DRILLING UPDATE: JAN-APR 2013
Section I - Overview
Permit Trends in the Marcellus & Utica Shale Region
With this, the fourth edition of the Marcellus and Utica Shale Databook series (the first of the 2013 editions), we’ve now built up permit analysis for
the past nearly 2 ½ years—all of 2011, all of 2012 and the first four months of 2013. We thought it would be interesting to show the trends over the
past two years and project where we believe permits may go in 2013.
The permit analysis for 2011 and 2012 is based on the number of what we call unique permits—discrete wells. Depending on the state, each stage of
drilling requires a number of permits as different parts of the process are permissioned, then completed and reviewed. The Databook’s “unique”
permit number means strip away all of the multiple permits for a single well and count each well once. To be fair, some “single” wells will receive a
permits in more than one period of time—so the same well may be counted in both 2011 and 2012, for example it may have been started in 2011 but
completed in 2012 (counted once in each calendar year). We believe such “double counting” across years is negligible in the final numbers. However,
you should be aware of it.
Our estimate for 2013 is crude, but we think, useful. We looked at the number of unique permits issued for the first four months of 2013 and
assumed the rest of the year would have the same activity, percentage wise, as the first four months. So we simply multiplied the numbers for
January through April by 3 to come up with an estimate for the entire year. Our sense, in reviewing the result, is that for those counties with the most
drilling activity, the numbers are likely estimated too high by some factor (maybe 10-20%), and for those with really low or now activity in the first
four months, the yearly estimate is too low.
That’s a weakness in this rather simplistic estimate. However,
as we’ve said, we believe it can be useful, taken with hard
numbers for 2011 and 2012 for spotting those counties where
activity is either going up or going down.
The chart to the right shows the aggregate across all counties
by state, to give you an overall sense of where permits are
headed. We believe permits are heading up in both the
Marcellus and Utica for 2013. The surprise is the potential
jump up in permits issued in West Virginia, a trend we believe
will continue in 2013 and beyond due to wet gas in WV. After
a softening in the PA Marcellus from 2011 to 2012, we believe
it will either stay around the same level or increase slightly in
2013. The Utica Shale continues to go up in 2013.
The next two pages show permit numbers broken out by
county within each state, with a nifty little trend indicator to
give you a quick visual understanding of whether that county
is seeing an increase or decrease in permit activity.

REGULATORY/LEGAL UPDATE
Pennsylvania
Permitting and drilling in Pennsylvania is regulated by the Department of Environmental Protection (DEP). A case before the PA Supreme
Court, Butler v Powers, was decided in April. It’s hard to overestimate the importance of this case. Pennsylvania has historically had a
“different” take on natural gas rights from other states. Going all the way back to a case in 1882, PA has had “the Dunham rule” which separates
natural gas rights from the broader concept of mineral rights. Natural gas rights are not automatically conveyed with mineral rights in PA. All of
the existing leases are based on that concept. A case from Susquehanna County, PA challenged it seeking to make natural gas part of mineral
rights. If that had happened, thousands of leases and the entire oil and gas industry would have been turned on its head with a myriad of
lawsuits. The PA Supreme Court decided to leave things the way they are. A second very important case still sits with the Supreme Court (and
has since late last year)—a decision on whether or not PA’s new Act 13 oil and gas drilling regulations can impose a statewide zoning standard
on all municipalities and supersede local zoning for oil and gas drilling. Local municipalities sued the state arguing “home rule” is best—they
know where drilling should and should not happen. The state and drilling industry say it’s too easy for local town boards to be packed with two
or three individuals who oppose drilling for philosophical reasons and the standards established in Act 13 by the state has crafted are more
even-handed and fair. Watch for this case to be settled sometime in 2013, likely before the next edition of the Databook due in September.
Ohio
Permitting and drilling in Ohio is regulated by the Department of Natural Resources (ODNR). The big story on the regulatory front in Ohio
continues to be taxes. Specifically, Gov. John Kasich (a Republican) introduced a plan to increase the severance tax in Ohio. He first submitted
his plan in 2012. The plan generated controversy with some—particularly in the drilling industry—who oppose it. Kasich’s fellow Republicans,
who control the state legislature, successfully blocked the plan last year. However, Kasich reintroduced the plan in 2013. Although it appeared
Republicans might accede to Kasich’s wishes, that has not yet happened. It’s still anyone’s guess what will happen with the severance tax. On
the regulation front, the ODNR has requested several non-budget items be re-included in the 2013 budget bill (items that were dropped along
with the severance tax idea). The items they want added back include: requirement that drilling waste material not be sent to landfills until
radium levels are analyzed and the results sent to the Department of Health, the Ohio EPA and the landfill itself; the creation of a permitting
process for treating brine waste before discharging it into the ground or bodies of water; the prohibition of hydraulic fracturing brine from use
on roads to control ice or dust; and the requirement that all oil and gas contracts be filed with the county recorder’s office, the landowner,
and/or the mineral interest owner within 30 days. No word yet on when/if/which of these items will be included in the 2013 budget bill.

Section I - Overview
#1 – The municipality or
operator name is followed by two
sets of numbers, with the second
number in parentheses. Example:
Jackson – 6 (4). The first number
- “6” in this case - shows the total
number of permits issued. The
second number - “(4)” in this case
- indicates how many wells the
permits were issued for. Usually a
single well requires several
permits during drilling, to allow
the driller to continue to the next
stage.
#2 – A purple dot indicates
where a well pad is located. Each
well pad can have from one to ten
wells on it. Typically a pad will
contain 2-4 wells. Because of the
size of the maps (vastly reduced
to show an entire county),
sometimes the purple dots will be
“on top of each other” and
sometimes will not be labeled
with a driller’s name.
#3 – The boundary of each
county is indicated with a blue
outline.
#4 – Major gas pipelines are
indicated with red lines and the
name of the pipeline somewhere
along the line.
#5 – The location for pipeline
compressor stations is indicated
by a green triangle–the name is
next to it.

  • 5. ©Marcellus and Utica Shale Databook 2013 – Volume 1 Sample Pages DRILLING UPDATE: JAN-APR 2013 Section I - Overview Permit Trends in the Marcellus & Utica Shale Region With this, the fourth edition of the Marcellus and Utica Shale Databook series (the first of the 2013 editions), we’ve now built up permit analysis for the past nearly 2 ½ years—all of 2011, all of 2012 and the first four months of 2013. We thought it would be interesting to show the trends over the past two years and project where we believe permits may go in 2013. The permit analysis for 2011 and 2012 is based on the number of what we call unique permits—discrete wells. Depending on the state, each stage of drilling requires a number of permits as different parts of the process are permissioned, then completed and reviewed. The Databook’s “unique” permit number means strip away all of the multiple permits for a single well and count each well once. To be fair, some “single” wells will receive a permits in more than one period of time—so the same well may be counted in both 2011 and 2012, for example it may have been started in 2011 but completed in 2012 (counted once in each calendar year). We believe such “double counting” across years is negligible in the final numbers. However, you should be aware of it. Our estimate for 2013 is crude, but we think, useful. We looked at the number of unique permits issued for the first four months of 2013 and assumed the rest of the year would have the same activity, percentage wise, as the first four months. So we simply multiplied the numbers for January through April by 3 to come up with an estimate for the entire year. Our sense, in reviewing the result, is that for those counties with the most drilling activity, the numbers are likely estimated too high by some factor (maybe 10-20%), and for those with really low or now activity in the first four months, the yearly estimate is too low. That’s a weakness in this rather simplistic estimate. However, as we’ve said, we believe it can be useful, taken with hard numbers for 2011 and 2012 for spotting those counties where activity is either going up or going down. The chart to the right shows the aggregate across all counties by state, to give you an overall sense of where permits are headed. We believe permits are heading up in both the Marcellus and Utica for 2013. The surprise is the potential jump up in permits issued in West Virginia, a trend we believe will continue in 2013 and beyond due to wet gas in WV. After a softening in the PA Marcellus from 2011 to 2012, we believe it will either stay around the same level or increase slightly in 2013. The Utica Shale continues to go up in 2013. The next two pages show permit numbers broken out by county within each state, with a nifty little trend indicator to give you a quick visual understanding of whether that county is seeing an increase or decrease in permit activity.
  • 6. ©Marcellus and Utica Shale Databook 2013 – Volume 1 Sample Pages REGULATORY/LEGAL UPDATE Pennsylvania Permitting and drilling in Pennsylvania is regulated by the Department of Environmental Protection (DEP). A case before the PA Supreme Court, Butler v Powers, was decided in April. It’s hard to overestimate the importance of this case. Pennsylvania has historically had a “different” take on natural gas rights from other states. Going all the way back to a case in 1882, PA has had “the Dunham rule” which separates natural gas rights from the broader concept of mineral rights. Natural gas rights are not automatically conveyed with mineral rights in PA. All of the existing leases are based on that concept. A case from Susquehanna County, PA challenged it seeking to make natural gas part of mineral rights. If that had happened, thousands of leases and the entire oil and gas industry would have been turned on its head with a myriad of lawsuits. The PA Supreme Court decided to leave things the way they are. A second very important case still sits with the Supreme Court (and has since late last year)—a decision on whether or not PA’s new Act 13 oil and gas drilling regulations can impose a statewide zoning standard on all municipalities and supersede local zoning for oil and gas drilling. Local municipalities sued the state arguing “home rule” is best—they know where drilling should and should not happen. The state and drilling industry say it’s too easy for local town boards to be packed with two or three individuals who oppose drilling for philosophical reasons and the standards established in Act 13 by the state has crafted are more even-handed and fair. Watch for this case to be settled sometime in 2013, likely before the next edition of the Databook due in September. Ohio Permitting and drilling in Ohio is regulated by the Department of Natural Resources (ODNR). The big story on the regulatory front in Ohio continues to be taxes. Specifically, Gov. John Kasich (a Republican) introduced a plan to increase the severance tax in Ohio. He first submitted his plan in 2012. The plan generated controversy with some—particularly in the drilling industry—who oppose it. Kasich’s fellow Republicans, who control the state legislature, successfully blocked the plan last year. However, Kasich reintroduced the plan in 2013. Although it appeared Republicans might accede to Kasich’s wishes, that has not yet happened. It’s still anyone’s guess what will happen with the severance tax. On the regulation front, the ODNR has requested several non-budget items be re-included in the 2013 budget bill (items that were dropped along with the severance tax idea). The items they want added back include: requirement that drilling waste material not be sent to landfills until radium levels are analyzed and the results sent to the Department of Health, the Ohio EPA and the landfill itself; the creation of a permitting process for treating brine waste before discharging it into the ground or bodies of water; the prohibition of hydraulic fracturing brine from use on roads to control ice or dust; and the requirement that all oil and gas contracts be filed with the county recorder’s office, the landowner, and/or the mineral interest owner within 30 days. No word yet on when/if/which of these items will be included in the 2013 budget bill. Section I - Overview

Example: Jackson – 6 (4). The first number - “6” in this case - shows the total number of permits issued. The second number - “(4)” in this case - indicates how many wells the permits were issued for. Usually a single well requires several permits during drilling, to allow the driller to continue to the next stage. #2 – A purple dot indicates where a well pad is located. Each well pad can have from one to ten wells on it. Typically a pad will contain 2-4 wells. Because of the size of the maps (vastly reduced to show an entire county), sometimes the purple dots will be “on top of each other” and sometimes will not be labeled with a driller’s name. #3 – The boundary of each county is indicated with a blue outline. #4 – Major gas pipelines are indicated with red lines and the name of the pipeline somewhere along the line. #5 – The location for pipeline compressor stations is indicated by a green triangle–the name is next to it.
