Dear Burr Ridge Market on the Green Prospective Vendor,
Thank you for taking the time to apply for one of the best new farmers’ markets around town! We are pleased
with the momentum we have gained in the past two years and look forward to building upon our success and
community tie-ins.
Burr Ridge is a new retail area that is rapidly expanding and we have been on the forefront of creating one of
the most anticipated events of the year. Not only have we fed community’s knowledge of why it is important to
shop local, but we have watched as the demand for quality vendors and offerings has grown. Hosting this
event at the Village Center is advantageous for us and the 30+ retailers and restaurants who reside here.
Our top priority has always been building great relationships with our farmers, vendors and patrons. We feel
our reputation is what makes our location distinct and will launch us into being recognized as the premier
market in the western suburbs. Burr Ridge’s slogan is “A Very Special Place,” and we aim to create it on the
Village Green each and every week. A few exciting changes to this year’s market include:
• Extended season: Adjusted calendar to 16-weeks, from June 17- September 31, 2010.
• Operating hours: Market will run from 9am-2pm each Thursday morning.
• Demo Kitchen: Local and regional chefs will create a weekly schedule of themed topics designed for
children and adults alike.
• Increased Sponsorship: Areas of value have been identified and an increased community role in the
market will be evident.
• Organic/Sustainable: Increased focus on this element in vendor selection, educational topics and
community alliances.

Market on the Green (the "Market") only such items as listed on my application form. Further, I
acknowledge full responsibility for all activities conducted through the term of the Market, abide by the
Market rules and regulations, and agree to comply with all conditions and restrictions for the Permit,
including but not limited to, the condition requiring me to indemnify and hold harmless the Burr Ridge Park
District, its officers, agents and employees and to waive any claims against the Burr Ridge Park District, as
provided in the permit.
I release and hold harmless NorthMarq Real Estate Services LLC, Opus North Corporation, Opus Real
Estate IL VII Burr Ridge L.L.C., 450 Village Center Drive Condo Association, 570 Village Center Drive

V. Permit & Signature Form

THIS PERMIT IS SUBJECT TO THE TERMS,
CONDITIONS AND RESTRICTIONS PRINTED BELOW
1. The Applicant shall observe and comply with the rules and regulations promulgated by the Burr Ridge Park
District for the Market on the Green and shall cooperate with the Park District in the implementation of those rules
and regulations.
2. The Applicant shall comply with all applicable federal, state and local laws, ordinances, rules and regulations and
Cook County Health Regulations.
3. The Applicant agrees that in performing under this Permit, Applicant will not discriminate against any worker,
employee or any member of the public, because of race, creed, color, religion, age, sex, mental or physical
disability.
4. The Applicant by this means acknowledges that it has inspected the Market on the Green’s Site, that it is satisfied
with its physical condition and its suitability for its intended use, and that it accepts the Market on the Green’s Site
in the condition existing at the beginning of the Market season.
5. The Applicant agrees that no improvements or alterations, temporary or permanent, structural or non-structural,
shall be made to or on the Market Site without the express written consent of the Burr Ridge Park District.
6. The Applicant shall maintain the Market on the Green Site in a safe, sanitary and sightly condition and in good
repair.
7. The Applicant agrees that nothing contained in this Permit is intended or should be construed as in any way as
creating or establishing the relationship of partners or joint ventures between the Park District and the Applicant or
as constituting the Applicant or any officer, employer or agent of the Applicant as agent, representative or
employee of the Park District for any purpose or in any manner whatsoever, and that it shall not represent to any
third parties that such is the case.
8. This Permit may be terminated without notice in the event of threat to the public health or public safety as may be
determined in the sole discretion of the or in the event the determines to its sole satisfaction that Applicant or any
employee of Applicant is engaging, or has engaged in any illegal activity or unethical business practice including,
but not limited to, short-weighing, short-changing, adulteration or misbranding of items offered for sale, selling
impure or spoiled foods or any similar practice. The Burr Ridge Park District, its officials, employees and agents
shall not be liable to the Applicant for any losses incurred by reason of such termination.
9. The Applicant agrees that the Burr Ridge Park District, its officials, employees, and agents, shall not be liable for
injury to the Applicant’s business or any loss of income or for damage to the goods, wares, merchandise or other
property of the Applicant, its employees, invitees, customers, or any other person in or about the Market Site, nor

shall the Park District, its officials, employees, and agents, be liable for injury to the person of the Applicant, its
employees, agents, vendors or contractors, whether such damage or injury is caused by or results from fire,
steam, electricity, gas, water or rain, or from the breakage, leakage, obstruction or other defects of the Market
Site, or from any other cause, whether the damage or injury results from conditions arising upon the Market Site
or from other sources or places, and regardless of whether the cause of such damage or injury or the means of
repairing the same is inaccessible to the Applicant. The Burr Ridge Park District, its officials, employees and
agents, shall not be liable for any damages arising, directly or indirectly, from any act or neglect of any other
person on the Market Site.
10. (a) It is expressly understood, agreed upon and the specific intent of the parties that the Park District, its officers,
trustees, agents and employees will at no time assume responsibility or liability for actions of Applicant or
Applicant’s employees, agents or representatives under this Permit. Applicant agrees to fully defend, with the
attorney chosen by the Park District, indemnify and hold harmless the Park District, its officers, trustees, agents
and employees from and against all claims, suits, damages, losses and expenses of any kind whatsoever,
including attorney's fees, arising directly or indirectly out of or by reason of the Applicant and Applicant’s
employees, agents and representatives action or inactions under this Permit.
It is further agreed by the parties that in any and all claims against the Park District, its officers, trustees, agents
or employees by an employee of Applicant, anyone directly or indirectly employed by Applicant or anyone for
whose acts Applicant may be liable, the indemnification obligation under this provision shall not be limited in any
way by any limitation on the amounts or type of damages, compensation or benefits payable by or for Applicant
under Workers' or Workmen’s Compensation Acts, disability benefit acts or other employee benefit acts.
(b) Applicant promises and hereby agrees to release, waive, covenant not to sue and forever discharge the Park
District, its officers, trustees, agents and employees for and from any personal injury claim, suit or action or
Workmen's Compensation claim, suit or action, whether or not well-founded in fact or in law, which Applicant, its
employees, agents and representatives has, or may have, arising out of or relating to the actions to be taken
under this Permit by Applicant, its employees, agents and representatives.
(c) In the event that any claim, action, suit or proceeding is brought against Applicant in connection with or that in
any way refers or relates to the activity provided pursuant to this Permit, it shall within 48 hours have written
notice of that fact given to the Park District by certified mail.
(d) Notwithstanding the foregoing, nothing in this Permit should be construed as an effort on or by the Park
District, its trustees, officers, agents and employees to be indemnified for liability caused by the negligence or
intentional acts of a party indemnified hereunder.
11. It is specifically recognized, understood and agreed between the parties that in the event that the Park District is
in any way deemed to be in breach of this Permit or any provisions or terms of it, the only claim, suit or action that
may be brought against the Park District, its officers, trustees, agents and employees is a breach of contract claim
for money damages only, and that in the event of a violation by the Park District of this Permit the Park District will
pay, at most, as liquidated damages to Applicant, the sum of money that Applicant paid to the Village for this
Permit which shall not exceed $250.00. The parties further recognize and agree that the different types of claims
that could possibly be made by Applicant are difficult of ascertainment, and it is the specific intention of the parties
that the Park District, its officers, trustees, agents and employees shall never at any time be held liable to
Applicant or its heirs or successors for any amount of money that is greater than the amount identified in this
paragraph.
In recognition and agreement that its damage award against the Park District may be limited, and except for that
amount identified in the paragraph above, Applicant hereby forever waives, releases and dismisses the Park
District, its officers, trustees, agents and employees of and from any and all claims, debts, dues and obligations of

every kind and nature that it may have either directly or indirectly that arises or grows out of or may arise or grow
out of this Permit. Applicant specifically waives and releases the Park District, its officers, trustees, agents and
employees from any and all claims, debts, dues and obligations of every kind and nature under the Illinois and
United States Constitutions as well as under any federal or state statute or law, including but not limited to the
Civil Rights Act. Applicant further waives all remedies which are available to it for the violation of any of the terms
of this Permit, including but not limited to the equitable remedy of specific performance, and agrees not to seek
injunctive relief of any sort. Except for a claim for money damages as set forth above, which damages are limited,
Applicant covenants not to sue the Park District, its officers, trustees, agents and employees for a violation of any
provisions or terms of this Permit and the Park District’s responsibilities and obligations under it.
12. The Applicant shall not assign, transfer, pledge, sublet, surrender or otherwise encumber or dispose of this Permit
or any portion of it or any rights and privileges created by it and shall not permit any other person or persons,
company or corporation to use or occupy the Market Site or any part of it without the prior written consent of the
Park District.

VI. Market Rules for Vendors
Please read the following rules and regulations carefully, and keep for your records.
A. Display Guidelines
• We will operate as a rain or shine policy. In the event of poor weather, we reserve the right to
cancel on-site assistance, musicians, cooking demonstrations, and children’s events.
• Products must be sold directly from tables in your assigned area. Unless approved by Market
Coordinator, all cars/vans/trucks or trailers must be off the market street no later than 8:45 am.
Ample parking is located behind the buildings on the east and west side.
• Vendors must furnish their own tables, chairs, tents, tent leg weights, table cloths (cloth must
reach the ground on front and sides), signage, display arrangements and rain protection as the
Market will not supply them.
• Ingredients list must be displayed on all items.
• The Market is an open area with no shelter provided. We request all vendors to display their
products in a professional manor.
• Due to safety concerns and insurance liability, no children under 10 years of age will be allowed
to participate as or with vendors.
• The Market is a smoke-free environment, and smoking is NOT permitted within 100’ of the
Village Green. We ask that you go to the vendor outdoor parking lots and refrain from loitering
near the four main entrances/corners, breezeway or parking garage entrances if you smoke.
• Please be respectful of the Village Center residents by keeping noise to a minimum in the
morning during set-up.
• All products must be clearly labeled with item, price, and city/state if grown outside of Illinois. All
organic products must be labeled “Organic.” Prices cannot be higher than other markets for
your specific product.
• Samples are encouraged. If you are providing samples of any of your goods, you must be
approved by Cook County Department of Public Health. and the Market Coordinators.
Sanitation guidelines state you must provide single service disposable utensils and containers,
three-container dish washing set-up with detergent, potable rinse water, sanitizer, sanitizer test
strips, and hand-washing station (potable water , catch basin (bucket), disposable towels and
soap. Cook County Department of Public Health guidelines are also available by contacting
Kamala Nagaraj at (708) 974-7118.
• Please consider attempting to decrease your plastic bag usage when possible. One suggestion
is ask patrons if they need a bag rather than automatically supplying one. Complimentary
shopping carts as well as pickup/drop-off service are available near the entrance at the
Information Booth.
• Vendors must remove all waste and refuse from their spaces before leaving the Market.
• For safety reasons, all vendors must stay until the end of each market day even if you run out of
the product. The Market closes at 2:00pm.

weights/$25.00. Tablecloths and table skirts with your logo can be purchased from HMC Display,

B. Vendor Guidelines
• A “grower” or “producer” is any person offering for sale articles for human consumption, such as
fruits or their juices, vegetables, edible grains, nuts and berries, and apiary products or non-
edible articles such as cut or potted flowers, which articles have been raised or prepared by the
grower or producer, members of his/her family or by persons in his/her employ.
• No vendor is allowed to reserve space for another vendor.
• Designated spaces will be assigned with priority given to past participants and seasonal
vendors as well as any vendors requiring electric outlets or special needs. Space allotments
based on availability and are at the Market Coordinator’s discretion.
• In the event that you will arrive late, are ill or have an emergency, please contact one of the
Coordinators listed as soon as possible: Laura Valcour-(630) 835-7026, Lavonne Campbell
(630) 464-1736 or Kimberly Mans at (630) 770-1322. We would appreciate a call at least 24
hours in advance if you know you will not be attending the market.
C. Cooperative Growing
**If you need a Co-Op Grower Affidavit, please contact Laura by phone or email.**
• An accepted grower of the Burr Ridge Farmers’ Market may be permitted to sell the homegrown
produce of another grower or producer upon approval by the Market Coordinator following the
completion of the enclosed affidavit sign by both the permittee as well as the grower and within
the guidelines of our four-state region (IL, IN, WI, and MI).
• Co-op Rule: 20 percent of the total number of products brought to the Burr Ridge Farmers
Market can be procured from a member of your pre-described “Farm-Farm” co-op agreement.
Example: You bring 10 different products to the market; ONLY 2 of those 10 products can be
part of a cooperative agreement.
• All co-op members actively grow/produce what they sell at the market.
• 100 percent of the products sold by the co-op must come from the co-op farm.
• All co-op members/farms must provide their own completed application form and individual
affidavits, in conjunction with the seller’s application.
• The co-op must be a farmer-to-farmer relationship-no auction, wholesaler, or produce house
product qualifies.
• Locally grown. - If you co-op with a farmer within the guidelines of our co-op agreement, your
co-op must be within our four-state region (IL, IN, WI, MI). Purchasing from a wholesaler is not
allowed, and those found doing so will be removed from our market.
WHO ENFORCES THE MARKET RULES?
The Market on the Green Coordinators have full authority to enforce all rules. Violation or falsification of any of
the conditions as set forth in these legal documents will result in the revocation of privileges to sell any product
at the Burr Ridge Farmers’ Market.
