Opposing Forces Drive 2014 Litigation Market—An Impetus for New Business
Activity and New Matters to Surge
60.7% of clients expect to see a jump in the number of litigation matters they will be handling
in 2014. Each new matter represents an opportunity for new business. Corporate clients will be
busier and more focused on litigation.
Spending Is Heading Down
Litigation is the largest part of most medium- and large-sized companies’ legal spending,
accounting for 38–41% of a typical corporate legal budget. Companies have been attacking
litigation costs with a vengeance since 2010. In 2013, we see more aggressive and widespread
use of early case assessment (ECA) as a cost management tool. The combination of ECA,
alternative fees, budget enforcement, alternative staffing and a focus on settlements
convinces corporate counsel they can manage the new surge in matters with minimal, if any,
spending increase.
The law firms who can change their approach to help drive these costs down and market to
the new surge of business will fare well in a new twist to the market.

Research Methodology and Approach
BTI Litigation Outlook draws on more than 3,700 interviews conducted over the span of 13 years. BTI’s
ongoing Annual Survey of General Counsel includes between 50% and 55% of companies participating in prior
years. This approach provides for accurate analysis of longitudinal trends while simultaneously allowing for
insights into new, changing and up-and-coming opportunities.
Spending, budget and practice assessments for 2013 and 2014 are based on 300 new one-on-one telephone
interviews with decision-makers at top-spending companies:
• Average revenue of $14.3 billion
• Median revenue of $4.0 billion
This year’s new analysis relies on interviews conducted between March 11, 2013 and June 28, 2013 with
legal decision-makers, including:
• Head of Litigation
• Chief and Vice President of Litigation
• General Counsel
• Direct report to General Counsel
BTI conducts all interviews using multiple techniques. These include:

BTI’s ongoing Annual Survey of General Counsel includes between 50% and 55% of companies participating in prior years. This approach provides for accurate analysis of longitudinal trends while simultaneously allowing for insights into new, changing and up-and-coming opportunities.
