples from adoption. Ohio allows one partner to adopt a child as an individual but do not allow the couple to adopt. Lesbians are choosing to exercise their right, as women, to have children by using sperm from a reputable facility rather than giving up on their dream of having a biological child. Some of the donors of these sperm banks are open to be contacted by the child after the child reaches the age of 18 years.
