This document discusses a request for a TCEQ public meeting regarding a proposed Type IV disposal facility called the Brazos Valley Disposal Facility. The proposed 42-acre facility would accept construction and demolition waste, be located 1300 feet north of FM 60, and have a capacity of 4.2 million cubic yards over its estimated 7.4 year life. Staff is recommending city council approval of a resolution requesting TCEQ schedule a public meeting on the proposed permit given public interest in the application.
7. Permit Process
Permit application submitted to the TCEQ on June 3, 2011 by CCAA, LLC (CCAA),
also known as Brazos Valley Recycling.
Permit under technical review for 9 months.
Permit submitted to the Brazos Valley Council of Governments Solid Waste Advisory
Board (SWAC) for a regional solid waste management plan conformance review. On
January 20, 2012 the SWAC, in a unanimous vote, found the application to be in non-
conformance with the Regional Solid Waste Management Plan (Non - binding).
On May 1, 2012 TCEQ Executive Director issues Notice of Application and
Preliminary Decision deeming permit as technically complete, opening 30 day public
comment period.
The permit has received 2 comments in opposition to the facility.
8. Public Meeting
The Preliminary Decision Notice states:
“The purpose of a public meeting is to provide the opportunity to submit comments or
to ask questions about the application. TCEQ holds a public meeting if the Executive
Director determines that there is a significant degree of public interest in the
application or if requested by a local legislator. A public meeting is not a contested
case hearing.”
9. Staff Recommendation
Staff recommends Council approval of a resolution requesting the Texas Commission
on Environmental Quality Executive Director to schedule a public meeting concerning
a proposed permit to operate the Brazos Valley Disposal Facility, a Municipal Solid
Waste Type IV disposal facility.
