Legal status of the patent
The legal status of the patent (granted, pending, revoked, expired) may serve as indicator of the legal validity and life expectancy of the
patent. The more the legal status is valid, the more the patent will be maintained for a long time.
Patent age
The patent age may serve as indicator of the patent’s life expectancy. The lifetime of the patent is typically limited at 20-years, calculated
from the filing date, as long as the maintenance fees are paid. Furthermore, with increasing age, the underlying technology reaches a
higher degree of market penetration, but the older the patent, the higher the chance that the underlying technology has become
obsolete. The more the patent is old, the less it will be maintained for a long time.
Claims (scope and number)
The number of claims may serve as indicator of the scope of the invention. It is also correlated with the patent’s legal sustainability. The
more independent claims a patent has, the more the patent’s scope is important. The more claims a patent has, the higher the chance
that at least one will survive an invalidation procedure (legal robustness ).
Patent family size (Geographical coverage)
The geographical coverage of the patent’s protection may serve as indicator of the legal robustness and the exploitation potential of the
patent. The more the geographical protection is large, the more the potential sales volume will be high. The patent’s family size may be
also correlated with the patent’s value. The expansion of patent protection involves additional costs for every jurisdiction. If the applicant
chooses to spend additional money, the exclusion right should be worth the extra costs. The number of family members of a patent is
positively related to its potential value.

Search Report and Citation Analysis
Examiners’ reports and citation analysis enable to evaluate the technological quality, the legal robustness and the scope of the patent.
They also enable to evaluate the patent’s value. Moreover, exchanges between inventors and patent offices allow the understanding of
the grant procedure and applicant’s patenting strategy.
Patent data include citations to previous patents and to the non-patent literature. An analysis based on citation data from patent search
reports open up the possibility of tracing technological trajectories, and identifying reference patents and linkages between them. Our
methodology takes into account the number of citations, their categories and their origin.
Forward Citations
The higher the patent’s technological quality, the more inventions should build upon the underlying invention of the focal patent,
thus increasing the value of its exclusion right. A widely accepted patent value indicator that captures patent’s technological
quality is the number of forward citations a patent receives in the patent examination process, prior art that would limit the
patent’s novelty is identified. The more forward citations a patent receives, the higher is its contribution to the prior art, making it
a good proxy for patent’s technological quality. The number of forward citations a patent receives is positively related to its value.
Backward citations
A patent makes several references to other publications considered to be relevant prior art. If patents are found that are held
against the claims of the patent applied for, so-called backward references to prior patents are placed. The number of backward
references a patent gives measures the amount of extant technology in a technology field, the scope of the patent and the
patent’s technical novelty. The more the search report cites relevant prior art, the more the technology will be low and the legal
risk will be high. The number of backward citations a patent have is negatively related to its value.
Description of the invention
The quality of the description may serve as indicator of the patent’s technological validity. It is also correlated with the patent’s legal
sustainability. The more the description is descriptive, the more the technology is valid and the higher the chance that patent will survive
an invalidation procedure (legal robustness ).
Technology infringement capability
The infringement capability of the patented invention may serve as indicator of the technological quality and the life expectancy of the
patent. The more the technology is easy to copy, the less the patent will be maintained for a long time.

Innovation type
The type of the patented invention (incremental, differential, radical, breakthrough) may serve as indicator of the patent’s technological
quality. It is also correlated with the exploitation potential of the patent. The more the technology is innovative, the more the patent will
offer new opportunities.
Competitors/Applicant type
The size of competitors/applicant (Multinational, SME, startup) may serve as indicator of the patent’s life expectancy. The more the
competitors size is important, the more it will be difficult to maintain the patent. The more the assignee size is important, the more the
patent will be well defended against any lawsuit.
Application field
The application field of the patented invention (niche market, limited, large market) may serve as indicator of the scope of the patent and
its exploitation potential. The more the number of applications is important, the more the potential sales volume will be high.
Innovation intensity in the field of application
The number of similar patents published during last years may serve as indicator of the patent’s life expectancy. The more the business
sector is competitive (technology renewal), the less the patent will be maintained for a long time.
Geographic coverage of applications
The geographic coverage of the patented invention‘s applications (world, emerging coountries, national …) may serve as indicator of the
patent’s exploitation potential. The more the application coverage concerned by the patent is important, the more the potential sales
volume will be high.
Market size
The market size targeted by the patented invention may serve as indicator of the patent’s exploitation potential. The more the market size
concerned by the patent is important, the more the potential sales volume will be large.

We perform an in-depth analysis of citations
An analysis based on citation data from patents open up the possibility of tracing technological trajectories, and
identifying reference patents (“seminal” patents) and linkages between them. Our methodology take into
account the number of citations, their categories (X, Y, A …) and their origin (type of citing applicant).
Furthermore, blocking patents (potential litigation) may be identify by taking into account the number of
different applicants which cite them.

Introduction
Patent due diligence is a particular investigation about a patent portfolio. Due diligence is often done prior to
patent acquisition or licensing agreement, and can help capital fundraising process, M&A (buy or sell side) or
private equity, so that the potential purchaser/investor knows more about the asset that he is acquiring.
The objective of a patent due diligence investigation is to reveal the strength of the patent portfolio (patent
validity, patent enforceability, patent prosecution events, patent infringement …). Because every patent is
unique, patent due diligence should be handled with an individualized approach on a patent-by-patent or
portfolio-by-portfolio basis.
Full search on the ownership of patents, the patent history and maintenance fees to ensure that rights
are still in force, and confirmation of the validity of the information being presented.
Ascertain whether patents are the subject of any litigation or infringement suits.
