Decision regarding the possibility of coexistence between brand
and company name in the same commercial segment

A Sexta Câmara Cível do Tribunal de
Justiça do Rio Grande do Sul manteve a
sentença de primeiro grau que
reconheceu a possibilidade de
convivência harmônica entre marca e
nome empresarial de empresas do
mesmo segmento comercial
(“Computech”).
O registro de marca da Autora gaúcha foi
depositado em 1996 e concedido em
1999 pelo INPI, enquanto o nome
empresarial da Ré foi devidamente
registrado na Junta Comercial de Curitiba
em 1997.
Dear Clients,
The Sixth Civil Chamber of the Rio Grande do
Sul State Court of Appeals upheld a lower
court verdict that recognized the possibility of
harmonious coexistence between a brand
and business name (“Computech”) of
companies in the same commercial segment.
The plaintiff, from the state of Rio Grande do
Sul, filed a trademark application with the
National Industrial Property Institute (INPI) in
1996, and registration was granted in 1999,
while the defendant, a company located in
the city of Curitiba in the neighboring state of
Paraná, had registered its business name with
that state’s Commercial Registry Board in
1997.

2. Ainda, conforme alegação da Ré, este
desconhecia a existência da marca da
Autora, motivo pelo qual ambas as partes
conviviam harmoniosamente por 16 anos
no mercado.
Mencionando o posicionamento do
Superior Tribunal de Justiça e seguindo o
entendimento da juíza a quo Cláudia
Maria Hardt, da 19ª Vara Cível do Foro
Central de Porto Alegre, o
desembargador relator Rinez da Trindade
manteve a sentença de primeiro grau, na
qual previu que, em não se tratando de
marca de alto renome ou de marca
notoriamente conhecida, aplicar-se-á os
princípios da territorialidade e da
especificidade para resolução deste tipo
de colidência.
Assim, em virtude das atividades serem
exercidas em âmbitos territoriais
distintos, o pedido de abstenção de uso
de marca foi rejeitado, possibilitando o
uso comum da expressão “Computech”
por uma empresa de informática de Porto
Alegre e por outra similar com sede em
Curitiba.
Cumpre observar que, segundo o
acórdão, o nome empresarial
devidamente registrado perante a Junta
Comercial possui proteção em qualquer
segmento de atividade dentro do âmbito
do seu território estadual. Já o registro
de marca devidamente concedido pelo
INPI gozará de proteção nacional, porém
adstrito ao mesmo ramo de atividade ou
classes de serviços e produtos oferecidos
através da marca, conforme seu
enquadramento perante o INPI.
The defendant alleged that it was
unaware of the existence of the plaintiff’s
trademark application at the time, and
that the two parties had coexisted
harmoniously in the market for 16 years.
Mentioning the position of the Superior
Tribunal of Justice (the highest court for
non-constitutional matters), the reporting
judge of the Sixth Civil Chamber, Rinez da
Trindade, upheld the verdict of the lower
court judge, Cláudia Maria Hardt, of the
19th Civil Court of Porto Alegre, that when
two brands are not well known or highly
renowned lower, the principles of
territoriality and specificity must be
applied to resolve this type of conflict.
Therefore, since the activities of the two
companies are limited to distinct
territories, the pleading for cessation of
use of the brand was rejected, enabling
using the term “Computech” by an
informatics company in Porto Alegre and
another similar firm located in Curitiba.
It should be noted that according to the
appellate decision, a business name
registered with the state commercial
registry enjoys projection in all segments
of activity within the particular state,
while a trademark registered with the INPI
is protected nationwide, but is limited to
the same field of activity or classes of
products and/or services identified by the
brand, according to the classification of
the INPI.
