Cause: Alleged Fraud
Thesis: Was Dr. Kent Hovind wrongfully incarcerated?A thesis can’t be a question. This needs to be a
statement with a cause and effect claim.
Body Paragraph-Topic sentence 1: Dr. Kent Hovind was arrested on 58 federal charges, including failing to
pay $473, 818 in employee-related taxes in 2006. The Grand Jury alleged that Kent Hovind failed to pay
$473,818 in federal income, social security, and medicare taxes on employess at Creation Science Evangelism
ministry. This happened supposedly between March 31, 2001 and January 31, 2004. The unsealed indictment
alleges Kent Hovind paid his employees in cash and labeled them "missionaries" to avoid payroll tax and FICA
requirements. Kent Hovind also owns Dinosaur Adventure Land; error which he claims is part of his ministry.

Body Paragraph-Topic sentence 2: Dr. Kent Hovind claims he is employed by God, recieves no income, has no
expenses, and owns no property. Kent produced legally documented reciepts showing that all money owed
had been paid and that all money brought in was put towards all expenses for his ministry. Now, with this
statement and the legally documented proof that every dime was accounted for, was evidence alone of the
Amendment I of the Bill of Rights. The first Amendment in the Bill of Rights, in respect to religion, states that
"Congress shall make no law respecting an establishment of religion, or prohibiting the free excersice
thereof". (Forbes, 2010)
Body Paragraph_Topic sentence 3: Out of the 58 charges, 44 of those charges were due to evading bank
reporting requirements. According to IRS Topic 417, Traveling Evangelists are independent contractors (self-
employed) under common law. All earnings, wages, offerings, and fees recieved for performing marriages,
baptisms, funerals, etc., are subject to income tax. So, according to this topic, all Traveling Evangelists are
automatically employeed by common law. The details of this IRS law are under Publication 517. (Tax Topics,
2015)
Conclusion: From the evidence provided above of this case, one could conclude that this case should have
never been an issue at all. The physical evidence that Kent Hovind presented in court should have been
enough to dismiss the case; providing the fact the prosecution couldn't produce any physical evidence to
prove their arguements. According to Amendment I, The IRS Topic 417 should have never been permitted by
Congress. This "Topic 417" is clearly a violation of the first Amendment of the Bill of Rights. If the first
Amendment clearly states, "Congress shall make no law respecting an establishment of religion, or
prohibiting the free excersice thereof"; then the question here is why was this "tax law" permitted into
existance? How does "Common law" override our Amendments our forefathers gave for all to adhere to in

3. Effect: Wrongful incarceration
Thesis: Dr. Kent Hovind has been imprisoned for 8 years for Fraud and evading bank reporting requirements.
Body Paragraph-Topic sentence 1: If one evaluates the evidence, from both the prosecution and defense, one
can determine whether Dr. Kent Hovind was wrongfully incarcerated or not. Kent Hovind had four complaints
registered with the IRS over a course of 17 years. Back in 2002, during construction Kent failed to obtain
building permits. The members of Creation Science Evangelism claimed building permits violated their
"deeply held" religious beliefs. The constuction was of his "Dinosaur Adventure Land". (Religion News, 2006)
Body Paragraph-Topic sentence 2: One way to determine whether or not there was intent of Fraud; one must
take a look at his background. Dr. Kent Hovind was a Highschool teacher, whom taught Science specifically,
for 15 years. Before his incarceration, he was teaching Creationism, which is scriptural evidence of how the
universe was created. He traveled around the world teaching Creationism and the Bible and would debate
with other Evolutionist teachers on how ridiculous evolution is. One of his statements about evolution,
submitted to New York times, Kent said, "No one has ever observed a dog produce a non-dog." This common
sense statement alone disproved one theory of Evolution. (Forbes, 2013)
Body Paragraph-Topic sentence 3: Where Kent Hovind's rights violated according to the Bill of Rights?
According to Amendment 1, yes his rights were clearly violated. If his first Amendment was violated, then
Amendment VI was violated as well. Amendment VI states it is the right of the people to be secure in their
persons, houses, papers and effects, against unreasonable search and seizures, shall not be violated, and no
warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing
the place to be searched, and the persons or things to be seized. So, this brings the IRS Topic 417 into
question again. As one can see, with the evidence provided, Kent Hovind's rights may have been violated in

Conclusion: With all of the evidence presented above, one can conclude that Dr. Kent Hovind was indeed
wrongfully convicted and incarcerated. The violation of his Amendment I rights were just the beginning of
this case. The IRS Topic 417 comes into question of it's existance, according to Amendment I. One can also
see that seeing there was no evidence showing if the arrest was made warrantless or not; then Kent's
Amendment VI rights may have been violated here as well. In conclusion, with the evidence publically
presented; one can conclude Dr. Kent Hovind was wrongfully convicted and wrongfully incarcerated.
